The existing conditions of the site are graded roadside ditches and private lanes. The proposed gravity sewer will be
placed at the right-of-way line with permanent easements throughout the project. Where no right-of-way is present,
permanent easements will be acquired by the County to install and maintain the new gravity sewer lines.

The project is proposed to provide public sanitary sewer to the residents along New Hope Church Rd. and the adjacent
private lanes.

The project will involve the construction of one (1) pump station, approximately 7,025 LF of 12-inch gravity sewer, and
approximately 4,800 LF of 8-inch gravity sewer. The gravity sewer and pump station will be installed using trackhoes and
other related equipment to dig the trenches within the proposed right-of-ways and permanent utility easements. Proper
erosion control measures will be used to prevent sediment moving offsite. The one intermittent stream will be open cut
but will use proper measures to prevent downstream impacts.

The majority of the buffer impacts are in the NCDOT's existing transporation facility, which are exempt. See Appendix H for

A. DESCRIPTION OF PROJECT
Location of Project
The proposed sanitary sewer project is located in Edgecombe County southwest of the
Town of Leggett and north of the intersection with NC Highway 97 and New Hope Church
Rd. (SR 1408). This sewer project will be owned by Edgecombe County's Water and
Sewer District No. 5, where it resides. The majority of the work will take place within
NCDOT right-of-ways and private utility easements along New Hope Church Rd. and
Dunbar Woods Rd. A vicinity map has been attached which shows the exact project
location in Edgecombe County.
Type of Development
Gravitv Sewer
The proposed sanitary sewer project will be a linear construction project consisting of
installing approximately 7,025 LF of 12-inch gravity sewer and 4,800 LF of 8-inch gravity
sewer. The 12-inch sewer is located along New Hope Church Rd. to act as the main trunk
line that accepts wastewater from the adjacent residences and the 8-inch feeder lines that
are located along Dunbar Woods Rd., private lanes, and utility easements.
Manhole 25, the northernmost manhole, is the manhole that the existing 6-inch force main
from Phillips School Pump Station will tie-in to. The wastewater from Phillips School will be
conveyed by the gravity system to the proposed Dunbar Pump Station.
At the southern end of the proposed collection system, the existing 8-inch force main that
conveys wastewater from the Leggett Main Pump Station and Coker-Wimberly School
Pump Station will be redirected to Manhole 26 and then to the proposed Dunbar Pump
Station where it will be repumped.
Pump Station & Force Main
The collected wastewater will be conveyed to the new Dunbar Pump Station, which is
located on a parcel owned by Edgecombe County adjacent to New Hope Church Rd. The
wastewater will then be pumped through approximately 400 LF of a new 8-inch force main
to the existing 8-inch force main that previously conveyed wastewater from the Leggett
Main Pump Station. The existing downstream 8-inch force main will convey the wastewater
from the Dunbar Pump Station to the City of Rocky Mount's Wastewater Treatment Facility
(WWTF).
Earth Disturbing Activities
The project will involve digging trenches for the 8 and 12-inch gravity sewer lines, the new
8-inch force mains at the south end of the project area, and the construction of the Dunbar
Pump Station. The width of the installation trench will vary based on the depth of the
gravity sewer. At the deepest parts, the trench will be approximately 30 feet wide with a 10'
wide spoil pile. The one intermittent stream (unnamed tributary to Key Branch) will be open
cut to install the 12-inch gravity sewer that is proposed for that location. Sedimentation and
erosion control measures will be used throughout the project, but most importantly at the
main stream crossing and at the many small ditch crossings. The required erosion control
measures will be installed prior to construction. A track-hoe will be used in the excavation
process with other associated equipment for sewer system installation. To cross NCDOT
roads, a process of boring and jacking will be utilized.
Existing Drainage Patterns
E:dgecombe County is generally broad and flat sloping from west to the east. The County
is located in the Tar-Pamlico River Basin and within Fishing Creek, Little Fishing Creek,
Rocky Swamp and Beech Swamp Subbasin (03-03-04). The majority of the area located
within this project area drains to road side ditches and/or unnamed tributaries, which
ultimately flow to Key Branch. Key Branch flows directly to the Tar River that bisects the
County.
B. EROSION AND SEDIMENTATION CONTROL MEASURES
1. A copy of the latest approved sediment and erosion control plan must be on file at the job
site. Timely and proper attention shall be required for prevention of offsite erosion and
sedimentation. Various levels of erosion control are proposed in the engineering
documents. If it becomes evident that additional erosion and sedimentation control
measures are needed they shall be installed immediately by the contractor. A temporary
cover sufficient to restrain erosion must be provided within the 21 calendar days of
completion of any phase of land disturbance. A permanent ground cover, sufficient to
restrain erosion, must be provided within the shortest of 14 working or 90 calendar days
after completion of the construction or development.
2. A buffer zone, sufficient to restrain sedimentation, must be maintained between the land-
disturbing activity and any adjacent property or watercourses. Maintain / Do Not Disturb
existing vegetative cover in areas of no construction.
3. All disturbed areas will be seeded within 30 days following construction in accordance
with the seeding schedule as shown on the plans. We have attached the seeding and
mulching specifications to this document which gives the rates for fertilizer, tack, seeding
and mulch.
4. Temporary sediment control primarily will consist of temporary check dams and arc filters
which will be placed along the existing roadside ditches. The rock check dams shall be a
maximum of 1,000 LF apart and the volume of storage shall accommodate this sediment
as shown on the engineering documents. In the proposed project area, the slopes along
most of the roadside ditches are so flat that the spacing allows for a great amount of
storage before over flowing into the next drainage system.
In order to eliminate erosion from traveling downstream, arc filters will be utilized when
sewer lines bisect drainage culverts on the upstream side of the culvert.
5. Silt fence will be utilized in areas next to the blue line stream to prevent erosion of the
disturbed soil for the sewer line crossing. In the location of ditch crossings, rip rap is to be
placed at the opening of the storm drainage pipe to prevent erosion of the disturbed soil
for the pipeline crossing. Silt fence shall also be used to prevent erosion in areas where
bore and recovery pits are to be constructed and at open culvert crossings the silt fence
is to be tied into the temporary sediment traps or check dams as shown in the
engineering documents. Silt fence will also be utilized at the pump station site. Since the
velocity of flow through the roadside ditches is less than 2.5 fps, lining is not required but
there may be areas where the contractor will be required to place matting if drainage
ditch disturbance occurs.
6. If the contractor chooses to place any of the material on the adjacent roadway the
contractor shall be required to place screening over the roadway surface prior to
beginning the operations to assist in cleaning up the roadways after construction.
C. TIME SEQUENCE OF OPERATIONS
Construction is anticipated to begin January 2012. Permits are being secured now and
once the project is awarded, construction will be able to start. The contractor is required
under the contract to comply with all state regulations regarding erosion and
sedimentation control. Once the sediment and erosion control measures are in place, the
contractor will begin installing the sewer lines and manholes. The contractor shall
complete all construction within the easements and rights-of-ways as shown on the
plans. All utilities must be checked and tested and any areas that can be seeded should
be done as soon as possible.
Once the subsurface infrastructure is complete and tested, the contractor shall finish
grading and seeding remaining areas. Seed bed preparation details have been added to
the drawings. Hydro-seeding will not be used on this project. In areas where the trench
line is within the bottom of a ditch, erosion control matting shall be used to stabilize the
soil.
The erosion and sediment control measures are to be checked weekly and after any
rainfall event. Repairs shall be made immediately to the sediment and erosion control
measures as needed during the project.

