I just received a notice from the Office of Administrative Hearings on the above and our request for a hearing. You were listed as a witness. I just wanted to bring you up to speed on this. We had no choice but to file for an Administrative Hearing because there were erroneous findings of fact in our notice of penalty. First and foremost, the Civil Penalty was addressed and assessed against "Carolina Water Service, Inc.". The spill occurred in our Fairfield Mountains system which is owned and operated by CWS Systems, Inc. The two companies are not the same but both are owned by the same parent - but it is important we clear this mistake up. This had nothing to do with Carolina Water Service, Inc. In fact Carolina Water Service, Inc. is not even an official company name in this state. The legal name for that company is "Carolina Water Service, Inc. of North Carolina" but it doesn't matter because it should be assessed against CWS Systems, Inc. Second, we were accused of not providing public notice of the spill when we did and have a notarized statement from the paper to that affect. When an NOV is issued, we only have three ways to reply. One is to pay the fine and accept all findings of fact. The other is to ask for remission - but still accept all findings of fact. And last - request a hearing to contest any facts that were not correct and that is why we filed. The system has 279 man holes, five lift stations (all with telemetry), 465 sewer customers and 1,107 water customers. 3,500 feet of line was cleaned last year. All lift stations are checked three times each week. Could you please elaborate on which specific section of .0113 (or other) is being used to allow .0403 to become applicable?
