PROJECT SUMMARY: The applicant plans to construct four community piers with crabbing platforms, one community floating dock, an elevated wooden bridge, a screened shelter with restrooms, a canoe storage building and parking area. PROJECT DESCRIPTION The proposed project is located in Brunswick County between NC Hwy 211 and Sunset Harbor Road, adjacent to Mercer Mill Creek near the Lockwoods Folly River. The proposed project consists of three sites within the Seawatch subdivision. To reach the project area, travel south on US Hwy 17 to the intersection with NC Highway 211 near Supply, NC. Turn left onto NC Hwy 211 and travel approximately 5 miles to Sunset Harbor Road. Turn right onto Sunset Harbor Road and travel approximately 2.5 miles, the entrance to Seawatch will be on the left hand side of the road. Once within the development, travel to the three project sites should be made according to the subdivision map included in the permit application. The property encompasses approximately 1,274 acres with 1,141 lots and extends from Sunset Harbor Road to NC Hwy 211. Approximately 165.66 acres of the 1,274- acre site are §404 wetlands. Mercers Mill Creek, a tributary to the Lockwood Folly River, divides the property into two sections and borders the northeast boundary of the property. The highground portion of the property has an elevation range from 2 to 32 feet above mean sea level. The topography of the site is generally flat, with moderate slopes leading down to the waterfront in some areas. The highground soils consist primarily of Baymeade fine sand, Wando fine sand, and wetland soils consist of Torhunta mucky fine sand. The site is predominately wooded with highground vegetation consisting primarily of Loblolly Pine (Pinus taeda), Red Maple (Ater rubrum), Black Gum (Nyssa sylvatica), Sweet Gum (Liquidambar stryciflua) Turkey Oak (Quercus laevis), Yaupon Holly (Ilex vomitoria) and Southern Wax-myrtle (Myrica cerifera). The predominant coastal wetland species in the project area consist of Black Needlerush (Juncus roemerianus) and Salt Meadow Cordgrass (Spartina alterniflora). The coastal wetland areas consist of mixed high and low marsh areas of varying size and composition. The Corps of Engineers has approved a wetland delineation of the Seawatch development site. Existing structures on the property includes roads, utilities, and several houses under construction which are located landward of the 75' Estuarine Shoreline AEC. The Brunswick County Land Use Plan classifies the upland areas of this project as Rural. The waters of Mercer Mill Creek in the vicinity of the project area are classified C; Sw, HQW by the NC Division of Water Quality. The Division of Marine Fisheries has designated this area as Primary Nursery Area and it is closed to the harvesting of shellfish. PROPOSED PROJECT The applicant plans to construct four community piers with T-head platforms, one community floating dock, one elevated wooden bridge, a screened shelter with restrooms, a canoe storage building and a parking area. The applicant states that the floating dock will be used as a canoe and. kayak launching facility and no permanent boat slips are proposed. The majority of the uplands have been cleared and most of the roads and utilities have been installed. Development of the upland part of the project is currently under construction and consist of approximately 1,141 lots for single family homes ranging in size from approximately '/4 to l+ acre in size and several houses are nearing completion. The applicant proposes three separate sites for the construction of the four community docks (see Sheet 6 of 26 for locations). Site `'1" is located at the end of Gallego Point between Lots 41 and 42. At this location the applicant has proposed asemi-circular driveway and parking area measuring approximately 98' x 137' located landward of the 75' Estuarine Shoreline AEC. Adjacent to the parking area the applicant proposes two structures; one is referred to as a screened shelter with restrooms located on the northwest side of the parking measuring approximately 52' x 68'. A second structure referred to as a canoe storage building is proposed adjacent to the Seawatch at Sunset Harbor, Inc. Page 3 first structure on the south side. The canoe shelter would measure approximately 27' x 41' and would be connected to the screened shelter by a wooden open deck area. As proposed, there would be an elevated wooden boardwalk/pier measuring approximately 6' in width by 68' in length, which would extend waterward from the screened shelter to an elevated fixed T-head measuring approximately 12' in width by 28' in length. The structure would run parallel with the shoreline and would extend approximately 6' into the waterbody (see Sheets 7, 8 & 10 of 26). The center portion of the T-head, approximately 12' in width by 19' in length, would be covered. The waterbody measures approximately 24' wide at this location and the water depths adjacent to the T-head are approximately -1.06' @MLW. The northern end of the platform, approximately 6'in width by 8' in length would extend over §404 and coastal wetlands, predominately Salt Meadow Grass (Spartina patens) and Black Needle Rush (Juncus roemarianus). The remainder of the highground at this location is devoid of ground cover. The applicant proposes a second pier at Site "1"which would originate at the canoe storage building and would extend waterward and would measure approximately 6' in width by 100' in length. The pier would connect to an elevated fixed T-head measuring approximately 10' in width by 26' in length running parallel with the shoreline. This structure would extend approximately 5' into the waterbody and approximately 5' over coastal wetlands, vegetated predominately with Black Needle Rush. As proposed, the center portion of the platform, approximately l 0' in width by 19' in length would be covered. Extending from the north end of the platform the applicant proposes a ramp measuring approximately 3' wide extending to a floating dock measuring approximately 4' in width by 20' in length running parallel to the shoreline (see Sheets 9 & 11 of 26). The applicant states that this floating dock would be used for launching canoes and kayaks and no permanent slips are proposed. The waterbody measures approximately 26' wide at this location. Water depths adjacent to the floating dock range from approximately 0.60' to -4.16' @MLW. At Site " 2", which is located off Gallega Point between Lots 47 and 48, the applicant is proposing a third elevated pier and elevated fixed T-head. The proposed pier would measure approximately 6' in width by 385' in length and would