Bald and Golden Eagle Protection Act (BGPA)•
In the July 9, 2007 Federal Register( 72:37346-37372), the bald eagle was declared recovered, and removed
(de-listed) from the Federal List of Threatened and Endangered wildlife. This delisting took effect August
8,2007. After delisting, the Bald and Golden Eagle Protection Act (Eagle Act) (16 U.S.C. 668-668d) becomes
the primary law protecting bald eagles. The Eagle Act prohibits take of bald and golden eagles and provides a
statutory definition of "take" that includes "disturb". The USFWS has developed National Bald Eagle
Management Guidelines to provide guidance to land managers, landowners, and others as to how to avoid

Threatened due to similarity of appearance(T(S/A))•
In the November 4, 1997 Federal Register (55822-55825), the northern population of the bog turtle (from
New York south to Maryland) was listed as T (threatened), and the southern population (from Virginia south
to Georgia) was listed as T(S/A) (threatened due to similarity of appearance). The T(S/A) designation bans the
collection and interstate and international commercial trade of bog turtles from the southern population. The
T(S/A) designation has no effect on land management activities by private landowners in North Carolina, part
of the southern population of the species. In addition to its official status as T(S/A), the U.S. Fish and Wildlife
Service considers the southern population of the bog turtle as a Federal species of concern due to habitat loss.

