Sullins Director Dee Freeman Secretary October 6, 2011 Wake County DWQ Project No. 05-1132 Mr. Randy Smith DVS Investors, LLC 100 Weston Estates Way Cary, NC 27513 Subject Property: Chessington Subdivision DIFFUSE FLOW PLAN APPROVAL Dear Mr. Smith: On August 5, 2005, the Division of Water Quality (DWQ) issued a revised 401 Water Quality Certification to permanently impact 200 linear feet of stream and 0.454 acre of 404 wetlands in order to construct the Chessington Subdivision in Morrisville, North Carolina. In order to meet Condition 6 of the 401 Certification for this project, a diffuse flow plan for Chessington Subdivision, dated August 22, 2011, was received on August 22, 2011. The proposed diffuse flow plan for Chessington Subdivision has been reviewed and satisfies the diffuse flow condition of the 401 Water Quality Certification. You are required to meet the following conditions: 1. The diffuse flow system (consisting of one level spreader and all associated appurtenances), all stormwater conveyances and the grading and drainage patterns depicted on the plans, as approved by this office must be maintained in perpetuity. No changes to the diffuse flow practices shall be made without written authorization from the DWQ. The diffuse flow structures shall have maintenance access to allow for the ability to maintain the structures, and to perform corrective actions. The stormwater easements shall be recorded to protect the structures from potential alterations by future property owners. 2. All operation and maintenance activities shall be followed as stipulated in the Operation and Maintenance Agreement signed by Hampton Pitts (Division President of Ashton Woods Homes) and notarized on September 16, 2011. 3. The applicant and/or authorized agent shall provide a completed Certification of Completion Form to the DWQ 401 Program within ten (10) days of the project completion (available at: http://portal.ncdenr.org/web/wq/swp/ws/40 I/certsandpermits/apply/forms).
