Sullins Dee Freeman Governor Director Secretary September 7, 2011 CERTIFIED MAIL: RETURN RECEIPT REQUESTED Mr. Mark Landseidel Duke Energy Carolinas, LLC 526 South Church Street Charlotte, NC 28201 Subject Property: Dan River Combined Cycle Project MODIFIED STORMWATER MANAGEMENT PLAN APPROVAL Dear Mr. Landseidel: DWQ Project # 09-0940 Rockingham County On December 3, 2009, the Division of Water Quality (DWQ) issued a 401 Water Quality Certification to impact 0.133 acre of jurisdictional wetlands for the purpose of constructing the above named project. Condition 6 of the 401 Certification requires that the stormwater management facilities approved by the DWQ on December 3, 2009 be constructed and operational before any building is occupied at the site. On June 5, 2011, the DWQ received a request for a revision to the Stormwater Management Plan (dated June 29, 2011). The purpose of the revision was to replace the originally proposed bioretention area with a wet detention pond to better suit the groundwater conditions on the site. On August 26, 2011, the DWQ received an update to the Stormwater Management Plan (dated August 22, 2011). The proposed revised and updated stormwater management plan for the Dan River Combined Cycle Project has been reviewed and satisfies the stormwater management condition of the 401 Water Quality Certification. You are required to meet the following conditions: The stormwater management system (consisting of two wet detention ponds and all associated appurtenances), all stormwater conveyances and the grading and drainage patterns depicted on the plans, as approved by this office must be maintained in perpetuity. No changes to the structural stormwater practices shall be made without written authorization from the DWQ. The stormwater management structures shall have maintenance access to allow for the ability to maintain the structures, and to perform corrective actions. The stormwater easements shall be recorded to provide protection of the structures from potential alterations by future property owners. 2. All operation and maintenance activities shall be followed as stipulated in the Operation and Maintenance Agreement for Wet Detention Pond #I signed by Mr. Stephen A. You or your authorized agent shall provide a completed Certification of Completion Form to the DWQ 401 Program within ten (10) days of the project completion (available at: http://portal.ncdenr.org/web/wq/swp/ws/40 I /certsandperm its/apply/forms).
