(NCDCM) m response to NCDOT s recent permrt modification request for this pro�ect Previously submitted permrt drawings have not changed however a revised �mpact summary sheet and updated Ecosystem Enhancement Program (EEP) acceptance letter are included wrth this letter Excavation at Site 2 tn non ripar�an wetlands has increased by 0 23 acre and mechanized clearing in non ripanan wetlands has increased 0 09 acre Permanent fill for non ripar�an wetland impacts at Srte 2 has been reduced by 0 10 acre Th�s was accompl�shed by util�zmg more of the existing abandoned railroad causeway The portion of these wetlands ong�nally perm�tted for �mpacts was defined as non r�parian An addrtional tr�butary and wetlands at Srte 2 (service road for Ramp IB PC Sta 18+94 25) on U 4007B have been was evaluated ut�lizing L�ght Detection and Rang�ng (LiDAR) NCDOT generated topographic contours N C Wetland Assessment Method (NCWAM) and the Soil Survey of Onslow County After analyzing this mformat�on the contour �ntervals from the topographic maps and the soil survey support that these wetlands are non riparian LIDAR showed a crenulat�on that would deftne these wetlands as ripar�an under NCWAM However a road �s parallel to one side of the contour �nterval and the elevat�on on either side of the road was the same W�th the available references used to evaluate these wetlands characterizing th�s system being non r�par�an and the uncertainty of the L�DAR interpretat�on the wetlands at Srte 2 are cons�dered non riparian �� Net nonr iparian wetland impacts have increased by 0 22 acre which mcreases total permanent impacts for � tU 4007B tor2�9 acres� Th°e EEP will provide addrtional compensatory mrtigation for the unavo�dable non ripar�an wetland impacts due'to U 4007B Due to the addrt�onal impacts occurring at non riparian wetlands mrtigat�on from the Clay Hill Farm Mrtigat�on Srte w�ll not be debrted as proposed in the permrt modification request dated September 12 2011 Proposed impacts of 0 02 ac of fill in surface waters are proposed for the recently added tributary Compensatory mrt�gation for this �mpact is not proposed due to the fact that the feature �s cons�dered surface waters and not a stream Resources Sect�on 404 Permrt NCDOT requests that the USACE review this mformation and issue a modificat�on for the Individual 404 Permit issued September 1 2010 as required for the above described activities Section 401 Permrt NCDOT requests that the NCDWQ rev�ew this information and issue a mod�fication for the Individua1401 Certificat�on issued August 26 2010 as required for the above described activrt�es In accordance with 15A NCAC 2H 0501(a) we are providmg five copies of this mformation to the NCDWQ for their approval The prev�ously submitted permrt mod�fication request dated September 12 20ll authorized $570 to act as payment for process�ng the permit mod�fication CAMA The NCDOT certifies that the proposed act�vity includmg this additional informat�on compl�es w�th the enforceable policies of North Carolina s approved management program and wtll be conducted in a manner consistent w�th such program Based on these changes
