PROJECT SUMMARY: The applicant proposes to reconfigure the existing community docking facility and perform maintenance excavation of the boat basin and access channel. PROJECT DESCRIPTION: The applicant's project site is located at the Maritime Place Subdivision located off E. 7th Street between Old Marina Drive and Baywatch Drive, adjacent to Shallotte Sound and the Atlantic Intracoastal Waterway (AIWW), in Ocean Isle Beach, Brunswick County. The subdivision is located along East 7th Street - near the intersection of East 7th Street and Shallotte Boulevard. To locate the property from Ocean Highway South (NC Highway17) approximately 3 miles south of Shallotte, turn left onto Ocean Isle Beach Road SW and travel southwest approximately 4.5 miles to Ocean Isle Beach. After crossing the bridge, make the second left onto East 2nd Street and travel approximately 2 miles to Charlotte Street. Turn left onto Charlotte Street and make an immediate right on East 3rd Street. Follow East 3rd Street for approximately 0.1 miles to Shallotte Boulevard and turn left. Continue on Shallotte Boulevard for approximately 0.20 miles and turn right onto East 7th Street. The Maritime Place Subdivision will be located on the left hand side of the road. The existing subdivision consists of two strips of high ground, which range in elevation from 6 feet to 11 feet above mean sea level. Both strips extend from East 7th Street, north towards the Atlantic Intracoastal Waterway (AIWW) for approximately 450 feet. The two strips of high ground are connected along East 7th Street. Two existing paved roads, Old Marina Drive to the west and Baywatch Drive to the east, spaced approximately 300 feet apart, enter the property from East 7th Street and extend approximately 400 feet towards the AIWW. The high ground of the subdivision appears to have been created during the dredging of a basin adjacent to the property in the 1970's when the property was known as "Camp Atlantic" (See North Carolina Dredge and Fill Permit #130-74). A NC Dredge and Fill Permit #130-74, was issued to Richard Jennings on or around July 31, 1974 authorizing the excavation of a boat basin and access channel located waterward of the highground, within the waters of the Shallotte Sound. The authorized boat basin measured approximately 460 feet in the length and approximately 60 feet in width. The boat basin was connected to the AIWW via an access channel that measured approximately 400 feet in length by approximately 40 feet in width. The basin and channel were dredged to a final depth of approximately -12 feet at Normal Low Water, according to the previous permit. CAMA Major Permit #152-03 was issued to Maritime Place c/o Stuart Cooke on November 4, 2003 for the upland development of the subdivision and included roads, utilities, pool and bulkhead construction. CAMA Express Permit # 166-03 was issued to Maritime Place c/o Stuart Cooke on November 18, 2003 and authorized the maintenance excavation of the previously permitted boat basin to a final depth of -6 feet at NLW and -8 feet at NLW in the access channel. CAMA Major Permit #166-03 also authorized the construction of a 3- slip community pier. CAMA Permit #166-03 was modified on March 2, 2004 to include additional bulkhead and expired on December 31, 2006. The Maritime Place Subdivision consists of a 4.41 acre tract that has been subdivided into 22 single- family residential lots, averaging 5,443 square feet in size. The subdivision property has approximately 1,053 linear feet of shoreline along the Shallotte Sound. Approximately 500 linear feet of timber bulkhead stabilizes the highground adjacent to the platted subdivision lots along Old Marina and Baywatch Drives. The common access/open space area for the subdivision is located between the two subdivision streets. The common area is approximately 28,817 square feet or 0.66 acres with approximately 656 feet of shoreline frontage. The shoreline in these areas is not bulkheaded. The boundary between the upland lots and the common area has a marked elevation drop at the transition from the highground to the adjacent intertidal area and consists of an ebayment of wetlands. The shoreline transition consists of a progression of three bands of wetland and coastal wetland vegetation. Maritime Place Property Owners Association, Inc. Page 3 ' First, is a border of "404 type" wetlands including woody shrubs Iva spp., and Baccharis spp.,as well as Spartina patens. High Coastal Marsh comprises the second border of vegetation. Species observed include; Spartina patens, Juncus roemerianus, Limonium spp., Distichlis spicata and Salicornia spp.. The third and generally broadest vegetative band is a border of Smooth Cordgrass (Spartina alterniflora). Along the shoreline of the subdivision this vegetation pattern exists in overlapping