Washington Street, Suite 3072 Nashville, NC 27856 Subject Property: Central Nash Water and Sewer District - Water System Improvements - Phase 4 Toisnot Swamp (Silver Lake, Lake Wilson) [27-86-11-(1), NSW; WS-III] Beaverdam Swamp [27-86-11-3, NSW; WS-III] Juniper Creek [27-86-6-2, NSW; C] Tar River [28-(34.5}, NSW; WS-N] REQUEST FOR MORE INFORMATION Dear Mr. Murphy: On August 9, 2011, the Division of Water Quality (DWQ) received your application dated June 2, 2011 and received by DWQ on August 18, 2011 to fill or otherwise impact 100 linear feet of intermittent stream channel (temporary impacts), 20 linear feet of perennial stream impacts (temporary impacts), 630 square feet of Zone 1 Neuse River basin protected riparian buffer (temporary impacts), 400 square feet of Zone 2 Neuse River basin protected riparian buffer (temporary impacts), 720 square feet of Zone 1 Tar River basin protected riparian buffer (temporary impacts), 410 square feet of Zone 2 Tar River basin protected riparian buffer (temporary impacts) to install a new water system including an elevated water storage tank and booster pump station that will replace existing service through traditional wells. The DWQ has determined that your application was incomplete and/or provided inaccurate information as discussed below. The DWQ will require additional information in order to process your application to impact protected streams and buffers on the subject properties. This project is on hold and incomplete until we receive the additional information requested below. If we do not receive the requested information, your project will be formally returned as incomplete. Please provide the following information so that we may continue to review your project. Additional Information Requested: This office is requesting that you secure a riparian buffer determination letter. This is necessary in order to complete an appropriate review of your application. (In addition, the Division of Land Resources will likely require this as a requisite component of your erosion and sedimentation control plan application.) A review of your application showed you failed to depict all riparian buffers, streams subject to the buffer rules, maintenance corridors, construction corridors, or the existing transportation facility (toe-of-slope of roadway). Thereby we are unable to understand where the impacts will occur or how you will ensure impacts do not exceed what you have proposed. You will need to clearly show this information on the sets of plans. Accordingly, securing the riparian buffer determination will provide you necessary information such that you may develop and provide additional information (plans and details). You will need to modify the plans to clearly depict the respective footprint of the buffer, construction corridor and maintenance corridor. 2. The Total Stream Impacts on page 5 of 12 of the PCN should read "120." 3. Spiral bound plans should include a complete set of plans (sheets missing). 4. Contract 1 Water Lines Sheet 14 of 14: Detail 9/14. The notes are incomplete. 5. Include all temporary impacts for directional drill set up that may impact the buffer (e.g., de-watering). 6. Several crossings (4Q, 11 K-1, 11 K-2, 11 H-1, 11 H-2, 11-D 1, 11 D, 11 C, 11-A 1) identify Condition 2 Pipe Line Under Culvert but there is no mention of directional drilling on the plans for these locations. If a culvert is to be removed to place the water line under the culvert, a pump around set up is needed. Please clarify how the water line will be installed at these locations. Additionally, several other crossings were identified in the plans but not labeled as jurisdictional features; however, several of these features are shown on the Soil Survey or USGS Topo Map. Is there a JD for this project? 7. Please provide detail for the Crossing 11 L Open Cut. A pump around set up may be necessary. 8. At Crossing 4M, 9J and 11-H2, will there be any temporary wetland impacts due to the drilling activity? At Crossing 4P, the review showed numerous constraints at this location. Will there be any temporary buffer or wetland impacts due to the drilling activity? 9. The plans show new easement areas in several locations (4F, 90, 9G, 11 G). Show as a new buffer impact in the PCN application. Resubmit the buffer impact table. 10. At Crossing 11-H1, label buffers. Please submit five copies of this information within 30 calendar days of the date of this letter. If we do not receive this requested information within 30 calendar days of the date of this letter, your project will be withdrawn and you will need to reapply with a new application and a new fee. If you need additional time to compile the information requested above, please email Natalie Landry (natal le. landry@ncdenr.gov) requesting an extension and indicate a new date for submittal.
