Office of Conservation Plannmg & Commumty Affairs Natural Hentage Program dated September 21 2011 Mr LeGrand expresses concem over a 123 48 U S Department of Agnculture Wetland Reserve Program easement The proposed Desert Wmd Pro�ect (heareafter the Pro�ect ) will not impact this easement No Pro�ect faciliries or mfrastructure have been sited within this area The landowner of this parcel is not participatmg m the Pro�ect In the comment letter from Ramona M Bartos Department of Cultural Resources State Histonc Preservation Office Ms Bartos states that the proposed pro�ect is consistent with the State s Coastal Management Program Addit�onal surveys were performed m early October 2011 with the findmgs provided m a supplemental report subrmtted on November 4 2011 The findmgs of the supplemental report were cons�stent with previous mvestigations which concluded that no impacts to archeological resources would result from the Pro�ect Atlanhc Wmd LLC( Atlanhc Wind ) is contmumg to coordmate with the State Histonc Preservation Office wrth regards to archrtectural resources wrthm the vicimty of the Pro�ect However the findmgs of the Architectural Resources Survey Report concluded that no properties withm the study area are listed m or have been determined el�gible formally for listmg m The National Register of Histonc Places 2 V�a correspondence dated September 28 2011 the U S Navy stated that it has no ob�ect�on to the proposed pro�ect �n relahon to �ts ongomg operahon of the Relocatable Over the Honzon Radar (ROTHR)Rece�ve S�te m Chesapeake V�rgmia Comment noted 3 Via memorandum dated September 28 2011 the North Carolma Drv�sion of Mar�ne Fisher�es ezpressed concerns about�mpacts assoc�ated with pro�ect mamtenance and steps taken to avo�d and mimm�ze impacts to�ur�sdict�onal areas In the comment letter from Mr Kevm Hart Division of Manne Fisheries dated September 28 2011 the NCDMF expresses concerns regardmg potential mamtenance issues and asks if there would be a need to re construct roads should mamtenance or other work be necessary dunng operahons and ultimately recrearing impacts If dunng operations there were a need to perform mamtenance on any faciliries roads would not need to be re constructed to the dimensions that were needed dunng construction and there would not be any resulring impacts Dunng construction wider access roads are necessary m order to allow for large cranes and turbme components to be transported to each turbme locarion w�thout the need or burden of brealang down and reassemblmg the cranes for each mdividual turbme Repeated breakdowns and assembly of cranes �s costly and time consummg to the point of malang the pro�ect mfeasible from a cost and schedule perspective Wide access roads are necessary dunng construcrion to allow for safe two way passage of construction vehicles and to allow for mulriple uses of vehicles and equipment mcludmg any emergency access vehicles at any given time Dunng operat�ons should it be necessary to perform mamtenance on a turbme or other facility the permanent access roads would be sufficient to allow transport of crane components on regulation sized trucks and other vehicles through the site and ultimately assembled where necessary The comment letter also asks about the possibility of locatmg turbmes m areas ad�acent to wetlands to avoid or further mmimize impacts to such areas A detailed discuss�on of this is provided below as part of the response to the followmg comment 4 V�a memorandum dated September 30 2011 the North Carohna Wddlife Resources Comm�ssion eapressed concerns regardmg potential adverse impacts caused by the proposed pro�ect The Wildlife Resources Comm�ssion ( WRC ) provided comments through a letter from Mana Dunn dated September 30 2011 This letter discussed vanous concems of the WRC includmg proposed impacts to wetlands and wildlife habitat and impacts to resident and nugratory birds and bats The WRC letter expresses concerns regardmg habitat provided by wooded areas (wetlands and non wetlands)m the northern portion of the Pro�ect area and other areas The wooded wetlands identified m the letter are sigmficantly disturbed through timber practices that have been implemented for decades and under the current ownership will contmue to be cleared regularly m accordance with the t�mber management pract�ces that are carned out Certam wooded areas withm the Pro�ect have been cleared as recently as withm the past year and no longer provide des�rable wooded habitat for bat species Furthermore the Pro�ect s impacts to wooded wetlands have been avoided/rrummized through the removal of s�x turbmes and supportmg mfrastructure mihally proposed m wooded wetland areas m the northern portion of the pro�ect This avoidance/minimization effort totaled a reduction �n over 2 5 acres of permanent wetland impacts