PROJECT SUMMARY: The applicant proposes the construction of a private docking facility into Hewletts Creek. Price Page 2 9. PROJECT DESCRIPTION: The project site is located at 413 Buccaneer Road within the Pirates Cove Subdivision, adjacent to Hewletts Creek. The site is located within the City of Wilmington, New Hanover County. To locate the property from Oleander Drive (NC Highwayl7), turn onto Greenville Loop Road and travel west approximately 3.0 miles. Turn left onto Pine Grove Road and travel south approximately 1.2 miles until you reach Masonboro Sound Road, which will be on your left. Turn left onto Masonboro Sound Road and the entrance to Pirates Cove Subdivision will be on the left at Buccaneer Road. Please note this area of Masonboro Sound Road is currently under re-construction. Travel approximately 0.5 miles northwest through the subdivision until you reach the property of interest. The lot is approximately 0.61 acres with 74' of shoreline frontage that is stabilized with upland vegetation and what appear to be old tires at the waterwazd end of the highground and averages 5-10 feet above normal high water (NHW). The applicant maintains asingle-family residence along with a detached garage and swimming pool area on the property. Highground vegetation consists of maintained lawn grass and ornamental landscaping. The property also consists of hardwood and other woody species including oak and pine trees. Waterward of the upland vegetation is an area approximately 400' in width towards Hewletts Creek to the north, which consists primarily of Smooth Cordgrass (Spartina altern~ora) and small azeas of Black Needlerush (Juncus roemerianus). Due to the tidal amplitude in this area of southeast N.C. of up to approximately 4 feet, this area of Hewletts Creek would be comparatively navigable during the higher cycles of the tide. The project azea is located within upper reach of Hewletts Creek that has limited access due to the apparent shoaling on this side of the creek. Based on sites visits, the water depth within this azea of the creek was approximately 0.0' @ normal low water (NLW) along the waterwazd edge of the marsh. The project location is located adjacent to the Reserve at Masonboro Subdivision which is located to the west, and currently maintains a community access pier into Hewletts Creek issued under State Permit No. 6-03. Conditions under State Permit No. 6-03 limited the structure for a community fishing/crabbingpfer and fishing facility only due to the limited water in the project azea. Further, the adjacent riparian property owner to the east at Lot 22 within Pirates Cove Subdivision currently maintains a small private pier into Hewletts Creek (See Sheet 1 of 2). The Wilmington/New Hanover County 2006 Land Use Plan classifies adjacent waters as Conservation, and the adjacent high ground portion of the project area as Resource Protection. The waters ofHewletts Creek are classified SA by the Division of Water Quality. They are designated as a primary nursery area (PNA) by the N.C. Division of Marine Fisheries and they are CLOSED to the harvest of shellfish. PROPOSED PROJECT: The applicant proposes the construction of a private docking facility into Hewletts Creek. An access pier would extend a distance of approximately 430' in length by 6' in width from the shoreline of the property towards Hewletts Creek. The application states that a secondary access pier, measuring approximately 5 8' in length by 6' in width would extend from the western end of the property line to the primary access pier to potentially provide access to the adjacent property located at Lot 20. Based on the riparian survey, Lot 20 does not appear to have riparian access to the creek. The main access pier would terminate onto a fixed platform, measuring approximately 8' in length by 18' in width, which would be located over open water, creating a "T"head configuration. An access ramp from the eastern portion of the platform would lead onto a floating dock, measuring approximately 20' in length by 6' in width. The floating dock would run perpendicular to the shoreline towazds Hewletts Creek. Based on the limited water depth within this location (+1.4' to +1.6'at mean low water (MLW)), the application states the floating dock would be designed to remain fixed at 18" above the substrate to prevent the dock from resting on the substrate. The application also proposes to install a boatlift, measuring approximately 12' in length by 10' in width that would be located on the western side of the proposed floating dock. Price Page 3 The hydrographic survey provided in the application indicates that current water depths in the location ofthe proposed docking structures would range from approximately +1.40' to +1.60', relative to MLW. The application states that the proposed structures would accommodate smaller motorized vessels and self-propelled type vessels such as kayaks (See Sheets 1 of 2 through 2 of 2). 10. ANTICIPATED IlVIPACTS: The proposed docking facility would incorporate approximately 384 sq. ft. of Public Trust Area and Estuarine Waters and would shade approximately 2,928 sq. ft. of Coastal Wetlands. The proposed structures would extend approximately 33' into a waterbody, which measures approximately 143' across. This distance would conform to the 1/4 width rule. Based on the submitted survey, the proposed structures would not encroach into the adjacent riparian property owners' corridor 15' setback requirement. It is noted that the riparian line between the applicant's property and that of the adjacent subdivision was established from the application of State Permit No. 6-03.The construction would provide docking space for a total of two (2) vessels. Due to the absence of water, +1.4' to +1.6' @ MLW located on this side of Hewletts Creek as shown in the attached hydrographic survey and through historic aerial photography review, there will be potential for bottom disturbance and displacement of the substrate "kicking" by vessel propellers to access the channel of the creek.
