(Catena) has been retained by the North Carolina Granite Corporation (NCGC) to assist in acquiring the necessary environmental permits for their property in Surry County, NC. This letter and associated enclosures constitute the permit application. Background Information: NCGC (previously Thomas Woodruff & Sons) has been mining granite from its location in Mount Airy, North Carolina since 1889. NCGC has utilized water from the Ararat River for its mining and granite processing operations. Aerial photography from as early as 1950, shows the location and shape of the water supply pond that is still in use today. In 1979 and 1980, Mount Airy experienced the largest and second largest flood in its recorded history. These events led the USACE to study, design, and construct a flood control system. The system included a series of levees, dikes, and flood gates along the Ararat River, including a levee with floodgates on the Renfro property, just upstream of the NCGC property. At some point between 1980 and 1987, the Ararat River broke through its banks opposite NCGC's holding pond and created a new channel that diverted the river away from its water intake structures. In an effort to preserve their water supply, NCGC constructed a weir to reroute water to the Ararat River's original channel. This weir was not permitted and on September 17, 1987, NCGC received a Notice of Violation (NOV) from USACE. NCGC coordinated with USACE to remedy the situation and on December 7, 1988, received a permit to install a 350-foot long, 4-foot wide, 2-feet above normal water level granite rock weir (SAWC088-N-086-0292). NCGC received NWP 3 Maintenance permits to perform maintenance on the weir in 1996 and 2001. On January 1, 2011, NCGC received a NOV from USACE for an unpermitted dam. This dam crossed the Ararat River below the existing permitted weir and the existing NCGC holding pond. In addition to being a violation of the Clean Water Act, the dam was causing water to pond against the levee and two floodgates upstream on the Renfro property. NCGC initiated resolution to the NOV by providing a written response to USACE on February 24, 2011. As an initial corrective measure, USACE directed NCGC to take whatever measures were practical to result in a water level of 1015 feet on the most upstream floodgate. To meet this requirement, NCGC removed the dam between April 4 and 15, 2011. Sediment that had accumulated upstream of the dam in the reservoir pool was removed by an excavator working from the banks between April 29, 2011, and May 3, 2011, and transported to an upland area within the quarry property between June 15 and 30, 2011 . On July 5, 2011, USACE indicated that the initial corrective measure was satisfied and that NCGC should proceed with the permit process for a permanent solution. However, an unintended consequence of this action was that the river no longer flowed into the side channel. While a long-term solution to maintaining the water supply from the Ararat River was being developed, there was concern that until such a solution was approved and constructed, a temporary structure would be required to maintain water levels in the holding ponds to provide a sufficient hydraulic head over the intake pumps. To that end, a Nationwide Permit 33 was issued on April 29, 2011. However, due to infrastructure changes and water recycling efforts by NCGC, this permit has not had to be utilized to date. To devise a long-term solution, Baker Engineering was retained by NCGC to develop a plan that used natural stream design techniques to create structures that will (1) provide a water intake for NCGC and (2) create natural stream conditions that will stabilize and restore the stream banks that have been exposed by removal of the reservoir pool. Authorization Requests: The activities for which authorization are being requested fall into two categories: 1) an after-the-fact permit for the dam and expansion of the weir, and subsequent impacts to a side channel of the Ararat River and 2) a permit for the installation of in-stream structures. Dam & Weir. As detailed in the Background Section, though there is visual evidence that a dam has been in the river since at least the 1950's, the exact location appears to have changed at least once and it was never permitted. In addition, the existing weir dimensions are approximated as 185 feet long, 22 feet wide (at its widest), and 6 feet above normal water level, totaling approximately 600 cubic yards, which is larger than that which was originally permitted (350 feet long, 4 feet wide, and 2 feet above normal high water). Since the NOV was issued, the dam has been removed and the river has returned to its normal elevation leaving the entire weir above mean high water. This has impacted the side channel of the Ararat River by essentially limiting its access to water except during periods of extremely high flows. The total length of the side channel considered to be impacted is 540 feet. To mitigate for impacts to this side channel, NCGC is investigating multiple options, including payment to the North Carolina Ecosystem Enhancement Program (NCEEP). NCGC is requesting that these past activities be authorized through issuance of the appropriate permit In-Stream Structures. The attached plans detail the proposed in-stream structures developed by Baker Engineering. The plans call for three structures: a w-weir, a double drop cross vane, and a single wing deflector. The w-weir will aide in routing water towards NCGC's intake structure; while the double drop cross vane and a single wing deflector will be constructed to stabilize and restore natural stream features to the Ararat River. Construction activities will follow the sequence devised by Baker Engineering and shown in the attached plans. All work will be restricted to the area denoted as "Limits of Disturbance" as shown on the attached plans. To minimize impact to the river, work will be conducted from the river bank as much as possible, though construction of the in-stream structures will require access to the channel due to its width. The in-stream structures will be created using as much material from the demolished dam as practical. Following completion of the project, all disturbed flood plain areas and banks will be graded, mulched and seeded and/or planted with native grasses, shrubs and trees (planting plan included with the enclosed engineering plans). NCGC is requesting that these past activities be authorized through issuance of the appropriate permit. Nature of Activity (Description of project, include all features) North Carolina Granite Corporation (NCGC) requires a continuous source of water to maintain facility operations. The initial activity was creation of a dam and weir to funnel water into a holding pond. The dam has since been removed leading to the second activity, installing three natural stream structures that will funnel water into the holding pond while also providing for the restoration and stabilization of the stream banks exposed upon removal of the dam. Fill Material will consist of granite boulders re-purposed from the removed dam. 19. Project Purpose (Describe the reason or purpose of the project, see instructions) The purpose is twofold. First, to obtain after-the-fact authorization for construction of a dam and changes to a permitted weir in the Ararat River that provided water for the daily operation of the NCGC. This dam has subsequently been removed. The weir is permitted and is still in place but has increased in size due to additional construction and sedimentation. The increase in weir size has impacted the entire length (540 ft) of a side channel by essentially restricting flow from the Ararat River except during periods of extremely high flow. The second purpose is to authorize construction of natural stream structures that will provide water for the daily operations of the NCGC and will restore and stabilize the river banks that were exposed upon dam removal.
