This project is under the jurisdiction of the Town of Apex, so please issue it with a condition that impacts may not occur
until the DWQ has received a copy of the locally approved Stormwater Plan.
Here is some suggested wording:
1. Written Stormwater Management Plan (Final Plan Needed)
Before any of the approved impacts may occur, the Division of Water Quality must receive documentation of the
Town of Apex's approval of the stormwater management plan (including a copy of the signed and notarized
Operation and Maintenance Agreements) for this project by providing EITHER:
• A valid approval letter from the Town indicating that the proposed activity has an approved SMP and one
copy of the approved SMP, including plan details, calculations and other supporting information, OR
• A set of stormwater plan details and calculations stamped as "Approved" by the Town of Apex.
These facilities must be designed to treat the runoff from the entire site. Also, before any permanent building is
occupied at the subject site, the facilities (as approved by the Town of Apex) shall be constructed and
operational, and the stormwater management plan shall be implemented.
