Sullins Governor Director Dee Freeman Secretary July 18, 2011 Mr. Darin Waller Resident Engineer, Division 9, North Carolina Department of Transportation 4770 South Main Street Salisbury, NC 28147 Subject: I-85 Yadkin River Bridge Project I-2304AC Davidson/Rowan Counties DWQ No: 20040275 Dear Mr. Waller: On July 5, 1011, Amy Euliss, Division of Water Quality (Division) regional staff conducted a site visit on the I-85 Yadkin River Bridge Project in Davidson and Rowan Counties to document sediment loss that occurred following a 3" rain event on June 28, 2011. The site visit was in conjunction with yourself, Mrs. Stephanie Braquet, Division Environmental Specialist, NCDOT Division 9, Phil Suggs, Roadside Environmental, and other NCDOT and contractor staff. During the site visit, Ms. Euliss documented that a sediment loss had occurred as a result of a failed berm at permit site 3, and an overtopped basin at permit site 4. At permit site 3, a 500 linear feet ofjurisdictional stream was filled with sediment and 1.03 acres of jurisdictional wetland was filled with sediment. At permit site 4, 150 linear feet ofjurisdictional stream was filled with sediment. The fill of a jurisdictional wetland without authorization is a violation of Title 15A NCAC 2B .0231(a) and (b) (1) and (5). The loss of sediment of a jurisdictional stream is a violation of Title 15A NCAC 02B .0211 (3)f. Upon discovery, NCDOT quickly contacted the Division to report the sediment. At the Division's direction, sediment was removed in the jurisdictional stream at permit site 4 prior to the site visit on July 5, 2011. During the site visit, the Division directed that majority of the wetland shall have sediment removed by hand. Areas with a skim of sediment can be left, as is. The jurisdictional stream where it flows through the wetland shall also have sediment removed if sediment deposits are greater than one inch. Ms. Euliss will be on-site in the next week to document that clean up measures have been completed as directed. NCDOT and Flat Iron-Lane Joint Ventures are at this time in compliance with their NPDES permit. NPDES inspection records are up to date and thorough, and the Division was notified within 24 hours of the loss (not counting Sunday). The Division would like to commend both NCDOT Division 9 and Flat Iron-Lane Joint Ventures for their prompt response to this matter. The Division appreciates the time NCDOT staff spent discussing the site, and the immediate response taken by NCDOT and the contractor.
