I have spoken with Amy Chapman (DWQ Buffer Coordinator, Central Office) and Lauren Witherspoon (DWQ Environmental Specialist, Raleigh Regional Office) about this project. Here are my findings: If you have not increased the stormwater flow beyond an existing ephemeral channel's capacity for non-erosive flow , then you may discharge to that channel without providing a diffuse flow device. Therefore, your discharge on the west side of the project below the fill slope will be allowable as is without any additional engineering devices. - Since your maintenance corridor is 20 feet total, the sewer line will need to be approved by DWQ an allowable use within the riparian buffer. I just spoke with Lauren and she will write your approval this afternoon. We have decided not to require you to provide the Filterra devices in the storm inlets on the northeast side of the project as we discussed on the phone. Thanks, Annette Annette M. While we have not formalized the policy, I have been pushing the Town to reduce their maintenance corridor to 10 feet where they cross the stream buffer, as part of their overall stormwater program. They have been willing to do this in other areas. With an aerial crossing that's really all they need. Did you talk to Kenny or Will about this? If they have questions they can contact me. The easement is a linear 20' wide swath through the buffer from one side to the other and there will be no stream disturbance. You had indicated that we were exempt and could proceed, but I just wanted to make sure I understand the rules correctly, a Non-Electric Utility Line that crosses the stream perpendicular and disturbs equal or less than 40 linear feet of riparian buffer with a "Maintenance Corridor" less than 10' in width is "Exempt", but if the "Maintenance Corridor" is greater than 10' in width it is "Allowable". I am assuming the "Maintenance Corridor" is the area that will remain permanently cleared? If this is the case, the Town of Hillsborough wants this to be 20'. As I pointed out in our meeting, the contractor would like to begin this sewer outfall since it is +/- 20 deep through portions of the site and is a critical item on the schedule. Per the rule stated above, I don't want to proceed if we are not really exempt, and are indeed allowable so that leads to the question of : What can we do to expedite this "Allowable" use without delaying the Project while we are waiting on a directive as to how to handle the outfalls we discussed the other day? Should we submit an application for just the sewer such that it can be approved and permit issued? Please advise at your earliest convenience as I am trying to explain the current delays to the owner Thanks in advance, Chad E.
