Sullins Director Dee Freeman Secretary October 10, 2011 DWQ Project # 11-0847 & 11-0848 Wake County CERTIFIED MAIL: 7010 1870 0001 3428 0730 RETURN RECEIPT REQUESTED Lisa Potts City of Raleigh PO Box 590 Raleigh, NC Subject Property: Greenway Bridges Replacement and Removal Project Lake Johnston Park Bridge # 74 - DWQ Project # 11-0847 Lake Johnson [030402, 27-57-10, C; NSW] Lions Park Bridge #391- DWQ Project # 11-0848 Bridges Branch [030402, 27-33-19, C; NSW] REQUEST FOR MORE INFORMATION Dear Ms. Potts: On September 13, 2011, the Division of Water Quality (DWQ) received your applications dated August 17, 2011 to fill or otherwise impact 14 linear feet of perennial stream channel (permanent impacts), 36 linear feet of perennial stream channel (temporary impacts), and 117 square feet of Zone 1 Neuse River basin protected riparian buffer (temporary impacts) to replace Lake Johnson Park Bridge # 74 and to fill or otherwise impact 16 linear feet of perennial stream channel (permanent impacts), 40 linear feet of intermittent stream channel (temporary impacts), and 386 square feet of Zone 1 Neuse River basin protected riparian buffer (temporary impacts) to replace Lions Park Bridge #391. The DWQ has determined that your applications were incomplete and/or provided inaccurate information as discussed below. The DWQ will require additional information in order to process your applications to impact protected streams and buffers on the subject property. This project is on hold and incomplete until we receive the additional information requested below. If we do not receive the requested information, your projects will be formally returned as incomplete. Please provide the following information so that we may continue to review your projects. Additional Information Requested: Lake Johnson Park Bridge #74 and Lions Park Bridge Replacement #391 1) The limits of disturbance for both the projects appear to be greater than the buffer impacts in the PCN application. This could be a temporary impact but replanting would be required. Please explain and revise impacts accordingly. 2) Table 6b in both applications indicate that the buffer impacts are temporary. However, rip-rap is considered a permanent impact. Please revise impacts and resubmit Page 7 of 11 of the PCN Application. Lake Johnson Park Bridge #74 1) Is the extent of the buffer impacts correctly depicted on Exhibit A? The PCN Application indicates that "banks will be regraded, coir matting and rip-rap will be placed". This statement would indicate that Exhibit A is incorrect. Please explain and revise accordingly. Please submit five copies of this information within 30 calendar days of the date of this letter. Please send additional information to DWQ Central Office, Attn: Karen Higgins, 1650 Mail Service Center, Raleigh, NC 27699-1650 and copy Lauren Witherspoon (lauren.witherspoon@ncdenr.gov). If we do not receive this requested information within 30 calendar days of the date of this letter, your project will be withdrawn and you will need to reapply with a new application and a new fee. If you need additional time to compile the information requested above, please email Lauren Witherspoon (lauren.witherspoon@ncdenr.gov) requesting an extension and indicate a new date for submittal. This letter only addresses the application review and does not authorize any impacts to wetlands, waters or protected buffers. Please be aware that any impacts requested within your application are not authorized (at this time) by the DWQ.
