T -T ?TT SEP 19 2011 We are writing in response to the concerns raised in your internal memorandum, dated July 22, 2011, of which you have kindly provided a copy. Your memorandum recommends denial of our application for a boat lift adjacent to an existing dock at the subject property pending the submission of clarifying information. We'd like to make clear that the permit request does not contemplate any dredging. Indeed, installation of a boat lift doesn't require dredging. Further, what little fishing we do is of the rod- and-reel variety. We do not use "bottom disturbing fishing gear." We are aware of the lack of water at the site at low tide, and we understand the concerns you may have with respect to the effects of boat traffic on the ecosystem. It is our Intention to utilize any vessel only when there is sufficient water to actually float the vessel and propel it either by hand or by motor without disturbing the substrate. We are willing to stipulate to the following conditions on a boat lift permit: • The maximum standing.draft will be equal to or less than 9" according to the manufacturer's specifications; the draft measurement includes an outboard motor and two adult passengers. • The motor will be a "jet" style (e.g., Mercury Opti Max); that is, there will be no propeller. • The boat lift's dead stop-the lowest point above the substrate-will be 18". Since the average measured depth at high tide Is approximately four feet or 48", adoption of a 18" dead stop will enable us to use the vessel only when there is roughly half the measured depth (the 18" dead stop plus 6" to maneuver the vessel on or off the lift) and only for a 3-4 hour window between the incoming and outgoing tides, Also, an 18" dead stop provides you with the assurance that nothing protruding from the vessel during normal operation can disturb the substrate. Further, the installation of the boat lift will cause far less disturbance to the substrate. than the prior installation of the dock. We believe that these conditions are fair. They provide protection to the Pages Creek ecosystem while affording us some use of our property and the creek for travel and to go fishing once in a while.