Background: According to Neuse Buffer Rules 15A NCAC 028.0233(3)(b), the Tar-Pamlico Buffer Rules 15A NCAC
02B.0259(3)(b), and the Catawba Buffer Rules 15A NCAC 02B.0243(3)(a), the buffer protection rules do not apply
when there are existing uses that are present and ongoing. The Division of Water Quality interprets the Randleman
Buffer Rules 15A NCAC 02B .0250 to be consistent with the above-mentioned riparian buffer rules.
Problem: Several questions have been raised regarding the definition of an existing transportation facility. Specifically
the questions ask, what are the lateral boundaries of an existing transportation facility?
Solution: "Existing Transportation Facilities" are defined as shown in the attached drawings. If scenarios arise that are
not addressed by the attached drawings, DWQ shall make a determination of the existing transportation facility on a
case-by-case basis.

Explanation: The feature(s) listed above has or have been located on the Soil Survey of Edgecombe County, North
Carolina or the most recent copy of the USGS Topographic map at a 1:24,000 scale. Each feature that is checked
"Not Subject" has been determined not to be a stream or is not present on the property. Features that are checked
,,Subject' have been located on the property and possess characteristics that qualify it to be a stream. There may be
other streams located on your property that do not show up on the maps referenced above but, still may be
considered jurisdictional according to the US Army Corps of Engineers and/or to the Division of Water Quality.
This on-site determination shall expire five (5) years from the date of this letter. Landowners or affected
parties that dispute a determination made by the DWQ or Delegated Local Authority that a surface water
exists and that it is subject to the buffer rule may request a determination by the Director. A request for a
determination by the Director shall be referred to the Director in writing c/o Cyndi Karoly, DWQ
Wetlands/401 Unit, 2321 Crabtree Blvd., Raleigh, NC 27604-2260. Individuals that dispute a determination
by the DWQ or Delegated Local Authority that "exempts" a surface water from the buffer rule may ask for
an ad judicatory hearing. You must act within 60 days of the date that you receive this letter. Applicants are
hereby notified that the 60-day statutory appeal time does not start until the affected party (including
downstream and adjacent landowners) is notified of this decision. DWQ recommends that the applicant
conduct this notification in order to be certain that third party appeals are made in a timely manner. To ask
for a hearing, send a written petition, which conforms to Chapter 150B of the North Carolina General
Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. This
determination is final and binding unless you ask for a hearing within 60 days.
The (owner/future owners) should notify the Division of Water Quality (including any other Local, State, and
Federal Agencies) of this decision concerning any future correspondences regarding the subject property
(stated above). This project may require a Section 404/401 Permit for the proposed activity. Any inquiries
should be directed to the Division of Water Quality (Central Office) at (919)-733-1786, and the US Army
Corp of Engineers (Raleigh Regulatory Field Office) at (919)-876-8441.

I have reviewed the Environmental Report (March 2010 revision) for the Edgecombe
Water and Sewer District No. 5 Wastewater Collection System Project prepared by The
Wooten Company for the applicant and have made the following determinations. In
accordance with 7 CFR Part 1794.22 (b) and (c), Rural Utilities Service's Environmental
Policies and Procedures, the proposed project meets the classification criteria for a
Categorical Exclusion with an Environmental Report. The environmental report is
acceptable for use by USDA - Rural Development as the Environmental Review for the
project.
There will be no conversion of important resources and no public notice will be required
for this project. I will recommend the concurrence of RUS SI 1794 Exhibit H to the State
Director. After the State Director has executed Exhibit H as concurring approval official,
the environmental review process will be complete for this project. A separate FONSI is
not required for this action.

I have reviewed the environmental documentation for the Edgecombe Water and
Sewer District No. 5 - Wastewater Collection System project. In accordance with
7 CFR Part 1794, Rural Utilities Service's Environmental Policies and
Procedures, the proposed project meets the classification criteria for a
Categorical Exclusion with an Environmental Report. There is no public review
period required for this project. Therefore in accordance with 40 CFR 1508.4, 1
recommend that you concur in the Agency's determination that the proposed
project will not have a significant effect on the human environment. Neither an
Environmental Assessment nor an Environmental Impact Statement is required.
