Sullins Dee Freeman Governor Director Secretary September 7, 2011 DWQ# 11-0755 Rockingham County CERTIFIED MAIL: 7010 2780 0001 4221 6245 RETURN RECEIPT REQUESTED Leo Furlong, III Duke Energy Carolinas, LLC PO Box 1007 Charlotte, NC 28201 Re: Section 401 Water Quality Certification application Dear Mr. Furlong: On August 15, 2011, the North Carolina Division of Water Quality (Division) received a copy of your application for a 401 General Water Quality Certification to impact a stream for the Moss Street Entrance for the Reidsville Op Center in Reidsville, NC in Rockingham County. Additional information is required in order that we may determine your project's compliance with 15A NCAC 2H.0500. The Division will require this information in order to process your application to impact protected wetlands and/or streams on the subject property. Therefore, we will place this project on hold as incomplete until we receive this additional information, and if we do not receive the additional information requested below, we will have to move toward denial of your application as required by 15A NCAC 2H.0506. Please provide the following information so that we may continue to review your project. 1. Per the instructions for the Pre-Construction Notification (PCN) form, Item C3g, "The stream impact length should be measured along the centerline of the stream. When proposing a culvert, the impact length is generally greater than the length of the culvert and associated dissipater since the existing stream usually has some sinuosity (curvature)." It appears that the impacts listed are the length of pipe and the length of riprap dissipater, not the actual stream length, please verify this information and modify the PCN form as necessary. 2. Per the requirements of GC 3820, please enumerate all temporary impacts to the stream channels. Temporary impacts also include areas of disturbance necessarv for proper dewaterinlz measures and anv temporarv erosion control measures expected to be installed within any jurisdictional areas. Please note that temporary impacts should be minimized to the maximum extent practical. All temporary impacts must be shown on the construction drawings and clearly indicated in the PCN impact table. Please submit all revised documents showing all temporary impacts. 3. The detailed cross section and profile of the proposed culvert indicates that the bottom of the culvert will be at the same elevation as they stream bed. Per Condition #14 in GC 3820 "all culverts must be placed below the elevation of the stream bed by one foot for all culverts with a diameter greater than 48 inches and 20 percent of the culvert diameter for culverts having a diameter less than 48 inches." Please revise your plans to meet this Condition. If you will not be able to provide the requested information within that timeframe, please provide written confirmation that you intend to provide the requested information, and include a specific timetable delineating when the requested materials will be provided. If we do not hear from you in 30 calendar days, we will assume that you no longer want to pursue this project and we will consider the project as returned. This letter only addresses the application review and does not authorize any impacts to wetlands, waters or protected buffers. Please be aware that any impacts requested within your application are not authorized (at this time) by the Division.
