Thank you for your letter. I will add it to the administrative record. As I
mentioned in my email to Mr. Morrison, I am more than willing to review any
draft mitigation plan (as LMG knows, they can submit either a hardcopy or
electronic copy) and provide general comments at this time. Please be aware,
that from the Corps regulatory responsibility, it is premature for us to
issue any "final" recommendations or comments prior to the closing of the
Public Notice as we are still in the process of receiving and evaluating
public and agency comments and concerns, some of which relate directly to our
404(b)(1) analysis and compensatory mitigation. Land Management Group, Mr.
Bromby and Mr. Dorney are all familiar with the Corps' regulations and
guidelines regarding no-net-loss, functional replacement and the April 2008
mitigation rule and I anticipate that your draft proposal will include
thoughtful, scientific and comprehensive consideration of those requirements.
