Soils are assigned to one of four groups according to the rate of water infiltration when the soils are not protected by vegetation, are thoroughly wet, and receive precipitation from long-duration storms. The soils in the United States are assigned to four groups (A, B, C, and D) and three dual classes (A/D, B/D, and C/D). The groups are defined as follows: Group A. Soils having a high infiltration rate (low runoff potential) when thoroughly wet. These consist mainly of deep, well drained to excessively drained sands or gravelly sands. These soils have a high rate of water transmission. Group B. Soils having a moderate infiltration rate when thoroughly wet. These consist chiefly of moderately deep or deep, moderately well drained or well drained soils that have moderately fine texture to moderately coarse texture. These soils have a moderate rate of water transmission. Group C. Soils having a slow infiltration rate when thoroughly wet. These consist chiefly of soils having a layer that impedes the downward movement of water or soils of moderately fine texture or fine texture. These soils have a slow rate of water transmission. Group D. Soils having a very slow infiltration rate (high runoff potential) when thoroughly wet. These consist chiefly of clays that have a high shrink-swell potential, soils that have a high water table, soils that have a claypan or clay layer at or near the surface, and soils that are shallow over nearly impervious material. These soils have a very slow rate of water transmission. If a soil is assigned to a dual hydrologic group (A/D, B/D, or C/D), the first letter is for drained areas and the second is for undrained areas. Only the soils that in their natural condition are in group D are assigned to dual classes. Rating Options Aggregation Method: Dominant Condition Component Percent Cutoff. Robey, PE Post Office Box 339 Camden, NC 27921 Subject Property: Aviation Research & Development Park - Phase IT Drainage Feature to Pasquotank River, Pasquotank River Basin On-Site Stream Determination - EXPRESS REVIEW PROGRAM Dear Mr. Robey: On September 9, 2011, at your request, I conducted an on-site determination to review drainage features located on the subject property for stream determination. The features are labeled as sites "11-0833A and 11-0833 B" on the attached maps and initialed by me on September 13, 2010. The Division of Water Quality (DWQ) has determined that the features labeled as site "11-0833 A and 11-0833 B" on the attached maps, and highlighted in red is not considered streams. The features are marked on the ground with yellow DWQ flagging and starts at site 11-0833 A (N 36° 15.183' W 76° 09.704') and follows the drainage feature south to the second point (N 36° 14.933' W 76° 09.712') marked on the ground with yellow DWQ flagging. The second feature labeled 11-0833 B starts in the southwest corner of property, next to wood line, (N 36° 14.949' W 76° 09.949') and continues north to a point (N 36° 15.159' W 76°09.945') and marked on the ground with yellow DWQ flagging. The owner (or future owners) should notify the DWQ (and other relevant agencies) of this decision in any future correspondences concerning this property. This on-site determination shall expire five (5) years from the date of this letter. Landowners or affected parties that dispute a determination made by the DWQ or Delegated Local Authority that a surface water exists and that it is subject to the buffer rule may request a determination by the Director. A request for a determination by the Director shall be referred to the Director in writing c/o Karen Higgins, 1650 Mail Service Center Raleigh, NC 27699-1650. Individuals that dispute a determination by the DWQ or Delegated Local Authority that "exempts" a surface water from the buffer rule may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. Applicants are hereby notified that the 60-day statutory appeal time does not start until the affected party (including downstream and adjacent landowners) is notified of this decision.
