This activity is considered exempt from the Tar-Pamlico Buffer Rules [I 5A NCAC 0213.0259] due to the documentation of a prior mobile home was damaged during a Hurricane Irene in August 2011 and was demolished and was located outside of the Tar-Pamlico River Riparian Buffer. Due to the documented existing use outside of the Tar-Pamlico River Riparian Buffer, replacement of the mobile home does not require a written authorization from the Division of Water Quality (DWQ). This authorization is only valid for the purpose and design that you described in your application received by the Washington Regional Office on October 3, 2011. If changes to your project require encroachment into the Tar-Pamlico River Riparian Buffer, you must notify us and you may be required to send us an application. Requests for appeals of this decision shall be made to the Office of Administrative Hearings. If you do not accept any of the conditions of this approval, you may ask for and adjudicatory hearing. You must act within 60 days of the date that you receive this letter.