widths. Typically the "404 type" wetlands range from 5 to 10 feet in width, mixed coastal vegetation high marsh ranges from 5 to 15 feet in width, followed by the Smooth Cordgrass marsh that fills the ebayment and extends waterward of the bulkheads along the shoreline of the individual lots with frontage adjacent to the open water areas of Shallotte Sound. The ebayment of marsh is spanned by an access walkway measuring approximately 4 feet wide by 130 feet long. The access walkway is oriented east to west and extends from the highground of the common access area nearest Lots 9 and 14. The access walkway leads to an access pier that extends to the north measuring approximately 4 feet wide by 192 feet long to a T-head measuring approximately 20 feet long by 8 feet wide. The access pier then extends approximately 20 feet waterward of the T-head where it is connected via ramp to an approximately 60 feet long by 8 feet wide floating dock. The existing docking facility is authorized for 3 slips. Water depths adjacent to the existing docking facility range from -0.5 feet to -1.5 feet at NLW. The waters of the AIWW adjacent to the project are classified as SA by the North Carolina Division of Water Quality. The waters are open to the harvest of shellfish. They ARE designated as a Primary Nursery Area by the N.C. Division of Marine Fisheries. The open water of the ebayment is approximately 188 feet wide in the location of the existing docking facility. 10. PROPOSED PROJECT: The applicant proposes to reconfigure the existing community docking facility and perform maintenance excavation of the boat basin and access channel. The applicant is proposing to reconstruct the existing floating dock with a fixed docking system in order to accommodate boat lifts and finger piers. As proposed, the reconstructed fixed dock would measure approximately 94 feet long by 6 feet wide. The proposed dock would incorporate finger piers; four (4) on the north side of the fixed dock, each measuring approximately 21 feet in length by 4 feet in width, evenly spaced along the floating dock. The proposed finger piers would be spaced approximately 26 feet apart and boatlifts measuring approximately 12 feet wide by 13 feet long are proposed on the sides of the proposed finger piers. On the eastern end of the proposed fixed pier, an access ramp would be connected to a proposed floating dock measuring approximately 20 feet long by 8 feet wide. The proposed floating dock would be constructed with a handrail to prevent dockage on the southern side (see sheet 3 of 4). The proposed fixed dock and floating dock configuration would exceed the footprint of the existing docking facility by extending the facility approximately 65 feet to the east. As proposed, the docking facility would provide dockage for eight (8) vessels; seven (7) lift slips and one (1) wet slip on the outboard side of the proposed floating dock. As proposed lift slip #7, with associated finger pier, as well as the floating dock, would be located within the riparian access area of Lot #9 (see page 2 of 4). As proposed, the pier would extend approximately 47 feet into a waterbody which measures approximately 189 feet across. The applicant is proposing to maintenance excavate the boat basin Maritime Place Property Owners Association, Inc. Page 4 and access channel authorized by State Permit #130-74. The proposed maintenance excavation would be conducted adjacent to the proposed docking facility within the footprint of the previously authorized excavation area. The area to be excavated would measure approximately 185 feet in length by 60 feet in width and would be dredged to a final project depth of -6.0 feet at normal low water (NLW). The applicant is also proposing to maintenance excavate the access channel to the AIWW. The access channel excavation area would measure approximately 407 feet in length by 40 feet in width and would be dredged to a final depth of -8 feet at NLW. The applicant has stated that the proposed maintenance excavation would be accomplished with a hydraulic dredge. The applicant has also stated that the access channel would be tapered from -6 feet at NLW near the basin, to the -10 feet contour that exists adjacent to the AIWW. Excavated material would be hydraulically pumped to the Army Corps of Engineers Disposal Area #303 located to the northeast end of Lee Street in Ocean Isle Beach. The ACOE Disposal Area #303 is located approximately 1.25 west of the project site along the AIWW. The proposed spoil disposal area consists of approximately 35 acres. The applicant has provided a letter granting permission from the representative property owners (see attachment). Todd Horton, ACOE, has stated that the site is in great condition and is available for use; authorization from the ACOE is pending CAMA approval (see ACOE letter). 