span §404 and coastal wetlands, vegetated predominately with Black Needle Rush. At the terminal end of the pier would be an elevated fixed T-head measuring approximately 10' in width by 35' in length and running parallel the shoreline. This structure would extend approximately 6' into the waterbody and approximately 4' over coastal wetlands, vegetated predominately with Black Needle Rush. As proposed, the center portion of the platform, approximately 10' in width by 19' in length would be covered. The waterbody at this location measures approximately 28' wide and the water depths adjacent to the T-head range from approximately -1.83' to -2.50' @MLW. At Site " 3", which is located at the end of Verrazano Lane, starting behind Lot 288, the applicant is proposing the fourth elevated pier and elevated fixed T-head. The proposed pier would measure approximately 6' in width by 372' in length and would span X404 and coastal wetlands, vegetated predominately with Black Needle Rush. At the terminal end of the pier would be an elevated fixed T-head measuring approximately 10' in width by 40' in length running parallel the shoreline and extending approximately 6' into the waterbody and approximately 4' to 6' over coastal wetlands, vegetated. predominately with Black Needle Rush. As proposed, the center portion of the platform, approximately 10' in width by 19' in length would be covered. The waterbody at this location measures approximately 31' wide and the water depths adjacent to the T-head are approximately-0.82' @ MLW. Seawatch at Sunset Harbor, Inc. Page 4 The applicant is also proposing to construct an elevated bridge across Mercer Mill Creek in order to connect the northern and southern portions of the subdivision and provide access to the main entrance off Sunset Harbor Road. "The proposed bridge would be located on Nautica Blvd. Between North Respire and Barlowe Streets. At this location Mercer Mill Creek is designated as inland waters, but is still tidally influenced. Adjacent to the proposed bridge location are jurisdictional §404 wetlands, which extend approximately 250' landward from the bank of the creek. No coastal wetlands are located at the proposed bridge site. As proposed, the bridge would measure approximately 30' in width by 615' in length and would be elevated approximately 5' to 12' above the §404 wetlands. The proposed bridge would be elevated on pilings and constructed of solid wood framing with concrete abutments measuring approximately 35' in length with I-beams and wood planking (see Sheets 20 thru 25 of 26). As proposed, the bridge will have a horizontal clearance of approximately 35' and a vertical clearance of approximately 11' for navigation. The applicant states that logging mats will be used for construction equipment to cross all wetlands and silt fencing will be installed. Approximately 1500 sq. ft. of highground fill is proposed in the construction of the bridge to provide a transition from the ground to the bridge surface at the terminal ends of the bridge. No fill material is proposed in §404 wetlands. The average water depth at the proposed crossing is approximately -2' @ MLW. 10. ANTICIPATED IMPACTS A total of .68 acres of highground area would be graded, filled, and or disturbed for the construction of the screened shelter with restrooms, canoe storage building, parking area, and bridge. The proposed piers and platforms would result in the shading of approximately 5,481 sq. ft. of coastal and §404 wetlands. The docks would incorporate approximately 665 sq. ft. of Estuarine Waters and Public Trust Area. The piers and docks would not appear to exceed '/4 width of the water body. Those lots currently platted would be prohibited from having piers and since the property lines do not extend to MHW (thus no riparian rights). A short-term increase in turbidity can be expected during piling installation during pier/dock construction. Brunswick County will be the provider of community water and sewer service for the subdivision. Sedimentation and Erosion Control Plan and Stormwater approvals have been received for this project. Wilson Date: Apri126, 2007 Office: Wilmington Project Narrative CAMA Major Permit Construction of Plank Bridge Brunswick County Seawatch. at Sunset Harbor MAS Properties, LLC and Seawatch at Sunset Harbor Inc, request a CAMA Major permit to construct a wooden plank bridge over Mercer Mill Creek, to build four. community crabbing docks, one community floating dock, and four community piers in the Seawatch at Sunset Harbor subdivision. The planned Seawatch subdivision is located between Highway 211 and Sunset Harbor Rd. in Brunswick County. Mercer Mill Creek divides the development into two sections, so that the northern part of the development is disconnected from the community's planned entrance off Sunset Harbor Rd. To access the northern portion of the property, and avoid wetland fill impacts, a bridge is proposed. Mercer Mill Creek is a freshwater creek which has been deemed tidal by NC DCM staff. The crossing is not located within a 75' Estuarine Shoreline AEC, and no coastal wetland vegetation exists along the creek in the vicinity of the bridge. The Public Trust AEC is present and requires the inclusion of the proposed bridge crossing into the CAMA Major Permit application. Jurisdictional 404 wetlands do exist along the creek and extend approximately 250' from either side of the creek banks. Wetland limits have been delineated by Land Management Group and. approved by the US Army Corps of Engineers. The total bridge length will be approximately 615' and the total width will be approximately 30'. The bridge will begin approximately 50' before the wetland limit on both sides of the creek, so that no wetland fill is required. Upland fill will be utilized for approaches to the bridge. The proposed piers will be 68, 100, 372, and 385 feet long and will provide access to the proposed platforms. There are four platforms proposed that will be used as crabbing docks. One 4'x 20' floating dock is proposed. 1"he floating dock will be used to launch canoes and kayaks. There are no permanent boat slips proposed. There is no dredging or wetland fill proposed. Piers will be elevated over coastal wetlands a minimum of 3 feet and will not exceed 6 feet in width. Platforms will not extend more than '/4 of the width of the water body, into the channel, or more than 6' over coastal wetlands. None of the proposed structures are located within I S feet of adjacent riparian corridor lines. Upland development will include one screened shelter with restrooms, one canoe storage building, and asphalt and concrete parking located on Site 1.
