The Airport proposes to extend the existing runway, taxiway, and runway safety area west of the existing runway. The implementation of these improvements would permanently impact approximately 0.29-acre of Section 404 jurisdictional wetland and 0.06-acre Section 401 jurisdictional wetland. An Approved Jurisdictional Determination (SAW 2010-01453) was issued for the project area on December 23, 2010, and a Stream Buffer Call was issued on October 12, 2010 (TPRRO#10-108). The Airport is requesting a Water Quality Certification for the above impacts under Section 401 of the Clean Water Act in association with the a Section 404 Nationwide Permit. Please find enclosed five (5) copies of the Preconstruction Notification Form and related documentation. A check in the amount of $240.00 for the DWQ processing fee is also attached. Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this application: The project study area consists of the maintained areas of the Airport within the perimeter fencing. This area consists of maintained grasses and herbaceous species kept at a few inches in height. Wetland areas also exist within the project study area and are maintained less frequently than the adjacent upland, leaving areas dominated by species typical of a freshwater marsh. Adjacent land use consists of scattered rural residential development, undeveloped/forested areas, and active agricultural areas located west of the Airport. 3b. Explain the purpose of the proposed project: The purpose of the proposed project is to improve the safety and function of the existing runway at the Oxford-Henderson Airport to accommodate corporate turboprop and jet traffic. The improvement to the runway would provide economic benefit to the surrounding area. Safety and Function Corporate turboprops and jets require an all-weather runway of sufficient length, strength, and navigational aids for safe operation. Physical and logistical shortcomings related to the existing Airport would be alleviated by extending the existing runway and safety areas. In addition, the extension would allow for all-weather use and reduced approach visibility minimums. With rapidly increasing traffic at the Raleigh-Durham International Airport, additional emphasis on corporate air traffic at the Oxford-Henderson Airport is expected to continue. Economic Benefit Many large companies utilize corporate aircraft in their day-to-day business. A community without adequate airport facilities cannot compete in today's marketplace. Those communities offering well-designed and attractive airports can better accommodate and meet the requirements of corporate users. The proposed improvements would allow for additional growth of corporate aircraft utilizing the facility. In addition, a new industrial park is planned near the Airport off of I-85. Increasing the functionality of the facilities at the Airport to meet today's corporate standards would help to draw the desired commercial and industrial businesses the region is seeking. 3e. Describe the overall project in detail, including the type of equipment to be used: The proposed project would consist of extending the existing runway, taxiway, and runway safety area to the west of the existing runway. Runway 6 would be extended approximately 500 feet west and would be approximately 100 to 120 feet wide, which would include a 35-foot wide parallel taxiway. The runway safety area would extend approximately 300 feet from the end of the extended runway and would be approximately 150 feet wide. The improvements are detailed on the attached permit drawings. Selecting the extension of the runway to the west avoided potential stream impacts associated with extending the runway to the east. Based on aerial photography and the USGS Topographic Map extending the runway and associated safety area/taxiway would have impacted approximately 380 linear feet of a blue line stream. 1b. While the proposed project would also benefit the region economically, future economic development is not directly dependent on the completion of the proposed project. Future development planned at the Airport is shown in the attached Airport Layout Plan (ALP) (refer to Appendix E). The ALP represents potential future development for planning purposes and does not necessarily represent exactly what development will occur. Only the current proposed improvements are funded, and the timeframe for future development is largely unknown due to the nature of securing state and/or federal funds for construction. In addition, since these conceptual projects would occur in areas currently maintained by the Airport, minimal impacts to the natural environment are anticipated. 4. Permits X 0 0 BIOTIC COMMUNITIES AND WETLANDS Below is a description of the biotic communities and wetlands that will be impacted by the proposed 500-foot extension of Runway 6 and its associated taxiway at the Oxford-Henderson Airport. Biotic Communities Natural areas observed within the project study area can be classified based on their vegetative composition, landscape position, soil type, and hydrologic regime into various upland and wetland biotic communities. Upland communities identified within the project study area consisted largely of disturbed/maintained areas. This includes the upland area within the airport fence line, which is mowed/maintained on a frequent basis, thereby keeping the vegetation only a few inches tall. This area was dominated by various types of planted grasses and early-successional weedy herbaceous species. Disturbed/maintained areas observed also included areas that had been recently clear cut and managed planted pines. The clear cut areas likely consisted of mesic mixed hardwood forest and oak-hickory forest prior to disturbance, but at the time of investigation