Environmental Services, Inc. is submitting the enclosed supplemental information on behalf
of the project applicant, JVI Development II, Inc. This submittal is in response to your
request for more information dated October 4, eon and is intended to allow you to continue
reviewing the Section 401 permit application. I have responded, in order, to both items that
you described in your October 4`h notification.
Item #I: The project being proposed under this permit application is a single and complete
project with separate utility. Several projects in this vicinity have the name "Bella Casa" in
their title, but were planned and have been developed separately. I have included a PUD
map provided by the project engineer that depicts the first z "Bella Casa" projects. The
original Bella Casa subdivision is located on Apex Barbecue Road; a considerable distance
away to be considered part of this development. The Manors and Cottages at Bella Casa
PUD, which includes Phases 1-6, were developed next. This application includes Phases 5
and 6 of this PUD. Development in Phases 1-4 do not incur any jurisdictional impacts.
Therefore, stating that the Manors at Bella Casa 5 & 6 project has no project history is an
accurate statement as there are no previous impacts and it is not linked to any previous
development in this area.
The third development was the Traditions at Bella Casa, which received a permit for a road
crossing earlier this year. This development is not depicted on the enclosed PUD map.
These are all separate developments that have been acquired at different times as land has
become available over the years. There are no known plans to expand any of these projects
that have "Bella Casa" attached to their names. Please note that the Town of Apex has
approved all of these developments prior to any permit application.
It is noted that DWQrefers to this project with a 2005 project number, suggesting that
internally this is linked to the original Bella Casa project on Apex Barbecue Road. Other
than having "Bella Casa" in the name; this project is not linked to that original development
and should not be processed in that manner. It is our understanding that the 2005 permit was
for a sewer outfall that was being required by the Town of Apex and was permitted by

S&EC. We have provided this same information to the Corps of Engineers requesting that
they view this as a single and complete project.
Item #z: Please refer to the above information describing the map being provided with this
submittal. With regards to the road termini, the project engineer indicated to ESI that the
current roadway layout and termini shown in the application are a result of regulations
imposed by the Town of Apex with regards to future connectivity and fire response. These
requirements by Apex do not take into account the fact that the applicant does not control
the adjacent parcels where the road terminates in a stub. Also, the longest road that
terminates with a stub exceeds the length allowed for a cul-de-sac. The applicant does not
control the adjacent parcels and is not attempting to acquire them. Should they be developed
in the future by another party, the applicant has no control over their design (and potential
impacts) other than controlling where they must connect to the existing road that is inside
his project limits.

Re: U.S. Army Corps of Engineers (USACE) Site Meeting to verify the Wetlands and Waters of
the U.S. for the McLamb Tract, Wake County, North Carolina
Dear Mr. Iannone:
On April 7, 2006, Mr. Thomas Brown of the USACE and I reviewed the areas on the site potentially
subject to USACE jurisdiction. Mr. Brown determined that features B and C are non jurisdictional
channels. He also agreed with our delineation, with the exception of the area that was flagged in the
drainage above flag 203. This area was considered non jurisdictional. Please see map for details.
The next step in this process is to generate a wetland delineation map for submission to the USACE for
approval and permitting. S&EC has not received a draft copy for a sign-off map to date. If you choose to
have S&EC submit a map on the owner's behalf, please contact us or send a draft map for our review.

RE: Verification Meeting for the Town of Apex Riparian Buffer Rules on the Mclamb WeAtern
Parcels; Wake County, North Carolina
Dear Mr. Iannone:
On August 17, 2007 S&EC personnel met Mr. Michael Deaton of the Town of Apex to
verify/confirm our buffer determination. At our meeting Mr. Deaton confirmed that feature C would
contain a 50 foot buffer throughout its extent on property. Pond 1 has a 100 foot buffer as shown on the
attached sketch map. Feature B was determined not to be subject to the buffer rules. In a previous
determination on the property to the west, it was determined that feature A is not subject as well. Mr.
Deaton will send confirmation of our findings.
apex Buffer Rules
As part of the Town of Apex's Watershed Protection Overlay Districts, Apex has adopted riparian buffer
requirements. These requirements include establishment of a 50-foot riparian buffer on intermittent
streams and a 100-foot riparian buffer on perennial streams and rivers depending on whether the site is
located within a Primary or Secondary Watershed Protection District. Ponds and lakes require a 50-foot
minimum riparian buffer unless the feature joins with a perennial stream, in which case a 100-foot buffer is
required. Intermittent and perennial streams, ponds, and lakes are defined as those shown on the most
recent versions of the 7.5-minute USGS topographic quadrangle or applicable Soil Survey maps. If there is
a discrepancy between these two maps, the classification requiring the most stringent buffer applies.
Affected parties may appeal the classifications depicted on the aforementioned maps to the Town of Apex
in the Cape Fear River Basin.
Additional Services
S&EC is in the process of submitting documentation and pictures to the USACE on the questionable area
associated withfeature B, as well as the potentially isolated Pond 1. S&EC will let you know once a
determination has been made on this feature. If you have questions regarding this or permitting, S&EC
personnel-are available for site plan review or to meet for a discussion of permitting issues pertaining to
this project. Please contact S&EC if you have any questions.

Re: Wetland Delineation and Town of Apex Stream Buffer Evaluation

On February 13, 2007, S&EC personnel conducted a site meeting with the United States Army Corp. of
Engineers at the Holleman Tract located near the end of Evans Rd. in Apex, NC. At this meeting the
Corp. of Engineers determined that both stream features (A & B) on site are intermittent and have
unimportant aquatic function. It was also determined that the wetlands located to the west of flag S 100
are not.as large as they were previously identified as. New flags in this area were hung using orange
S&EC flagging with numbers in the 100's to demarcate the newly identified wetland boundary. These
flags should be surveyed and included m the wetland delineation/sign-off map. Lastly, the marginal
channel located near feature B was determined to be wetlands. The attached sketch map outlines these
changes to the wetland boundary and the stream determinations. If you have any questions please call.