11. ANTICIPATED IMPACTS: The proposed reconstruction and reconfiguration of the community docking facility would incorporate approximately 2,152 square feet of Public Trust and Estuarine Waters. The components of the proposed docking facility would result in approximately 1,060 square feet of shading impact. The proposed maintenance dredging would result in the excavation of approximately 27,380 square feet of shallow bottom habitat within a designated PNA. The applicant has stated approximately 7,087 cubic yards of spoils material would be generated from the project and placed at the ACOE Spoil Disposal Area #303. As proposed, all spoil material would be contained within the dike walls of the disposal area would be confined landward of any regularly or irregularly flooded marsh. As proposed the docking facility reconfiguration would be located within the riparian access area of Lot #9, the applicant has stated that the owner of Lot #9 has provided the POA with a letter of consent (copy included in package), with agreement to place an appropriate deed restriction to waive riparian rights for this property. As proposed the community docking facility would provide a total of eight (8) boat slips for the subdivision, although the applicant has not stated how the slips would be assigned or designated. As proposed the docking facility would conform to the quarter width limitation. Short term increases in turbidity can be expected during construction and dredging activity. Submitted by: Holley Snider Date: 10/11/11 Office: Wilmington Proiect Narrative: Maritime Place Subdivision is located on a 4.41 acre tract at the northeast end of Ocean Isle Beach, in Brunswick County and adjacent to the Atlantic Intracoastal Waterway (AIWW). The subdivision and project site is just north of East Seventh Street, near the intersection of East .Seventh and Shallotte Boulevard. The property has approximately 1,041 feet of shoreline, with 500 feet of timber bulkhead stabilizing a portion of the uplands. The waters of the AIWW adjacent to the project are classified as SA by the North Carolina Division of Water Quality. The project area is designated as Primary Nursery by the Division of Marine Fisheries. The Subdivision Property Owner Association (POA) maintains, an existing pier and floating dock that are located on the north side of the subdivision property, between Baywatch Drive and Old Marina Drive. There is a previously permitted dredged basin and access to the AIWW. The pier begins in the subdivision common area between Lot 9 and Lot 14, measuring 6 feet wide by approximately 235 feet in total length. There is also covered 8 foot by 18 foot sitting area and ramp to the floating dock. The floating dock measures 8 feet by 60 feet. The previous dredge area disturbance was approximately 44,100 square-feet. The most recent excavation and construction activity was initiated under CAMA Permit No. 166-03, issued on November 18, 2003 and modified on March 2, 2004. This excavation was performed in 2004. Past excavation of the site was performed under NC Dredge and Fill Permit 9130-74 in the 1970's. The applicant proposes to perform maintenance dredging within a portion of the previously permitted excavation . site. This area measures 27,255 square-feet and consists of a basin measuring approximately 60 feet by 185 feet, extending from the eastward riparian corridor for Lot 14 to just beyond the eastward riparian corridor for Lot 9. It should be noted that the owner of Lot 9 has provided the POA with a letter of consent (copy included in application package), with agreement to place an appropriate deed restriction to waive riparian rights for this property. The basin would be positioned approximately 80 feet northward of the existing bulkhead. It is proposed also to dredge the channel, approximately 40 feet wide by 407 feet long as previously permitted, connecting the basin to the AIWW. The basin area and southern-most 225 feet of the entrance channel have a proposed dredge depth of -6 feet MLW. The remaining portion of the entrance channel would be sloped from -6 feet MLW to the existing -10.7 feet MLW contour near the AIWW channel. The project would result in the excavation of approximately 7,087 cubic yards of material, which would be relocated using Hydraulic Dredging to the US Army Corps of Engineering Disposal Area #303, located at the northeast end of Lee Street, Ocean Isle Beach. The applicant also proposes to remove a portion of the existing pier and to construct a fixed 6 foot by 94 foot dock, with four 4 foot by 21 foot fingers, in addition to a 20 foot by 8 foot floating dock, to be accessed by a 4 foot by 12 foot ramp. Seven slips would be created and intended for use with boat lifts. One additional floating dock slip is planned, for a total of eight proposed slips. N.C.
