provide this written response to the USACEs March 30, 2011 Notification of Unauthorized
Activity, along with this after-the-fact application for unauthorized impacts and proposed boat
ramps at Billet's Run Subdivision, Chatham County, NC.
History & Existing Conditions:
John W. Blair of the Blair Company is the property owner and developer of Billet's Run
Subdivision. Billet's Run Subdivision consists of two road crossings, one within a 45' private
driveway easement off property (connection off Wimberly Road) and one road crossing on the
pond dam, and an amenity/fishing pond. The purpose of the road crossings were to access 5
residential lots ranging in size from approximately 5 acres to 15 acres.
The grading for the road and pond bottom started in or around 2005, the road paving and pond
completion took place in or around 2006, and the pond was filled by 2007.
S&EC was contracted by Pabst & Hilburn, PA, the project engineer, in May 2011 to assist in the
resolution of the outstanding violations associated with Section 301 of the Clean Water Act as
outlined in the USACE letter. S&EC met onsite with Monte Matthews of the USACE, Martin

Resaonse to USACE March 2011 Notification of Unauthorized Activitv:
The March 2011 Notification letter requested a formal response indicating when the violation was
completed, the amount of stream channel impacted by the violation and the remediation steps
proposed. We have provided a response to this request below:
Proiect/Violation History:
The road crossing off property (connection off Wimberly Road) was originally a dirt road, but was
upgraded to a paved road with a HDPE pipe in or around 2005-2006. Additionally, the grading of
the pond and road crossing on pond dam took place in or around 2006. And finally, the pond was
completed and filled by 2007.
Total Stream Impacts:
Attached is the after-the-fact PCN Application and supplemental information requesting
authorization for the existing impacts for the road crossings and amenity/fishing pond. This PCN
application package includes impact exhibits that identifies and approximates the existing impacts
for Billet's Run Subdivision. In addition, this PCN Application requests authorization for three
boat ramps along the Haw River, two of which will be shared.
The attached PCN requests the following impacts be formally approved
• 472 linear feet of stream (existing)
0 137 linear feet of perennial & intermittent for road crossings/fill
0 335 linear feet of perennial & intermittent for flooding
• 0.024 acres of open water (proposed)
Based on correspondence with Mr. Matthews and Mr. Richmond, it is our understanding that the
responses documented above along with the attached "after-the-fact" application (if approved)
should bring Billet's Run Subdivision back into compliance with USACE and NCDWQ Section 301
of the Clean Water Act. Please contact me if any additional information is required.

application: The existing conditions on site consist of five forested lots and the constructed Billet's Run Road and pond.
The general land use in the vicinity of the project is a mix of rural and forested land, with some agriculture.

The USACE and/or S&EC confirmed that no wetlands exist within the impact locations or within the floodplain between
lots 4 & 5.

The purpose of the proposed project is to construct boat ramps for residential access to the Haw River and to receive

Additionally, the project includes the previous construction of one road crossing, a road crossing/dam structure and the

other typical equipment used for land clearing, road construction and excavation.

D. Impact Justification and Mitigation
1. Avoidance and Minimization
la. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project.
Impact #1 (Road Crossing) was necessary to access the property. In addition, it was constructed in the upper
section of an unimportant, intermittent stream therefore avoiding impacts to a stream with important aquatic
function. Impact #2 (Pond Flooding) was constructed as an amenity and does not result in a "loss of waters". In
addition, the pond flooding was primarily to unimportant, intermittent streams to minimize perennial stream
impacts. Impact #3 (Road Crossing/Pond Dam) was necessary to access the southeastern portion of the site.
Impact #'s 4, 5 & 6 are all proposed boat ramps resulting in a combined total of less than 0.024 acres of open
water impact. All boat ramps will be constructed with concrete, steel rebar, rip-rap and filter fabric. Lots 1 & 2 will
share boat ramp #3. Lot 2 will access the boat ramp via Billet's Run Road and therefore will not require an
additional access drive over the perennial stream that bisects Lot 2. Lots 4 & 5 will share boat ramp #1 and Lot 3
will utilize its own boat ramp #2
The applicant is aware of the regional conditions associated with the Nationwide Permit 14, 29 and General Permit
No. 197800125. With respect to linear transportation crossing conditions (NWP 14-Regional Conditions section
4.0) the applicant does not anticipate any stream relocations; all culverts have been sized appropriately, and this
project is not being used in conjunction with a NWP 18 to create an upland area. With respect to residential
development conditions (NWP 29-Regional Conditions section 4.0) the applicant does not anticipate any impacts to
streams or wetlands associated with stormwater facilities, there are no impacts associated with single-family
recreation facilities, Impact # 1 does not result in permanent stream fill within the floodway/floodplain and the stream
classification for this project is WS-IV (i.e. not Outstanding Resource Waters, High Quality Waters, Coastal
Wetlands or wetland adjacent to these waters).

