If any crossing equals or exceeds 150 feet (intermittent and perennial streams) then
mitigation will be required from DWQ. It doesn't look like this will be the case,
but just wanted to let you know.
DWQ understands that it is a single and complete project.
Also, the Yadkin is 303d for turbidity. We expect Design Standards for Sensitive
Watersheds. We also expect stormwater treatment to the maximum extent practicable.

1. When you submit your PCN request, you will need to include documentation
for the required mitigation for this project.
2. Even thought the project is retaining the DOT TIP number, we will be
reviewing it as a separate and complete project with its own Corps Action Id
number.

Good afternoon. Axiom is preparing the permit application for the Duke Curve
Railroad Improvement project located in Davidson County and we wanted to
alert you to it and give you some background prior to its submission. This
project was initially part of the I-85 corridor improvements, including the
replacement of the bridge over the Yadkin River, and still retains the TIP

number for that project (I-2304A-C). The stretch of railroad considered for
this project is generally oriented on an east-west axis and extends
approximately 0.6 mile east from the general location of the I-85 bridge
replacement location. This project is intended to improve railroad function
and capacity of approximately 0.6 mile of railroad by realigning the track,
replacing several culverts and adding a short maintenance roadway. The
realignment will flatten a sharp curve that currently limits train speeds and
efficient railroad operations. The project will serve existing and future
passenger and freight rail traffic growth, including the Southeast High-Speed
Railroad Corridor. A Categorical Exclusion document has been prepared for
this project and we expect (based on my conversation with John last week per
independent utility of the project) that project impacts may be authorized
under Nationwide Permit 14 (Linear Transportation Projects). There are two
stream crossings located within this project, an eastern crossing and a
western crossing. The eastern crossing will impact two intermittent streams
(Streams SA and SB) for a total of 163 linear feet of impacts (based on a
25-foot buffer of the 258 design plans) and the western crossing will impact
approximately 144 linear feet of perennial stream (Stream SC) and 0.013 acre
of wetland. Jurisdictional streams and wetlands were delineated by NCDOT
Natural Environment Unit (NEU) biologists, and were apparently verified by
the two of you on January 6, 2010. At that time, streams SA and SB were
determined to have an intermittent flow regime and require mitigation at 1:1
ratios (if mitigation is determined to be necessary) and Stream SC was
determined to have a perennial flow regime requiring mitigation at a 2:1
ratio (if mitigation is determined to be necessary). I am attaching a figure
generated for the CE Document that should help my descriptions of the
location and function of the project.
We appreciate all of your time and input, and we hope to make this process as
smooth as possible. Any suggestions or requests that you have to aid in this
are greatly appreciated. We intend to keep you as up-to-date as possible.
