PROJECT SUMMARY: The applicant proposes to modify Major Permit #61-08 to include the construction of a docking facility that consists of a pier extension, a "T" head platform, finger piers, 8 boatlifts and 1 wet-slip with tie pilings for an additional 9 slips. Project Setting The site of the proposed development is an Eco-tourism business located at 1118 Corolla Village Road (SR 1185), Lot 2 of the Lighthouse Club Subdivision, within the Village of Corolla immediately north of the Corolla Lighthouse on the Currituck Sound in Currituck County. The subject property is owned by Twiddy Family Partnership, LLC and is ± 10.9 acres in size. The tract averages ±275' wide by ±1,721' deep and extends from Corolla Village Road to the Currituck Sound. With the exception of a small irregularly shaped area of uplands (±12,723 sf) adjacent to Corolla Village Road, the majority of the property (±427,222 sf) has been delineated as Section 404 wetlands by the US Army Corps of Engineers (USACOE). Additionally, most of the wetland area is Coastal Wetlands dominated by giant cordgrass (Spartina cynosuroides), with smaller amounts of salt meadow hay (Spartina patens), black needlerush (Juncus reomerianus) and cattails (Typha spp.). The upland area adjacent to Corolla Village Road is vegetated with oaks, some pines and has an understory of herbaceous shrubs, vines, and upland grasses. This area transitions to a wooded wetland as you move toward the sound. The wooded wetland quickly transitions to Coastal Wetlands. A large "pond" that has a connection to the Currituck Sound encroaches onto the property along the northwest property line with the remainder of the property on the northwest side being undeveloped and vegetated similarly to the applicant's. The adjacent property on the southeast side is also undeveloped and vegetated similarly to the applicant's. Existing development that was permitted through Major Permit #61-08 and any subsequent modifications on the tract include a ±1,495'x6' boardwalk over wetlands that extends from the upland area to the Currituck Sound, a ±22.5'x14' platform off of the boardwalk within the "pond" area, a ±200'x6' pier, a 20'x16' covered platform with a 18'x4' and 16'x4' dropdown platform attached to it, a boatlift on the north side of the platform and several kayak racks on both the pier and boardwalk. Additional development within the upland area of the tract includes a rental/retail facility and parking area. The property has ±315' of shoreline along the Currituck Sound and water depths approximately 230' offshore at the existing platform are ±3' below the normal water level (NWL). The bottom substrate within the project area is made up of fine sands. According to an SAV survey conducted within the project area, species found included horned pond weed (Zannichellia palustris), sago pondweed (Stuckenia pectinata), widgeon grass (Ruppia maritime), and eurasion milfoil (Myriophyllum spicatum). The waters of the Currituck sound are classified as SC by the Environmental Management Commission and are not open to shellfish taking. The nearest docking facility is located ±.25 miles to the southeast at the Whalehead Club. Development Proposal The existing Eco-tourism business, in efforts to expand its business to conduct guided motorized boat tours, has requested to modify CAMA Major Permit #61-08 to include a docking facility that will allow for an additional 9 slips in addition to the existing 1 slip previously authorized. The proposed docking facility will be accessed via a stairway on the northwest side of the existing platform area. The stairs will lead onto a 24'x4' access platform that will be located on the southwest side of the existing platform. A 54'x6' pier will extend from the center of the access platform and will end in a 26'x3' "T" head platform. Three tie pilings will be set ±15' waterward of the "T" head platform to provide for 1 slip. Two 20'x3' finger piers will extend from each side of the proposed pier creating an additional 8 slips. Within each of these 8 slips, a 20'x12' boatlift is proposed. The proposed docking facility will be elevated a minimum of 3' above NWL. Anticipated Impacts • The proposed pier, finger piers and platforms will result in the additional shading of ±738 sf of PTA and EW AECs within water depths -eT below NWL. • The proposed boatlifts will result in the additional shading of ±1,920 sf of PTA and EW AECs within water depths >_3' below NWL. The proposed development will result in localized short term turbidity. Existing Existing Eco Tour business with kayak rentals wants to expand to offer guided motorized (Avg. 24 feet skiff/runabout shallow draft boats) boat tours. Existing pier, educational platform, boat racks, boat slip with lift and kayak launches as shown on the attached site plan. Proposed Construction of an additional 9 slips (8 slips at 12 feet by 20 feet and one "side to" slip measuring 15 feet by 26 feet) for a total of ten slips. Eight of the nine proposed slips will have boat lifts and one side to mooring at end of "T" dock as shown will primarily be used for temporary mooring and dropping off and picking up of passengers. Proposed development involves construction of pier with "T" head (500 sf) and four finger piers (180 sf). All of the slips with the exception of the "side to" slip are proposed to have boat lifts (12 feet by 20 feet each). The newly constructed pier and slips will be accessed from the northwest dropdown kayak platform via a set of stairs as shown on the attached site plan. Water Depths and SAV All of the proposed development is sited in water depths of 3.0 feet or greater as shown on the attached map. A water depth and SAV survey was conducted by Quible & Associates, P.C. on July 1, 2011. Water depth contours are based on that July 1, 2011 survey. The area of the proposed project is SAV habitat and species found during the survey included Horned Pond Weed (Z. palustris), Sago Pond Weed (S. pectinatus), Widgeon Grass (R. maritime) and Eurasian Milfoil (M. spicatum). SAV in the vicinity of the proposed pier and boat slips is best described as "patchy" in water depths greater than approximately 1.0 feet. There are consistent beds of predominately R. maritima in the shallower waters (1.0 feet to 2.0 feet or less). Please note, there are no SAV found in waters shallower than 1.0 feet. The SAV survey was conducted by performing a frequent series of shallow dives using snorkel and mask along generally perpendicular transects from the shore to average water depths of approximately three and half feet. In addition, intensive surveying was conducted in and around the areas of the proposed structures and boat slips. A copy of an aerial photograph with the are reviewed during the survey showing water depths and general SAV observations is provided as an attachment to this application proposal. Avoidance and Minimization The proposed slips will have boat lifts which will keep the boats out of the water, allowing for adequate light penetration. Boat lifts also minimize the hull and water contact time which reduces the chance that anti-fouling paints or hull construction materials will dissolve. In addition, the proposed pier structure will be elevated a minimum of three feet above NWL to allow for light penetration to minimize impacts to SAV habitat. Purpose and Need There is and has been a great public demand for access to the waters of the Currituck Sound in Corolla Village. Currently, public water access is limited to the Whalehead Club where shoaling, organic deposition and inadequate and unreliable water depths make it problematic for the general public to enjoy the Currituck Sound. There is a long well documented history of guided tours within the public trust of Currituck Sound.
