Please reference our May 27, 2011 letter to you regardmg the non compliance with the terms
and conditions of the January 15, 2004 Department of the Army(DA)venfication to utilize
Regional Generai Permrt(RGP) 198000291 a,nd subsequent September 9 2004 and October 17
2007 modifications, issued to the North Carolma Aquanum at Pme Knoll Shores(Aquarium) for
impacts to waters of the U S , specifically wetlands abutting Bogue Sound m the Town of Pme
Knoll Shores Carteret County,North Cazolma Specifically the Aquanum did not comply with
the approved rrutigation plan by failing to execute and record a Conservation Easement to
preserve remairung and created on srte wetlands
On October 19 2011 the Corps received your alternative mitigation proposal and request
for a new DA authonzation Specifically, you now propose to provide(after the fact)a 1 1 m-
lieu fee payment to the North Carolma Ecosystem Enhancement Program(NC EEP) for the 0 25
acres of permanent npanan wetland impact instead of on srte wetland creation and preservation
Upon review of your proposal pursuant to the Clean Water Act Section 404(b)(1) guidelmes and
the 2008 Final Rule for Compensatory Mitigation for Losses of Aquahc Resources(33 CFR
332) the Corps finds your plan acceptable As such please find the enclosed General Permit
Venfication Regional General Permrt 198000291 and Special Condrtions
Please be aware that you are responsible for adhenng to all terms and conditions of this

Investigahon Report and its Bio Report to the appropnate Corps of Engmeers field office
thereby mitiating federal review of the pro�ect The Corps upon receipt of an application will
tmmediately assign an act�on identif cat�on number acknowledge receipt thereof and examine
the application to assure that it can be processed pursuant to tlus programmatic general permit

The applicant and the NCDCM vv�ll be furrushed wntten not�ficataon of the Corps
determination Nohfication to the applicant will mclude a bnef descnpLon of the admimstrative

b For those proposals that may result in a discharge into waters of the Umted
States mctuding wetlands the North Cazolma Division of Water Quality(NCDWQ)and the

typically funush this coordinated federal position to the NCDCM w�thin 45 days of rts receipt of
the complete application and copies of the Field Investigahon Report and Bio Report
h If the Corps does not concur with a Federal Agency s comments or
recommendations the Corps will contact the Federal Agency and advise it of the Corps posrtion

Attempts to resolve the issue may include initiating the referral procedures outlined by current
memoranda of agreement(MOA s)between the Department of the Army and the agency No
coorduiated federal posrtion will be fwzushed to the NCDCM until and unless the Corps receives
wntten agreement from the Federal Agency that all issues have been resolved to the satisfaction
of that agency
i If any of the recommendations and/or condihons included in the coorduiated
federal position aze unacceptable to the NCDCM the NCDCM v�nll contact the Corps vv�thin ten
(10)days of receipt of the coordinated federal posihon and attempt to resolve the conflict If
resolution of the conflict involves chatiges to the condrtions or recommendat�ons provided by the
Federal Agencies the provisions of pazagraphs g and h (above)vrnll apply If the conflict is
resolved to the satisfact�on of the Corps and any affected Federal Agency,the NCDCM permrt
will be issued and the authonty of tlus general permrt v�nll apply
� If a Federal Agency conflict is not resolved wit�uun the tune necessary for a
decision by the NCDCM,the NCDCM may proceed,independently to conclude the state action
vv�thout mclusion of the federal posrtion In such case the applicant and the NCDCM will be
nohfied immediately in wnhng that the state pernut does not sahsfy the federal perm�t
requirements and that the proposal in queshon may not proceed wrthout federal authonzat�on
k If the coordinated federal pos�tion 7s not in conflict wrth state agencies
posit�ons law regulat�on,or policy and is acceptable to the NCDCM,a state permit vv�ll be
developed by the NCDCM fully mcorporatang the state and federal positions The NCDCM will
funush copies of the fmal pemut to the applicant and the Corps The NCDWQ vv�ll funush a
copy of the Section 401 Water Quality Cerhficat�on if reqwred,to the apphcant and the Corps
The Corps vv�ll not confirm the authonzahon of a proposed pro�ect under tlus General Pernut
until the issuance of the NCDCM pernut and if required the Secbon 401 Water Qualrty
Certificahon
1 If the NCDCM pernut or Sect�on 401 Water Quality Cerhficahon is demed the
apphcant will be informed that federal authonzat�on is demed vv�thout pre�udice
m No work may proceed under tlus general permrt unt�l the Distnct Engineer or

or fill matenal vv�thm waters or wetlands outside the permitted area. This prolubrtion applies to
all borrow and fill activihes connected with t}us pro�ect
b Authonzation under tlus general permrt does not obviate the need to obtaui
other federal state or local authonzations
c All work authonzed by this general pernut must comply rvrth the terms and
conditions of the appl�cable Clean Water Act Sec�ion 401 Water Qualrty Certification for th�s
general permrt issued by the North Carolina Division of Water Qualrty

A Narrative
i The approved mitigation plan for the Pine Knoll Shores Aquarium pro�ect
consisted of 0 06 acres of wetland creation and 10 12 acres of wetland
preservation by means of a conservation easement The permitted
impacts totaled 0 23 acres
On May 27 2011 the Department of the Army issued a letter to Mr Allen
Monroe Director of the Pine Knoll Shores Aquarium stating that the
Aquarium is non compliant with the permit conditions#1 #11 and #12
stated in Permit No 06 04 (See Appendix A) The letter proposes two
resolution options A draft Conservation Easement the name of the
proposed Conservation Easement holder and draft preservation survey
as required by the existing permit or make A formal request to modify
the permit conditions as they relate to on site preservation
The North Carolina Aquarium has authorized CLH Design pa to act as
their agent in processing this permit application (See Appendix B )
In an effort to resoive this matter in a timely efficient and complete manor
this submittal formally requests an alternative mitigation plan of offsetting
the wetland impacts associated with the Action ID No 2004 00026 and
State Permit No 06 04 The Aquarium proposes compensatory
mitigation in the form of an in lieu fee payment to the North Carolina
Ecosystem Enhancement Program (NCEEP) at a 1 1 ratio as their sole
mifigation
The 0 06 acres of created wetlands would not be inciuded in the
proposed mitigation plan Establishing a Conservation Easement on the
remaining 10 12 acres of wetlands on site would require the re
delineation surveying and certification of the existing wetlands and would
restrict any future expansion of the Aquarium Making a compensatory
mitigation payment to NCEEP will allow the Aquarium to satisfy the
mitigation requirements of the expansion pro�ect Action ID No 2004
00026 It will also allow any future pro�ects to re delineate survey and
certify the existing wetlands and then pursue approval of any wetland
impacts through the applicable permitting agencies and processes at that
time
There was a minor deviation from the approved mitigation plan dated
7 22 2004 The service drive indicated as#3 on the mitigation plan noted
no fill requested due to the modifying the alignment to avoid the existing
wetlands The service drive was constructed straight rather than diverting
around the existing wetlands The straight service drive alignment

included in the above impact tabie and modifies the total nparian (non-
coastal)wetland impact area to 11 005 square feet(0 25 ac)
The compensatory mitigation rates to NCEEP are m 0 25 acre
increments This application formally requests to�nclude the additional
900 square feet (0 02 ac)of wetland impact to the permitted 10105
square feet(0 23 ac) impacts The m lieu fee payment wdl be made to
NCEEP m the amount of 0 25 acre based on the current Fee Schedule for
Ripar�an Wetland — Higher Fee catalogmg unit
CLH Design submitted an In lieu Fee Request Form to NCEEP They
