Sullins Director Dee Freeman Secretary October 26, 2011 DWQ Project # 11-0877 Wilson County CERTIFIED MAIL: 7010 1870 0001 3428 0808 RETURN RECEIPT REQUESTED Piedmont Natural Gas 4720 Piedmont Row Drive Charlotte, NC 28210 Subject Property: PNG Wilson Line 40A Hominy Creek [030407,27-86-8, C; Sw; NSW] REQUEST FOR MORE INFORMATION Dear Sir or Madam: On September 26, 2011, the Division of Water Quality (DWQ) received your application dated September 12, 2011 to fill or otherwise impact 1.93 acre of wetland (temporary impacts), 0.69 acre of wetland (conversion impacts), 204 linear feet of stream channel (temporary impacts), 10,132 square feet of Zone 1 Neuse River basin protected riparian buffer (permanent impacts), 7,819 square feet of Zone 1 Neuse River basin protected buffer (temporary impacts), 9,026 square feet of Zone 2 Neuse River basin protected riparian buffer (permanent impacts), and 7,361 square feet of Zone 2 Neuse basin protected riparian buffer (temporary impacts) to replace an existing gas line along an existing easement and in a new location. The DWQ has determined that your application was incomplete and/or provided inaccurate information as discussed below. The DWQ will require additional information in order to process your application to impact protected streams and buffers on the subject property. This project is on hold and incomplete until we receive the additional information requested below. If we do not receive the requested information, your project will be formally returned as incomplete. Please provide the following information so that we may continue to review your project. Additional Information Requested: Please provide a signed copy of the PCN application. 2. DWQ will not require wetland mitigation for this project since it is conversion of wetlands and the total permanent wetland impact is less than 1 acre. Please revise cover letter (specifically page 2) to indicate that this is not a requirement of DWQ and/or GC 3819 as noted in your cover letter. Note: The USACE may require wetland mitigation for this project. 3. Please revise and resubmit correct information. 4. Riparian Impact Table a. The buffer impact associated with S2 indicates that buffer mitigation is not required at this location. However, the mitigation requirement column indicates that you will be purchasing credits for this buffer impact. Please explain discrepancy and revise and resubmit correct information. FYI - Most of the buffer impact appears to be perpendicular with S2 except for a small portion of parallel impact that falls within Zone 1. DWQ requires that you only provide mitigation for this small portion of parallel Zone 1 impact because the line is not within the existing maintained gas corridor at this location. The buffer impact associated with S6 indicates that buffer mitigation is required at this location. However, the buffer mitigation requirement column indicates that you will not be purchasing credits for this buffer impact. Please explain discrepancy and revise and resubmit correct information. FYI - This buffer impacts appears to be perpendicular to S6. Therefore, DWQ will not require buffer mitigation at this location. Please submit five copies of this information within 30 calendar days of the date of this letter. Please send additional information to DWQ Central Office, Attn: Karen Higgins, 1650 Mail Service Center, Raleigh, NC 27699-1650. If we do not receive this requested information within 30 calendar days of the date of this letter, your project will be withdrawn and you will need to reapply with a new application and a new fee. If you need additional time to compile the information requested above, please email Lauren Witherspoon (lauren.witherspoon@ncdenr.gov) requesting an extension and indicate a new date for submittal. This letter only addresses the application review and does not authorize any impacts to wetlands, waters or protected buffers. Please be aware that any impacts requested within your application are not authorized (at this time) by the DWQ.
