PROJECT SUMMARY: The existing commercial marina was previously issued a major permit (251-89) on 12/22/89 (due to the expansion of a DOT right-of-way), for the reconfiguration of the existing docking facility, boat ramp relocation and maintenance excavation (20' x 75' x -4' nlw) within the existing high ground boat slip. The previously excavated area is currently the existing boat ramp. The applicant is proposing new excavation, outside of the previously permitted excavation area, at the existing 22 slip commercial marina. Osprey Oaks Marina 3197 Hwy 24 Page 02 9. Narrative Description: The Osprey Oaks Marina is an existing non-fuel commercial marina. The project is located at 3197 Hwy 24 in Newport, Carteret County (off State Road 1121, Pearson Circle). Osprey Oaks Marina is foa_-d by following NC Hwy 24 east to the Broad Creek Bridge (approximately 1/4 mile east of Croatan High School). The site is located on Broad Creek, south of the Broad Creek Bridge off of State Road 1121, Pearson Circle and is on the non- PNA section of Broad Creek in this area. The PNA is located north of the Broad Creek Bridge. The width of Broad Creek within this area is approximately 505' to 740' depending on location. The subject property is 71,838 square feet in its entirety and averages 9' in elevation above NHW. Currently on the high ground portion of the site is a 22 slip commercial marina (field verified and see old major permit plat), gravel drives and parking area, two residential rental units, bulkhead, piers, platforms, finger piers, boatlifts, boatramp, typical vegetation (grass) and trees. Extending off the portion of high ground, approximately 37' from the northern property line is the first existing pier (6' x 80') and platform (6' x 15' to a 10' x 18'). A total of 12 slips are located along this dock. Approximately 45' south of the first dock is an area of finger piers which house 4 additional slips. The final pier (6' x 80') and platform (10' x 30') for the last 6 slips is approximately 47' from the southern property line. A major permit (251-89) for the marina was issued on 12/22/89 for the reconfiguration of the existing marina, relocation of the boat ramp and maintenance excavation of an existing high ground boat slip (20' x 75' x -4' nlw) due to a DOT road expansion. South of the existing boatramp and pier, adjacent to the southern riparian neighbor, is a 9' wide x 12' long section of coastal wetlands which consists of Smooth Cordgrass (Spartina alterniflora). The shoreline along this area is 271' with water depths in the marina basin ranging -.75' nlw to -2.8' nlw (field verified) and connecting water depths of - 4' nlw. The bottom substrate is silty sand within the project area. The Division of Water Quality classifies this area as SA/HQW Waters. This portion of Broad creek is not a designated Primary Nursery Area and is closed to the taking of shellfish. There are no shellfish leases within this area and no SAV was observed. Carteret County's Land Use Plan dated 2010 classifies this area as Limited Transition with Conservation within the AEC. There is approximately 160' from the existing bulkhead to the channel. There is a DOT bridge and right-of-way to the north with single-family residences with private docks to the south of the project site. 10. Proiect Description: The existing commercial marina was previously issued a major permit (251-89) on 12/22/89 (due to the expansion of a DOT right-of-way), for the reconfiguration of the existing docking facility, boat ramp relocation and maintenance excavation (20' x 75' x 4' nlw) within the existing high ground boat slip. The previously excavated area is currently the existing boat ramp. Due to the shallow water depths (< -2' nlw), the applicant is proposing new excavation within the existing 22 slip commercial marina basin with a bucket to barge method. A total of 2,230 cubic yards of material would be removed below nhw. The excavation dimensions are v Osprey Oaks Marina 3197 Hwy 24 Page 02 125' x 219' and have an average existing depth of -1.3' nlw. The proposed final depth is - 3.5' nlw with connecting water depths within this area approximately -4'nlw. The excavation would be a distance of 5' to 10', depending on location, from the coastal wetlands located at the southern property line. The spoils would be located on the northwest corner of the property (100' x 100' area), enclosed with silt fencing and "wheat bale" berms, outside of the AEC and a distance of 180' to 215' landward of nhw. The typical boat to be served would be mixed types and have an average length of less than 25' (determined through field verification). 11. Anticipated Impacts: The proposed new excavation would disturb 27,375 ft' of shallow estuarine bottom and allow the continued use of the recreational facility. The water depths within the basin currently are an average of -1.3' nlw, with connecting water depths of -4' nlw. The excavation has the potential to cause a temporary increase in turbidity during excavation however no long-term negative effects are anticipated if a sediment curtain is utilized and the excavation does not exceed a maximum depth of -3.5' nlw (help ensure adequate flushing capabilities). No coastal marsh would be filled or excavated during this project. The only "high ground" disturbance would be the 100' x 100' spoil disposal area, which would be located 180' to 215' landward of nhw outside of the 75' Coastal Shoreline AEC. HEATHER STYRON Morehead City October 12, 2011 September 20, 2011 Osprey Oaks Marina 3197 Highway 24 Newport, NC 28570 252-342-2029 Osprey Oaks Marina, Dredging Project, This dredging project-will use one barge equipped with a hydraulic clam shell bucket, and dump trucks. The area to be dredged will be excavated and loaded onto barge with the hydraulic clam shell bucket until the barge is loaded. The dredged materials will then be transported by barge to designated unloading site. Once at the unloading site the material will be transferred from barge by hydraulic clam shell to dump trucks. After the dump truck is loaded, it will be driven to a Cama approved spoil area and unloaded. The above process will continue until the project has been completed. The unloading site is adjacent to existing channel that is to be dredged. The project from start to finish will take approximately 10 working days. The proposed basin to be dredged is 219' by 125'with an average depth of 3.5' at mean low water. The bulkhead shoreline will be sloped. This should help prevent further sloughing of the shore line.