was constructed on top of an existing dirt road to provide access to five (5) residential lots. As a result, 137 linear feet of
stream was piped. In addition, a portion of a stream was flooded to create a pond resulting in the flooding of 335 linear
feet of stream. Both activities were completed without Notification to the USACE/NCDWQ.

We have reviewed the "Draft Intemal Policy, Cumulative impacts and the 401 Water Quality Certification and Isolated
Wetlands Programs" document prepared by the NC Division of Water Quality on April 10, 2004, version 2.1. The draft
states that many private developments are unlikely to cause cumulative impacts, including projects such as urban in-fill,
most residential subdivisions and small commercial developments as well as agricultural and silvicultural operations. The
Billet's Run Subdivision project is a small residential development. The residential lots are large in size, ranging from 5-
15 acres in size and imperviousness will be well below 24%. We anticipate that if a qualitative or quantitative impact
analysis is required, the DWQ will advise.

Habitat? The NC-Natural Heritage Programs Virtual Workroom was used to search for elemental occurrences of state and
federally protected species in the vicinity of the project. It was determined based on the search that there are sixteen elemental
occurrences, five of which are Significant Natural Heritage Areas, that were found within two miles of the project boundaries.
Two of the elemental occurrences are listed as Federally Endangered however neither the Notropis mekistocho/as or the
Ptilimnium nodosum are located within our project location. Additionally, three of the sixteen are listed as either Endangered or

8b. If yes, explain how project meets FEMA requirements: The existing pond, dam and spillway are constructed (on an
unnamed tributary of the Haw River) in the effective (current FEMA mapping) flood Zone AE within a backwater
flooding area created by the Haw River. We understand that local ordinance allows the placement of fill within the
flood fringe (non-floodway areas) such as this without hydraulic analyses. The effective Base Flood Elevation
(BFE) as shown on the effective (current) Flood Insurance Rate Map (FIRM) is 177.00 feet. It should be noted that
at the time the pond, dam and spillway were constructed we understand that the regulatory BFE was 175.50 feet.
Based on field survey data collected at that time the construction activities occurred the work appears to have been
performed outside of the regulatory floodplain boundary. The proposed boat launches are to be constructed along
the west bank of the Haw River in the effective flood Zone AE (same BFE). The fill material is anticipated to have
little or no impact to water surface elevations and as such is similarly permitted by local ordinance.
8c. What source(s) did you use to make the floodplain determination? Floodplain boundaries and floodplain determinations
were made utilizing available on-line data from the North Carolina Floodplain Mapping Program (NCFMP) website
(www.ncfloodmaps.com) including Flood Insurance Rate Map Panel No. 9688 dated February 2. 2007.

Dear Mr. Blair:
This refers to a recent site meeting on March 15, 2011, on property you have developed off
Wimberly Road near Moncure, Chatham County, North Carolina. The development is a residential
subdivision named Billet's Run. The purpose of the site meeting was to verify the presence of
jurisdictional waters within the area for future permitting needs.
The March 2011 site visit revealed that approximately 200-300 linear feet of jurisdictional
stream channel had been impacted without a section 404 permit during the construction of a road
crossing and amenity pond.' This activity is considered a violation of Section 301 of the Clean
Water Act. Conversations with Mr. Dan Pabst, consulting engineer, indicated that no further work
would occur in waters of the U.S. without a DA permit. The Corps agrees that this is a necessary
step that would help in the overall remediation process. It is understood that additional impacts
may be required for complete construction of the subdivision and that these impacts will be
addressed during the permitting process.
Please provide a formal response to this letter indicating when the violation was completed, the
amount of stream channel impacted by the violation, and the remediation steps proposed. Removal
of the fill and restoration of the streams or verification of an After-the-Fact permit would act as
remediation of the Section 301 violation. You should submit your response on or before May 2,
2011, and note that any permit application must include all impacts associated with your project.
Please be reminded that no new impacts within wetlands or waters other than restoration of the
site can occur on your property until this matter is resolved. Such work, without authorization by a
DA permit, may result in referral of this matter to the U.S. Attorney for appropriate action.
