Sullins Director September 6, 2011 CERTIFIED MAIL: 70110110 0000 3789 0125 RETURN RECEIPT REQUESTED Phillip Golden 381 Gillikin Road Beaufort, NC 28516 SUBJECT: Golden Landing, Smyrna Project # 2011 0748 Carteret County Dear Mr. Golden: Dee Freeman Secretary This Office has reviewed your CAMA application dated August 9, 2011 for the construction of 10 slip docking facility, boat ramp and storage shed. The Division of Water Quality (DWQ) has determined that your application was incomplete as discussed below. The DWQ will require additional information in order to process your application to impact protected wetlands/waters and/or streams on the subject property. Therefore, unless we receive the additional information requested below, we will have to move toward denial of your application as required by 15A NCAC 21-1.0506 and will place this project on hold as incomplete until we receive this additional information. Please provide all of the following information so that we may continue to review your project. 1) Concerns have been raised by Shellfish Sanitation about the potential of closures of shellfishing waters due to more boats mooring at the docks than permitted slips. The additional closure of shellfishing waters is a violation of the DWQ rules: 15A NCAC 02B .0221(1) and 15A NCAC 02B .201(b). Because of this potential closing concern, please revise the drawings to show how boats will be prevented from docking at this facility in areas not permitted as slips. Please respond within three weeks of the date of this letter by sending this information to me in writing and two copies to Ian McMillan c/o 401 Wetlands and Stormwater Branch, 1650 Mail Service Center, Raleigh, NC 27699-1650. Please reference the DWQ Project # of 2011 0748 in all future correspondence. If we do not hear from you within three weeks, we will assume that you no longer want to pursue this project and we will consider the project as withdrawn.
