Director Division of Water Quality May 1, 2007 DWQ Project # 07-0464 Franklin County CERTIFIED MAIL: RETURN RECEIPT REQUESTED Mr. Richard Wolf Olde Liberty Club, LLC 4208 White Chapel Way Raleigh, NC 27615 Subject Property: Olde Liberty Golf Club Ut to Cedar Creek [030301, 29-28-(1), WSII, HQW, NSW] REQUEST FOR MORE INFORMATION Dear Mr. Wolf: On March 15, 2007, the Division of Water Quality (DWQ) received your application dated March 14, 2007, to impact 0.338 acres of 404/wetland (0.1706 acres of permanent 404/wetland impact, 01674 acres temporary 404/wetland impact), 0.038 acres of isolated wetland, 3461inear feet of stream (148 linear feet of permanent perennial stream impact, 0.0002 acres perennial stream impact due to bridges/driven piles, 1381inear feet of permanent intermittent stream impact, 0.0006 acres intermittent stream impact due to bridges/driven piles, 301inear feet of temporary perennial stream impact and 301inear feet of temporary intermittent stream impact, and 30,627 square feet of Zone 1Tar-Pamlico River basin protected riparian buffers and 17,135 square feet of Zone 2Tar-Pamlico River basin protected riparian buffers to construct the proposed residential subdivision and golf course. On Apri19, 2007, the DWQ received additional information from you, however, the DWQ has determined that your application remains incomplete and/or provided inaccurate information as discussed below. The DWQ will require additional information in order to process your application to impact protected wetlands and/or streams on the subject property. Therefore, unless we receive five copies of the additional information requested below, we will have to move toward denial of your application as required by 15A NCAC 2H .0506 and will place this project on hold as incomplete until we receive this additional information. Please provide the following information so that we may continue to review your project. Additional Information Requested: 1. Please provide percentage imperviousness data on drainage areas 1 through 29 so that DWQ staff can verify that they are below 30 percent. 3. Wet detention basins B, D, E and F are currently discharging just outside of protected riparian areas. This practice is not allowed due to the possibility that the discharge may create an eroded channel through the buffer. At the outlet of these wet detention ponds, please provide either properly designed level spreaders (with plans, calculations and worksheets) or engineered conveyances (pipes or swales) that are designed for the appropriate flows and velocities. Please contact the DWQ within three weeks of the date of this letter to verify that you have received this letter and to provide us with a date that we may expect to receive this requested information. If we do not receive this requested information within one week of the date you indicate it will be forthcoming, your project will be withdrawn and you will need to reapply with a new application and a new fee. Please contact me in writing and Lauren Cobb of the DWQ Raleigh Regional Office. If we do not hear from you within three weeks, we will assume that you no longer want to pursue this project and we will consider the project as withdrawn. This letter only addresses the application review and does not authorize any impacts to wetlands, waters or protected buffers. Please be aware that any impacts requested within your application are not authorized (at this time) by the DWQ.
