Hi Amy,
The 426 sf of the new house footprint sits directly on top of the old house footprint so that the new house footprint is not
impacting Zone 2 at all. That 426sf was already impacted from the old house footprint. Hopefully this answers your
questions. I guess we should remove that from the calculations table.

Robin, I received the modification request today in the mail and it appears from the plan sheet that there are 426sgft of
Zone 2 buffer impacts for the house. Is this correct that there are 426 sq ft of new house impact in the Zone 2 buffer?

Hi Amy,
I overlaid the previously approved site plan over the new site plan and there is one area where the new proposed
retaining wall and drive is outside of the previously approved retaining wall footprint. The plan above shows the location
of the previously retaining wall per plans 3/31/11 and the new retaining wall. All other proposed site features are within
the previously approved plan w/ the exception of this area.
What does this mean as far as getting buffer authorization approval for the new site plan?

Hi Amy,
Our client's have opted to reconfigure the footprint of the cover porch so that the 32sf is no longer in the buffer. With that
change, it seems from our phone conversation yesterday that the proposed site features (retaining wall, walk, steps and a
portion of the house (which fits over the existing footprint of the old house) are allowable uses in the buffer and falls under
a buffer authorization.
The question I have is
1. Since we already have a buffer authorization approval from the drawings we submitted on 3/31/11 can the buffer
authorization be used for this new site plan or do we need to submit for a modified buffer authorization?
If you would please let me know how to proceed on getting approval for this new site plan that would be great. Thanks for
your help.

Robin,
It appears from the revised plan sheets that the Shirley's are now proposing to put part of the home in the buffer and
not just the driveway, retaining wall and walkway they were previously approved for. If this is true, the home would
require a minor variance instead of the buffer authorization they were approved for before. If this is the case, any
portion of the house in the buffer that is not currently on top of existing impervious surface would require a minor
variance. This application is more detailed than the authorization was.
Please verify whether they are putting new portions of the home (living space) in the buffer where there currently is no
impervious surface. Thanks.

Hi Amy,
The impacts in Zone 1 and 2 have been reduced w/ the new site and house footprint. The original approved plans, dated
3/31/11, shows the following amount of land disturbance in Zone 1 and 2 as:
Zone 1 33 sf
Zone 2 1,201 sf
The New site plan shows the land disturbance that is impacting the Zone 1 and 2 as:
Zone 1 32 sf
Zone 2 630 sf
If you will please let us know how to proceed in regards to revising the permit per the new plans dated 3/31/11.
If you feel I need to come in for a short meeting, I can meet anytime on Friday after 10:00.

There have been modifications to the Architect's floor plan and site plan for 2100 St. James Street. Do you have time to
meet this week to review the revisions. I am available any time Thursday afternoon and all day Friday. It seems that we
need to submit for a modification DWQ permit.

Morning Robin.
The modification would not be required unless the decreased impacts were outside of the approved footprint.
If the impacts are within the same footprint, but less area, then the modification is not necessary. It would be the
owners decision at that point.
The time frame is hard to judge, but we would have 60 days to do it. It wouldn't take nearly that long, but it does get
issued out of the Raleigh Regional Office now.

I have a "what if' scenario. If someone receives a Neuse River permit than decides to decrease the amount of impact in
the buffer areas is a permit modification required or even necessary. If a permit modification is necessary than what is the
time frame to get the modification permit approved. Can construction begin w/out modifying the permit?
