formal written modification request.
The descriprion of the proposed acrion provides adequate assurance that the proposed acrion in the L�w.�cr.
River Basin in conjunction with the proposed development will not resuit in a violarion of applicable Water Quality
Standards and discharge guidelines. Therefore,the State of North Cazolina certifies that Uus acrivity will not
violate the applicable portions of Secrions 301, 302,303, 306, 307 of PL 92-500 and PL 95-217 if conducted in
accordance with the applicarion and conditions hereinafter set forth. Should your project change,you aze required
to notify the DWQ and submit a new applicarion. If the property is sold,the new owner must be given a copy of
trus Certification and approval letter, and is thereby responsible for complying with all the conditions. For this
approval to remain valid,you aze required to comply with all the condirions listed below. In addirion,you should
obtain all other federal, state or local permits before proceeding with your project including(but not limited to)
Sediment and Erosion conh-ol,Coastal Stormwater,Non-dischazge and Water Supply watershed regularions. This
Modification Approvai shall expire on the same day as the expiration date of the coaesponding Corps of Engineers
Permit.
Condirion(s)of Modificarion Approval:
1. As-built drawings of the proposed acrion shall be submitted to the NC DWQ Transportarion Permitting
Unit within 30-days of the completion of the acrion.
2. All the authorized acriviries and conditions of the certificarion associated with the original Water Quality
Certification dated C"-� 19,zoLoand all other corresponding modifcations srill apply except where
superceded bythiscertiFicarion.

Failure to construct the proposed acrion as described in the Modificarion Descriprion and Sketch on Page 1 of this
document and/or violarions of any condirion herein set forth may result in revocarion of this modificarion approval
and may result in crimina] and/or civil penalries. This modificarion approval shall become null and void unless the
above condifions aze made conditions of the Federa1404 ancUor Coastal Area Management Act Permit. If the
Corps of Engineers requires a formal written modificarion to the 404 permit for the proposed acrion,then NC DWQ
must require a formal written modification to the 401 WQC, and therefore,this in-field modificarion is invalid. If
additional(wetland,stream,baffer)impacts for this project(now or in the future)exceed(one acre, 150 Gnear
feet,or one-third of an acre/150 linear feet,respectively), or if mirigation is required above and beyond the
current mirigarion requirements for this project,Uris in-field modification is invalid and a.formal written
modificarion is required. -
This in-field modificarion is effecrive upon the date the last party signs this document. This in-field modificarion is
made upon mutual agreement beriveen DOT and DWQ as indicated by the signatures below and is,therefore,not
subject to appeal by either party. Appeals by third parties must be made within sixry(60)days of norificarion
pursuant to the contested case provisions of the Adminish-arive Procedute Act,N.C. Gen. Stat. § 150B-23 et sea• -

20091359v.3) . This modification authorizes temporary wetland impacts (<0.01 ac) for
the removal stump and root material conflicting with installation of piles for the
temporary detour between Sta. 25+55 and 27+00. This work is authorized under WQC
3821 (attached) which corresponds to the Nationwide 18 issued by the USACE £or this
temporary impact. If you have� any questions, please do hesitate to contact me. I
will provide you with your hard copy when I see you on Wednesday.