little vegetation remained in these areas. The area of managed planted pine consisted of four to five year old loblolly pine (Pinar taeda) Wetland communities identified consisted of freshwater marsh in areas that have been disturbed. Wetlands identified within the airport fence consisted of areas that are maintained by the airport, although not as frequently as the upland grassed areas, resulting in vegetation that was approximately three feet high at the time of investigation. Due to the maintenance of these areas, they are kept in a marsh like state. Without maintenance they would likely grade into forested wetlands over time. Vegetation observed was typical of fresh water marsh wetlands and consisted of soft rush (Juncus eff rsus), sedges (Caren spp.) tear thumb (Polygonum sagittatum) and false nettle (Boehmeria cylindrica). Wetland areas outside of the airport fence has been recently clear-cut at the time of investigation, and due to the removal of woody vegetation, also exhibited characteristics of a freshwater marsh, dominated by vegetation similar to areas within the airport fence line. These areas likely consisted of bottomland hardwood type wetlands prior the clearing activities. Impacts to Biotic Communities Impacts to approximately 10 acres of biotic communities would result from the runway extension and clearing/grubbing activities (See Figure2). A large majority of the biotic community impacts caused by the runway extension would be to upland disturbed/maintained communities. These areas would likely remain in their existing condition, expect for areas that would consist of the new impervious surface for the runway and taxiway. The runway extension would also result in 0.35 acres of impacts to wetland communities. These impacts are based on a GPS survey of the wetland limits in the approved Jurisdictional Determination (attached) and the design shown on Figure 2. These impacts would occur from fill required to extend the runway safety area. Impacts resulting from the grubbing of the previously cleared areas would impact uplands consisting of disturbed areas. The area of managed pine would also be cleared and grubbed. Grubbing would not occur in wetland areas, so wetlands within the clearing/grubbing limits would not be impacted. 0 0 Permitting and Mitigation The proposed runway extension would likely be permitted under a Section 404 Nationwide 14 Permit (for linear transportation projects). A Nationwide 14 includes activities required for the construction, expansion, modification, or improvement of linear transportation projects (e.g., roads, highways, railways, trails, airport runways, and taxiways) in waters of the United States, which does not cause the loss of greater than 0.5-acre of waters of the United States! Since the wetland impacts associated with the proposed project are due to the extension of the existing runway and taxiway, and are under the 0.5-acre threshold at 0.35 acres, it is anticipated that a Nationwide 14 could be used to permit the project under Section 404 of the Clean Water Act. The final determination of the pen-nit type would be determined by the U.S. Army Corps of Engineers (USACE) with the submittal of a Pre-Construction Notification Form. Applicants for state and federal permits for projects that would result in a discharge to wetlands and waters of the United States must obtain a Section 401 Water Quality Certification from N.C. Division of Water Quality. This certification involves a review of the proposed project and analyzes its potential impact to water quality. This review is performed to ensure that any discharge into jurisdictional areas is in accordance with State water quality standards. The Section 401 Water Quality Certification would also ensure compliance with the Tar-Pamlico Buffer Rules. Per the recent requirements issued jointly by the USACE and the U.S. Environmental Protection Agency (EPA) in the Department of Defense, Department of the Army, Corps of Engineers 33 CFR Parts 325 and 332/Environmental Protection Agency 40 CFR Part 230 Compensatory Mitigation for Losses of Aquatic Resources; Final Rude, dated April 10, 2008, mitigation banks are the preferred method of mitigation. Therefore, existing mitigation banks in the Tar-Pamlico River Basin were investigated for the potential future purchase of mitigation credits. Four commercial mitigation banks are located in the Tar-Pamlico River Basin and none of the banks are located within a service area (HUC 03020101) that includes the project study area.z Therefore, it is likely that the North Carolina Ecosystem Enhancement Program (NCEEP) In-lieu Fee Program would be used to compensate for unavoidable impacts to waters of the U.S. The NCEEP is a state run statewide in-lieu fee program administered by the NCDENR and is similar in function to a mitigation bank. The NCEEP provides a mitigation option for permit applicants when commercial mitigation bank credits are not available. Additionally, in order to comply with NC Session Law 2008-152, mitigation banks serving HUC 03020101 would need to be contacted to determine if credits are available before the use the NCEEP In-lieu Fee Program. Given their nearness to the runway extension, we would like to review the revised noise contours for the airport on a map that shows a larger area surrounding the airport. This will help us determine if there are other historic properties in the area as well as the effect of the proposed extension and improvements. Based on our knowledge of the area, it is unlikely that any archaeological resources that may be eligible for inclusion in the National Register of Historic Places will be affected by the project. We, therefore, recommend that no archaeological investigation be conducted in connection with this project.
