REQUEST FOR MORE INFORMATION
Dear Mr. Marotta:
On October 4, 2011, the Division of Water Quality (DWQ) received your major variance application
dated September 29, 2011 to impact 92,260 square feet (ft) of Zone 1 protected riparian buffers and
61,507 square feet (ft) of Zone 2 protected riparian buffers to expand the landfill at the subject property.
The DWQ has determined that your application was incomplete and/or provided inaccurate information
as discussed below. The DWQ will require additional information in order to process your application to
impact protected buffers on the subject property. Therefore, unless we receive three copies of the
additional information requested below, we will place this project on hold as incomplete until we receive
this additional information. If we do not receive the requested information, your project will be formally
returned as incomplete. Please provide the following information so that we may continue to review your
project.
Additional Information Requested:
1. Please address any possible secondary impacts to the remaining surface waters at the subject
property as a result of the landfill expansion.
2. Buffer mitigation is required for the proposed impacts. Please submit a mitigation plan
detailing how the impacts to the buffers (Zone 1 and Zone 2) will be mitigated.
3. Please provide temporary stormwater management measures at every proposed discharge point
that are adequate to detain the 1.5 inch storm for a period of 5 to seven days and to detain the 25-
year, 24-hour storm without overtopping the emergency spillway. Please be certain that each of
the proposed temporary BMPs can be easily accessed for construction and maintenance.

4. Each of the three proposed discharge points must be equipped with a stormwater BMP that
removes a minimum of 85% TSS, 30% Total Nitrogen and 30% Total Phosphorus after the
landfill is closed. Please provide a BMP Supplement Form for each proposed best management
practice (including both worksheets, Design Summary and Required Items Checklist), as well as
all of the required items. The BMP Supplement Forms are available on the DWQ web site at:
http://portal.ncdenr.org/web/wg/ws/su/bmp-manual. Please be certain that each of the proposed
permanent BMPs can be easily accessed for construction and maintenance.
5. One (1) data CD of full size plans in TIFF Group 4 format (black and white, not grayscale or
color). If the plans are too large to store in TIFF format, they can be stored in PDF format.
Please respond in writing within 30 calendar days of the date of this letter by sending a copy of this
information to me. If you will not be able to provide the requested information within that timeframe,
please provide written confirmation that you intend to provide the requested information, and include a
specific timetable delineating when the requested materials will be provided. If we do not hear from you
in 30 calendar days, we will assume that you no longer want to pursue this project and we will consider
the project as returned.
This letter only addresses the application review and does not authorize any impacts to wetlands, waters or
protected buffers. Please be aware that any impacts requested within your application are not authorized (at
