Bridge No. 77 Replacement (TIP No. B-3611) I) This minor modification authorizes an additiona10.02 acres of temporary Coastal Wetland impacts resulting from hand clearing, as depicted on the attached workplan drawing, for a total of 0.36 acres, and a shift in the location of the area of hand clearing. This change is being authorized to revise placement of the hand clearing area shown in original permit drawings, sheets 4 and 5 of l7, dated l/28/l0 and sheets 6 and 7 of 17, dated 11/5/09. 2) All conditions and stipulations of [he active permit remain in force under this minor modification unless specifically altered herein. 3) This minor modification shall be attached to the original of Permit #24-10 and copies of all documents must be readily available on site,when a Division representative inspects the project for compliance. The Division of Coastal Management (DCM) through a Memorandum of Understanding with the Division of Water Quality (DWQ) has reviewed your project proposal, determined that the project as proposed complies with the aforementioned regulations, and made a "no practical alternatives' determination per those regulations: Those activities covered by your Coastal Area Management Act (CAMA) permit have received Buffer authorization as long as the project is constructed in a manner that continues to meet allot the conditions listed below. Failure to comply with this Buffer Authorization shall subject the property owner & the party (contractor) performing the construction &/or land clearing to a civil penalty of up to $25,000 per day per vidlatioh. 1) All stormwater runoff shall 6e directed as shee[Flow through stream buffers atnon-erosive velocities, unless otherwise approved by this certification. 2) All riparian buffers impacted by the placement of temporary fill or clearing activities shall be restored to the preconstruction mntoutsand re-vegetated. Maintained buffers shall be permanently re- vegetated with non-woody species by the end of the growing season following completion of construction. For [he purpose of this condition, maintained buffer areas are defined as areas within [he transportation corridor that will be subject to regular.NCDOT maintenance activities including mowing. The area with non-maintained buffers shall be permanently re-vegetated with native woody species before the next growing season following completion ofconstruction. n 3) Pursuant to NCACISA 2B .0233 & .0259, sediment and erosion control devicesshallnot be plated in Zone 1 of any Neuse orTar-Pamlico Buffer without prior approval by NCDWQ. At this time, NCOWQ has approved no sediment and erosion control devices in Zone 1, outside of the approved project impacts, anywhere on this project. Moreover, sediment and erosion control devices shall be allowed in Zone 2 of the buffers provided that Zone 1 is not compromised and that discharge is released as diffuse flow. 4) Bridge deck drains shall no[ discharge directly into [he stream. stormwater shall be directed across the bridge and pre-treated through site-appropriate means (grassed swales, pre-formed scour holes, vegetated buffers, etc.) before entering the stream. Please refer to the most current version of stormwater Best Management Practices.