m th�s northern portion of the Pro�ect and over 21 acres of temporary impacts m this area The use of ad�acent agncultural areas beyond the Pro�ect boundary was hmdered by the fact that such landowners were not willing to lease or part�c�pate m the Pro�ect A detailed discuss�on of the process by which Atlantic Wmd came to lease the properties provided below Atlantic Wmd is pursuing appropnate mitigahon for the Pro�ect as d�scussed further below However placmg all remaming onsite wetlands m a conservation easement statmg that they cannot be permanently impacted for wnnd energy development �s not withm the contractual authonry of the lease agreements that Atlantic Wmd has entered into v�nth all part�cipatmg landowners In response to the stated concerns of the WRC regardmg birds and bats Atlantic Wmd has performed extensive stud�es specific to avian and bat use of the site mcludmg comprehensive radar studies m the spnng and fall as well as acoustic bat momtonng surveys Results of the radar studies that were performed m the proposed Pro�ect area m the spnng and fall of 2011 mdicated that the Pro�ect is not located w�thm a ma�or avian flyway and that use of the Pro�ect area by migratory birds is consistent�rnth or less than other wmd pro�ects proposed or constructed m the eastern United States Spec�fic to waterfowl geese and swan a l�terahue rev�ew of wmd facility waterfowl mteraction studies was conducted after consultat�on with the WRC and U S Fish and W�ldlife Service ( USFWS ) Published studies on wmd facil�ty waterfowl mteractions mdicated that there has been rrummal waterfowl mortal�ty at wmd facilities m the U S and Europe Based upon these findmgs �t was concluded that the direct impacts from a wmd facility would not have a population level affect on waterfowl Furthermore the research showed that mdirect�mpacts to waterfowl(i e avoidance or d�splacement)also appeared to be mmimal for wmd facil�ries Based upon the literature review combmed wrth studies performed the Pro�ect is expected to have mmimal direct or mdirect impact on ducks geese and swans The WRC expressed concerns specific to the cumulative effects on avian resources of the Pro�ect and other potential wmg energy facilrties m Beaufort Camden Curntuck Pamhco Washmgton Tyrell and Hyde Count�es Atlantic Wmd has committed to perfornung post construction momtonng m accordance with Iberdrola Renewables Avian and Bat Protection Policy which mcludes in depth program of momtonng and long term searches to help detect trends m avian use of the Pro�ect area However Atlantic Wmd cannot comment on the potential impacts that wind faciliries proposed by other developers m other locations may have on avian resources m northeastern North Carohna 5 V�a correspondence rece�ved on October 13 2011 Mr John Droz Jr ra�sed several �ssues concernmg pubhc health impacts to w�ldLfe and local chmate and financ�al respons�b�hty for the Lfe of the pro�ect Although we recerved Mr Droz s letter after the close of the publ�c not�ce comment period I have also enclosed a copy h�s letter for your mformation General mtroductory comment Mr Droz is a well known vocal opponent of wmd energy His commentary on the Pro�ect is cons�stent with comments he has raised on other wmd energy proJects The responses below are mdexed accordmg to Mr Droz s comments Page 1 —Mmimizat�on of environmental and health impacts are achieved through proper site selection and setbacks The Pro�ect is sited in an area where impacts to the environment and humans are irutigated by the fact that the area is mtensively farmed and few people live near the Pro�ect facilities Page 6+ The environmental benefits of clean energy exceeds the potenhal impact of the disruption of local air flow Page I 1 — Avian and bat surveys were conducted with mput from the US Fish and Wildl�fe Service and WRC among others Page 14—On s�te surveys md�cate that the Pro�ect has a low potenhal to impact bats Page 19 — After conduchng several hours of public heanngs both Pasquotank and Perquimans Counties approved zonmg pernuts for the Pro�ect It should be noted that there was no opposition to the Pro�ect Page 26—Confidentiality clauses are not uncommon m commercial agreements Page 32 The Corps �s concerned w�th the long term dispos�hon of th�s pro�ect You state that Atlant�c Wmd LLC was orgamzed to develop pro�ects m the eastern Umted States and is owned by Iberdrola Renewables We have been mformed that once the permit is �ssued construct�on and operahon of the facdity wdl be transferred to Desert Wmd LLC an ent�ty that does not ex�st at this pomt in hme Please be adv�sed that before a permit can be�ssued �t must clear how these compames will be structured and who the responsible party will be m the long term Accordmgly 1 wdl be contactmg you to schedule a meehng to explore this matter