We are trying to make sure you have one collective response as opposed to divergent paths. First off I agree with 7oanne comments but have a couple points I wanted to clarify (my comments are numbered the same as 7oanne's): 7oanne comment; (2), the question is whether or not the activity is a regulated impact or not. If you are approaching the removal from high ground and simply extracting pilings that does not represent a discharge and thus not regulated. Now if you are going to have to construct some sort of causeway (logging mats or 1 other means) and this occurs in the wetland than yes please tabulate that area as an impact. If there is a regulated impact and its best described as an area and not a linear foot impact the way it's currently enumerated would be acceptable. The work in WaLLace Creek, WetLand 9, and WetLand 10 that we are caLcuLating as a temporary impact is the removaL of the wooden trestles that currently support the force main and the water Line. They wiLL be removed from boats or barges so there wiLL be no impact from the work structure. However, the trestles are to be puLLed from the ground or cut off below the stream bottom so there wiLL be some disturbance but not necessarily fiLL or a discharge. Because there was some in-water work and the bottom was to be disturbed I thought that we would need to perform that activity under some type of permit and needed to quantify it somehow. We can remove it as a temporary impact if it is not a regulated activity. (3) & (4), please do make it clear which area is permanent conversion and which is not. On that same note if the impact is so small and does not show up on the drawing then please zoom in the picture so an individual can complete compliance. For example, wetland impact 10, I cannot see the hatching on the provided drawings. Also if we had better detail with the trestle removal the above question may be easily answered. I have revised the drawings to separate temporary impacts from permanent impacts. I have also have tried to zoom in on the smaLLer areas so that they impacts are easier to discern. These revised drawings are attached. Also I think it is fair to say we both would like some sort of detail as to the trenching operation. Past permit applications from other applicants have included drawings or at least typical drawings showing how the material will be excavated, stock piled, and returned to the trench restoring the previous grade. For example, top soil should be staged separately and placed in the restored trench last to reduce compaction and provide a better base for regeneration. You do not want the contractor to place subsoil as topsoil and this should be clear to the operators. Currently developing and wiLL send to you when completed. (5) yes, our regional condition 4.7 states, "A plan to restore and re-vegetate wetland areas cleared for construction must be submitted with the required PCN. Cleared wetland areas shall be re-vegetated to the maximum extent practicable with native species of canopy, shrub, and herbaceous species. Fescue grass shall not be used." Please include the restoration plan with the additional information. This wiLL be ready and sent to you by Monday October 10, 2011 Both of us are in favor of electronic communication as long as it does not exceed our statutory review period. If you can have a response before the first couple days of October we can continue down this path if you need more time let us know so we can write letters. If you would like to reply with electronic drawings and or updated application sheets that would be fine. We will print out the new sheets and substitute into the application package. Oh, I see it now in the attachment. 3 2) I have a question on the open water impact on page 5 of 10. It indicates a tributary being impacted. The name is Wallace Creek. So would this impact not be listed under stream impacts vs open water impacts. Since it is only temporary. I guess it boils down to the definition of tributary in this case. (Brad this question is for you) 3) On the drawings there is no separation of the hatching for permanent impacts and the temporary impacts. We will need this culled out for future compliance. 4) I also need drawings that show more detail for the temporary impacts for the stream and open water. 5) I also need a description of how the areas that are to be temporarily impacted (for the mechanically impacted areas) how they will be restored and proposed monitoring for these areas. 6) For the DWQ, in lengths of utility lines over 150' in wetlands, there is requirement that anti seep collars are to be used. Please indicate and label on the drawings where these collars are to be placed and please be sure to include them on the construction drawings. This does not include the directional bore locations.
