This information is provided in response to your September 23, 2011 letter requesting additional information, a copy of which is provided for reference. The additional information requested is listed below, followed by a written response: Additional Information Requested. - 1. Per the requirements of the Neuse River riparian buffer rules, you must show that this site meets diffuse flow requirements with level spreader or other BMP per Chapter 8 of the BMP Manual (see http://Portal.ncdenr.org/weblwglwslsulbmp-manual). The PCN application indicated that a diffuse flowplan was included but DWQ could notlocate one. Please provide a diffuse flow plan. The original submittal included copies of the grading and storm drainage plan (2 sheets), which was submitted for the purpose of illustrating the site grading and configuration of BMP's and level spreaders for demonstration of conformance with the diffuse flow requirement. Also, please note that an additional 50' of stream buffer width is provided beyond the 5o' Neuse buffer in accordance with City of Durham stream buffer requirements. There are no proposed impacts or grading within any of these buffers, except for the one (i) perpendicular roadway crossing. BMP #7: The water quality volume from BMP #7 is split out to a 1o' level spreader. An engineered filter strip with a 4.3% slope is provided outside the buffer. Larger storm events are conveyed through a bypass pipe which discharges to a plunge pool dissipater. BMP #8: The discharge from BMP #8 occurs upstream of a roadway crossing which is located upstream of the Neuse buffer. The outflow from this BMP enters a natural wetlands area upstream of the Neuse River Buffer. A stable outlet with plunge pool dissipater is provided for this BMP. Per current NCDWQ Policy, stormwater flows which enter wetlands (outside of the NRB) at a non erosive velocity (less than 2 feet per second) have been deemed to be in compliance with the diffuse flow regulations. The attached calculations show that the expected velocity, at the edge of the NRB, for the 10 -yr storm is 1.86 ft/sec, thereby complying with current policies. BMP #1o: The water quality volume from BMP #10 is split out to a 1o' level spreader. An engineered filter strip with a 2.3% slope is provided outside the buffer. Controlled fill, as specified by the Geotechnical Engineer, in the dam embankment shall be placed in 6 -inch loose layers (3 -Inch loose layers within 3 -feet of either side of the principal spillway pipe to a depth of 2 -feet over the pipe) and shall be compacted to a density of no less than 95% of the Standard Proctor Maximum Density at a moisture content of + or - two percentage points of the optimum moisture content in accordance with ASTM D698. 2. All visible organic debris such as roots and limbs shall be removed from the fill material prior to compaction to the required density. Soils with organic matter content exceeding 5% by weight shall not be used. Stones with size measurements greater than 3 -inches (in any direction) shall be removed from the fill prior to compaction: 3. Fill material placed at densities lower than specified minimum densities or at moisture contents outside the specified ranges or otherwise not conforming to the specified requirements shall be removed and reworked or removed and replaced with acceptable materials. 4. Any fill layer that is smooth drum rolled to reduce moisture penetration during a stone event shall be properly scarified prior to the placement of the next soil lift. 5. Surface water and stream flows shall be controlled continuously throughout construction and the placement of controlled fill. 6. Foundation areas may require undercutting of compressible and/or unsuitable soils in addition to that indicated on the plans. All such undercutting shall be performed at the discretion of the Geotechnical Engineer and shall be monitored and documented by the geotechnical engineer during construction. In no rase shall there be an attempt to stabilize any portions of the foundation soils with crushed stone. 7. Treatment of seepage areas, subgrade preparation, foundation dewatering, and rock foundation preparation (Le., treatment with slush grouting, dental concrete, etc.) may be required at the discretion of the geotechnical engineer. All such activities shall be closely monitored and documented by the Geotechnical Engineer during construction. 8. Fill placed adjacent to the riser and principal spillway pipe shall be placed in a manner where lifts are at the same level on both sides of the structures. 9. Earthwork compaction within Vest of any structures shall be accomplished by means of hand tampers, manually directed power tampers or plate compactors, or miniature self-propelled rollers. 10. Compaction by means of drop weights from a crane or hoist shall not be permitted. 11. Heavy equipment shall not be allowed to pass over cast -in-place structures (including the cradle) unfit adequate curing time has elapsed. 12. To reestablish vegetation after construction, a 2- to 3 -inch layer of topsoil shall be placed on the disturbed embankment surface and the area seeded and mulched or hydroseeded. If grass stabilization is attempted during the summer months, the placement of sod and the implementation of an aggressive watering program may be the best and quickest means of achieving the 85% stabilization requirement of the BCE certification program. Testing, Observation, and Certification 13. Tests of the degree (%) of compaction of the placed fill in the dam shall be performed as a part of the Pernittee's normal quality control program for the construction of the dam. Tests shall be conducted concurrent with the installation of the compacted fill, and the contractor shall coordinate the construction of the dam so that the testing can be completed. Should the results of the tests indicate that the specified degree of compaction has not been obtained, the portions of the dam represented by such tests shall be reworked or rebuilt. All portions of the dam shall achieve the specified minimum degree of compaction. 14. Construction of Class A, B, and C dam embankments (with the exception of detention only Class C dams that collect drainage from an area of 25 -acres or less) shall be performed under the observation of a qualified Geotechnical Engineer, who is a registered NCPE The geotechnical engineer must have experience in the design and construction monitoring of dams of the size and scope covered by these standards and guidelines. 15. On Class A, B, and C dams (with the exception of detention only Class C dams that collect drainage from an area of 25 -acres or less), the Geotechnical Engineer, as defined above, shall observe all aspects of the construction of the dam (i.e., preparation of the foundation, installation of the cut-off trench, installation of the principal spillway pipe, installation of the internal drainage, installation of compacted fill, etc.).