further Atlant�c Wmd is willmg to participate m any meerings or discussions pertammg to the corporate structure of Atlantic Wmd and Iberdrola Renewables Inc m an effort to clarify any questions or concerns that may exist regardmg the responsible part�es for the Pro�ect b Your stated pro�ect purpose on page 47 of the supporhng documentahon differs from your statements in the appl�cation and on page � of the Egecutrve Summary This must be reconciled Although the Corps �s respons�ble for deflnmg the pro�ect purpose we do so w�th the appl�cant's needs m mmd Therefore �t �s very �mportant that you are clear m expressmg your purpose for buddmg th�s pro�ect If the pro�ect purpose is to generate Renewable Energy Cred�ts (RECs) for Virgmia Electr�c and Power Company(VEPCO) then the alternahves analys�s must be expanded to address other sources of renewable energy and other s�tes that m�ght support those facd�ties Less env�ronmentally damagmg renewable energy sources may ex�st that could meet the pro�ect purpose of prov�dmg RECs for use by VEPCO The Pwpose of the Pro�ect as stated m the Executive Summary is to construct a wmd energy generation facility m North Carohna The discussion on page 47 in the sechon pertaming to Indirect and Cumulative Impacts was not mtended to contradict the stated Purpose from the Executive Summary but provide a discussion on the lack of mdirect or cumulative impacts resultmg from the construction of the proposed Pro�ect After complehon of the Pro�ect wmd generated power would help sahsfy the requirements of the North Carolma Renewable Energy Portfolio Standard (`NCREPS ) which mandates certam utilities to provide an mcreasmg amount of renewable energy The power produced by the Pro�ect will be transmitted through Virginia Electnc and Power Company s ( VEPCO ) ex�stmg 230kV Wmfall to Suffolk transmission lme which will not require any upgrades to transmit the electncity generated by the Pro�ect This m no way creates any sort of requirement that the energy produced by the Pro�ect be purchased or used by VEPCO VEPCO is simply the owner of the transnussion lme c T6e alternahves analys�s sect�on of your appl�cat�on�s not adequate for the Corps to make a final dec�s�on Please describe the s�te selechon cr�ter�a you uhl�zed to evaluate sites and spec�fic reasons why other alternatrve s�tes were removed from considerahon Nowhere m the document do you descr�be why the facd�ty must generate 300MW of electr�c�ty Your company has developed several other w�nd generahon facilities that are smaller than th�s proposed pro�ect You must explam why the number of turbmes assoc�ated w�th this pro�ect cannot be reduced to avo�d �mpacts to DA�ur�sd�chon In 2009 a comprehensive search for potent�al wind energy srtes m North Carohna was imtiated and identified sites withm Camden Cumtuck Pasquotank Perquimans and Tyrrell counries that based upon prelimmary evaluation had the potential of fulfillmg the three essential requirements for a wmd energy development h�gh qual�ty wmd resource location and capacity of transmiss�on lmes and available pnvately owned unconstramed land Atlantic Wmd had a Geographic Informarion System(GIS) database evaluation and prel�mmary envuonmental review conducted of the potenrial sites which qual�tatively ranked each of the sites based on vanous constramts and parameters One site was elimmated early m the process due to a vanety of factors mcludmg environmental constramts such as high potential for floodplam issues and the presence of state federal and local lands with documented unique vegetahon and wildlife habitats w�thm and ad�acent to the site Two s�tes the Desert Wmd site and another site located m Camden and Cumtuck County were advanced to further stages of development Of those two sites the Desert Wmd srte advanced much more quickly m terms of land acqu�sition/leasmg which allowed for the requisite nghts to conduct studies apply for pernuts and otherwise develop the pro�ect The Desert Wmd ProJect was presented to landowners m the Desert area of Pasquotank and Perqu�mans Count�es at a number of ineetmgs between November 2009 and July 2010 Land acqu�sition efforts m general focused on owners of contiguous agncultural open land between Hwy 17 Turnpike Road Swamp Rd 4 Mile Desert Road and Millpond Rd (collect�vely the Initial Target Area or ITA ) Imtial land acquis�tion efforts specifically focused on the southem portion of the ITA nearest the existmg transm�ss�on hne mfrastructure Of particular initial mterest was an open area m the southeastern quadrant of the ITA near an existmg substation near Foreman Bundy Road and Hwy 17 under smgle ownership This property is locally known as Tanglewood and is part of an expansive master planned development near the mtersection of Hwy 17 and Halstead Road Extended Because of its planned