Mr McMillan
The Western Wake Regional Wastewater Management Facility (the permittee) hereby requests
authorization of an encroachment into the protected riparian buffer The sub�ect pro�ect has
been authorized under Section 401 of the Clean Water Act under DWQ#2006 1203 At the
time the permit application for the Water Quality Certification was submitted the riparian buffers
in the vicinity of the proposed pro�ect were not protected During the permit application review
period the Jordan Lake Watershed Buffer Rules were implemented Therefore an
authorization to encroach in the riparian buffers is required for the proposed pro�ect to proceed
Impacts to riparian buffers include exempt and allowable activities Exempt activities include
perpendicular crossings with an underground nonelectric utility line that will affect
approximately 9 846 square feet of Zone 2 buffers and 13 096 square feet of Zone 1 buffers
Allowable activities include non perpendicular encroachments with an underground nonelectric
utility line that will affect approximately 7 901 square feet of Zone 2 buffers and no Zone 1
buffers

Avoidance of impacts is only possible by implementing a no bwld option which does not satisfy the need for the pro�ect
Crossings of streams with protected riparian buffers are designed to be within 15 degrees of perpendicular to the stream
Crossings at B5 and 66 are as near to perpendicular as feasible given the natural meander of these two tnbutanes to Reedy
Branch and the necessity to locate the pipe in a topographic low area Further measures to reduce the area of buffer
impacted at these crossmgs would result in an increase m the impacts to the buffer along Reedy Branch In order to minimize
the impacts to the buffer along Reedy Branch carefui consideration was given to all viable stream crossing locations within
