Sullins Director September 6, 2011 CERTIFIED MAIL: 70110110 0000 3789 0118 RETURN RECEIPT REQUESTED Friends of Spooners Creek Attn: Ed Robbins, Vice President 408 Sand Fiddler Court Morehead City, NC 28557 Natural Resources Dee Freeman Secretary SUBJECT: Spooners Creek Maintenance, Morehead City Project # 2005 1906 V3 Carteret County Dear Mr. Robbins: This Office has reviewed your CAMA application dated August 09, 2011 for the maintenance dredging of the existing entrance channel for Spooners Creek Harbor and the construction of a 300 foot groin. The Division of Water Quality (DWQ) has determined that your application was incomplete as discussed below. The DWQ will require additional information in order to process your application to impact protected wetlands/waters and/or streams on the subject property. Therefore, unless we receive the additional information requested below, we will have to move toward denial of your application as required by 15A NCAC 2H.0506 and will place this project on hold as incomplete until we receive this additional information. Please provide all of the following information so that we may continue to review your project. 1) Concerns have been raised by the Division of Marine Fisheries (DMF) of potential impacts to submerged aquatic vegetation (SAVs) within the footprint of the groin structure. DMF is requesting a SAV survey. The DWQ is also concerned about the impacts to SAVs and requests an SAV survey to see how impacts to SAVs can be avoided. Please revise the drawings after the SAV survey has been conducted to show how impacts have been avoided and include the breaks in the groin structure as requested by DMF. The DWQ is only concerned about the groin structure and the potential impacts to SAVs, as long as the dredging occurs within the existing previously permitted dredging footprint the DWQ will have no concerns with the dredging aspect of the project. Please respond within three weeks of the date of this letter by sending this information to me in writing and two copies to Ian McMillan c/o 401 Wetlands and Stormwater Branch, 1650 Mail Service Center, Raleigh, NC 27699-1650. Please reference the DWQ Project # of 2005 1906 V3 in all future correspondence. If we do not hear from you within three weeks, we will assume that you no longer want to pursue this project and we will consider the project as withdrawn.
