acres of wetland creation and 10 12 acres of wetland preservation by means of a conservation easement The permitted impacts totaled 0 23 acres On May 27 2011 the Department of the Army issued a letter to Mr Allen Monroe Director of the Pine Knoll Shores Aquarium stating that the Aquarium is non compliant with the permit conditions#1 #11 and #12 stated in Permit No 06 04 (See Appendix A) The letter proposes two resolution options A draft Conservation Easement the name of the proposed Conservation Easement holder and draft preservation survey as required by the existing permit or make A formal request to modify the permit conditions as they relate to on site preservation The North Carolina Aquarium has authorized CLH Design pa to act as their agent in processing this permit application (See Appendix B ) In an effort to resoive this matter in a timely efficient and complete manor this submittal formally requests an alternative mitigation plan of offsetting the wetland impacts associated with the Action ID No 2004 00026 and State Permit No 06 04 The Aquarium proposes compensatory mitigation in the form of an in lieu fee payment to the North Carolina Ecosystem Enhancement Program (NCEEP) at a 1 1 ratio as their sole mifigation The 0 06 acres of created wetlands would not be inciuded in the proposed mitigation plan Establishing a Conservation Easement on the remaining 10 12 acres of wetlands on site would require the re delineation surveying and certification of the existing wetlands and would restrict any future expansion of the Aquarium Making a compensatory mitigation payment to NCEEP will allow the Aquarium to satisfy the mitigation requirements of the expansion pro�ect Action ID No 2004 00026 It will also allow any future pro�ects to re delineate survey and certify the existing wetlands and then pursue approval of any wetland impacts through the applicable permitting agencies and processes at that time There was a minor deviation from the approved
