These letters include a plat showing the revised wetland areas on the properties. We have subsequently sent each property owner an authorization form which would allow Land Resource Companies to act on their behalf to have their lots rerecorded showing the current delineation. Please note that lot 95R has executed and' returned the authorization. Please be aware that lot 96 was sold with lot 95 with the clear understanding that .lot 96 was not buildable. It is our desire to mitigate all the wetlands on the remaining properties by either buying into a wetland bank or creating an approved wetland mitigation site within RiverSea Plantation. Please be aware that all the wetland areas in question total less than one acre. As you know, we have retained Land Management Group to assist us on these issues and they are currently investigating the mitigation possibilities. Having gotten this far with the redelineation process we see no reason for our LAMA permit process to be delayed any longer. Division of Water Quality has required RiverSea Plantation to update the jurisdictional wetland delineation for the entire property. This includes the previously sold lots. During this process, wetlands were identified on your lot and delineated (see attached map). The area of wetlands on your lot has increased. For lots with an increase in wetland area, DWQ has required us to notify the current property owners and inform you that you must contact the U.S. Army Corps of Engineers (USAGE) and the N.C. Division of Water Quality prior to impacting any wetlands on your property. These agencies regulate the discharge of fill material into navigable waters of the United States including wetlands. A 404 Permit from the U.S. Army Corps of Engineers and a 401 Water Quality Certification from the N.C. Division of Water Quality is required prior to discharging fill material into jurisdictional wetlands. With your permission, RiverSea Plantation will request an official jurisdictional determination from the USAGE for the attached wetland delineation of your lot, which means the wetland delineation will be considered valid for five years from the date of signature. The DWQ requires a jurisdictional determination prior to issuing a 401 Water Quality Certification. If you wish for RiverSea Plantation to pursue securing a jurisdictional determination for your lot, please sign the attached authorization letter and return it to us at the noted address. RiverSea Plantation will provide you a signed map once it is received.
