Thanks Dave 1 N North Carolina Wildlife Resources Commission 0 Gordon Myers, Executive Director November 3, 2011 Mr. Monte Matthews U.S. Army Corps of Engineers, Regulatory Branch 3331 Heritage Trade Drive, Suite 105 Wake Forest, NC 27587 SUBJECT: WRC Comments on Nichols and Curry Application Wilkes County, DWQ 20110934 Dear Mr. Matthews: Mr. Jerry Nichols and Pamela Call Curry requested a permit for two culverts in tributaries to Fishing Creek in Wilkes County. Comments from the North Carolina Wildlife Resources Commission (WRC) on this regulatory action are offered for your consideration under provisions of the Clean Water Act of 1977 (33 U.S.C. 466 et. seq.) and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d). This project should not harm trout and construction does not need to be avoided during the spawning moratorium. We have no concerns with this project provided the culverts are properly bedded (Final Regional Condition 3.6) and any bare soils along the streams are quickly stabilized to reduce erosion.
