(BLC) is pleased to submit the attached PCN application package for the proposed Cardinal Oaks Subdivision to request a verification of Nationwide Permit 29 and a 401 Water Quality Certification and Neuse River Basin (NRB) riparian buffer approval. The project site is approximately 45 acres in size and located approximately 385 feet south of Cheek Road (SR 1800) at Carpenter Road's (SR 1822) intersection with Cheek Road, Durham, Durham County, North Carolina. The project consists of a high-density residential subdivision including roads, sanitary sewer and stormwater infrastructure. There is one road crossing of a wetland and two sanitary sewer crossings of buffered stream channels and grading and fill impact four isolated wetlands on the site. The project would permanently impact a total of 0.099 acre of jurisdictional wetland and 0.140 acre of isolated wetlands, temporarily impact 66 linear feet of stream channel, and impact a total of 2,167 square feet of Zone 1 NRB riparian buffer and 2,503 square feet of Zone 2. Permanent impacts to stream channels have been avoided. Because the jurisdictional wetland impact does not exceed 0.10 acre, BLC does not believe the USACE should require compensatory wetland mitigation. Additionally, BLC does not believe that NCDWQ should require compensatory wetland mitigation because the total wetland impacts do not exceed 1 acre. The residential development of Cardinal Lakes is located to the south of the site and the remaining property around the project is primarily forested with rural development along Cheek Road. Please refer to the attached USGS Location Map (Figure 1) and Durham County Soil Survey Map (Figure 2) for more information on the project setting. 3b. Heavy equipment typical for road construction, utility installation and grading will be used to construct the proposed project such as track hoes, bulldozers, dump trucks, and graders. Comments: Each proposed sanitary sewer crossing was aligned to be perpendicular with the stream channel and buffer, do not exceed 40 linear feet of buffer and have a maintenance corridor of 30 feet; therefore, they meet the criteria for an allowable activity without mitigation in the NRB Riparian Buffer Rules. D. Impact Justification and Mitigation 1. Avoidance and Minimization 1 a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project. The applicant requested a delineation of surface waters and wetlands early in the project planning process to facilitate avoidance and minimization of impacts to surface waters and wetlands. Roadway configuration and lot layout was prepared in accordance with City of Durham standards, and was designed to respect the existing environmental features and topographic constraints and to provide substantial open space areas for preservation of significant trees. Permanent impacts to jurisdictional wetland areas was reduced to a single road crossing of approximately 4,320 SF (0.099 Ac.) along the northern boundary of the site. This location allows for complete preservation of the stream and buffer areas, excepting for temporary impacts necessary for the construction of the required gravity sewer outfall. The sewer outfall was designed for a perpendicular crossing of the buffered stream, in order to reduce the impacts to the greatest extent possible. Road stub to adjacent property has been provided in accordance with City of Durham Unified Development Ordinance Section 12.3.1 (D) (6), which requires a minimum of one roadway stub out for every 1,400 linear feet on any single side of a proposed development in the Suburban Tier. This location has been identified as the least impactful to future offsite wetland and/or stream buffer areas based upon review of aerial photography, topographic maps and field review of the lower stream areas within the project boundary. In addition to the 50' wide Neuse Riparian Stream buffer, the project proposes an additional 50 foot City of Durham upland buffer for protection of the jurisdictional stream areas and their adjacent wetlands. The project also proposes to preserve as open space area an approximately 2.6 acre upland area in the southwest corner of the project site, as well as upland perimeter buffers to adjacent properties. Overall, the project anticipates preservation of in excess of 15.4 acres of open space area (approximately 33% of the overall project site). 1 b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques. A culverted road crossing will be provided to allow for continued connection of the wetland system and historical drainage patterns. This culvert has been sized to provide adequate hydraulic connection for a 25-year storm event in accordance with City of Durham standards, and will be installed at the natural grade of the wetland at the upstream and downstream ends to ensure continued hydrologic connection and passageway for aquatic wildlife.