development for commercial and residential uses the owner declmed to participate Therefore the land acquisition efforts were refocused further to the west and southwest It should be noted that Tanglewood s owner later filed for bankruptcy and the property was sold at auct�on The subsequent owner also declmed parricipation m the proJect Imtial leasing successes occuned m the southwestern portion of the ITA and spread north and northeast For the most part the leased land is largely open fields However near the center of the ITA lies a large 3 000 acre tract used pnmanly for t�mber produchon Due to its location and the landowner s desire to develop wmd energy as a compatible use the property was mcluded m the pro�ect Additionally the same landowner requested the mclus�on of an addit�onal 1 500 acres of timberland lying at the northwestern edge of the ITA As leasmg efforts progressed from the fall of 2009 through the sprmg of 2011 landowners m the east and northeastern portions of the ITA north of Tanglewood were approached and offered leases With the exception of 3 landowners along Old Dommion Road all of these landowners declmed participation The ma�onty of those landowners declmed due to their belief that their properties potenhal for resident�al or commercial development precluded rts mclus�on m the wind pro�ect By the spnng of 2011 land acquis�tion efforts had secured nghts to approx�mately 22 000 acres and it was clear that all reasonable efforts to secure contiguous land were exhausted An analysis was conducted to evaluate the locat�on of 156 turbme sites on the 22 000 acres from the standpoint of environmental impact conshuctab�lity and wmd energy production This analysis ultimately led to the removal of 6 turbmes from the wooded area m the northwest At the conclusion of the process 150 wmd turbme srtes were selected for final pernuttmg Imtial analysis of the Irutial Target Area md�cated that the land could potentially support 450 SOOMW of wmd energy Atlanric Wmd s further analysis of potenhal constramts leasmg permittmg as well as certam econorruc and operational factors led Atlantic Wmd to apply to PJM Interconnecrion LLC (the regional transmission operator)for a pro�ect s�ze of 300MW on February 25 2010 Further�ust�fication for the size of the pro�ect arose from analysis of the NCREPS which requires certain utilities to provide an increasmg amount of renewable energy Atlantic Wmd deternuned that demand for renewable energy necessary for compliance with the NCREPS would be sarisfied m part by the potential pro�ect In 2011 both Duke Energy Carolmas and Progress Energy Carolmas announced RFPs for wmd energy pro�ects up to 300MW which further supported Atlantic Wmd s determmarion of pro�ect size d You propose to prov�de compensatory truhgat�on for th�s pro�ect by purchasmg credits from the Great Dismal Swamp Restoration Bank (GDSRB) T�mberlake Farm property Spec�fically you propose to offset�mpacts to managed pme wetlands by purchasmg credits from th�s bank at a raho of 0 5 1 and for impacts to "hardwood flat wetlands at a ratio of 1 1 Please be advised that the GDSRB m�hgat�on banlung mstrument(MBI)establ�shed that dependmg on the quality of the �mpacted resource cred�ts wdl be deb�ted from this bank at a �rummum raho of 1 25 1 Add�t�onally your proJect ts located outs�de of the des�gnated geograph�c serv�ce area for the Timberlake Farm property Although the GDSRB m�hgahon banlang mstrument (MBI) allows for cons�derat�on of deb�t�ng outs�de of the geograph�c serv�ce area on a case by case bas�s a tinal dec�s�on regardmg the appropr�ateness of the Timberlake Farm property located m Tyrrell County south of the Albemarle Sound to offset impacts to wetlands assoc�ated w�th your pro�ect located m Pasquotank and Perqu�mans Counhes north of the Albemarle Sound �s yet to be made by the Corps Based on the above your compensatory m�hgat�on plan must be rev�sed before a fnal perm�t decis�on can be made As descnbed m the application Atlantic Wmd proposed to irutigate for permanent impacts to wetlands associated with the Pro�ect by purchasmg non npanan wetland rrurigation credits from the Great Dismal Swamp Restoration Bank — Timberlake Farm Site located w�thm the Pasquotank River Basm (HUC 03010205) Smce the quality and function of the managed pme wetlands is low as determmed through the application of the North Carolma Wetland Assessment Method (MCWAM) and because the impacted areas have been disturbed through decades of active timber management activity and these areas would contmue to be disturbed m accordance with the current timber management plans implemented by the landowners a m�t�gahon ratio of 0 5 1 was proposed for certam impacted areas Since the quality and function of the hardwood wetlands observed withm the pro�ect area is medium/high(as deternuned
