9. PROJECT DESCRIPTION:
The project site is located off Kings Landing Road, adjacent to the AIWW, in Hampstead, Pender County. To get to the
site from Wilmington, take NC Highway 17 north toward Jacksonville. Turn right onto Country Club Road
(approximately 8.5 miles from Porter's Neck) and travel east approximately 0.7 miles before turning right onto Olde Point
Road. Continue traveling along Olde Point Road and turn left at the intersection of Olde Point Road and Kings Landing
Road. The project site will be located on the eastern side of the road, roughly 0.20 miles from the intersection of Olde
Point Road and Kings Landing Road.
The applicant (Kings Landing Creek Homeowners) is comprised of seven (7) individual property owners who share, or
have interest in the access channel in question. The canal/channel is located on the west side of the Atlantic Intracoastal
Waterway (AIWW) between Navigation Markers 96 and 98. The residential tracts are developed and most have individual
docking facilities. Combined, the tracts total more than 3 acres with roughly 350 linear feet of shoreline, all of which are
bulkheaded. Vegetation on the high ground areas include; Live Oak (Quercus vir iniana), Sweet Bay (Ma olia
vir ing_ iana), Sweet Gum (Liquidambar stryciflua), Loblolly Pine (Pinus taeda), and Red Cedar (Juniperus virginiana).
Under-story/scrub vegetation consist of Yaupon (Ilex vomitoria), Wax Myrtle (M erica cerifera), Japanese Honeysuckle
(Lonicera japonica), Grounsel-bush (Baccharus halimifolia), Marsh-elder (Iva frutescens), Sea Oxeye (Borrichia
frutescens) and other ornamental plants. The shoreline consist of high marsh species including; Black Needle Rush
(Juncus roemarianus), Sea Lavender (Limonium, spp.), Glasswort (Salicornia spp), Spike Grass (Distichlis s ip cata),
Bulrush (Scirpus spp.) and Salt Meadow Crass (Spartina patens), and it transitions to the regularly flooded Smooth
Cordgrass marsh (Spartina alterniflora) along the Normal High Water (NHW) contour.
The disposal site for this project is a residential lot located at 1223 Kings Landing Road. There are several structures
located on the property (approximately 14,000 sq. ft.) including a pump house, asphalt driveway and boat ramp. The site
has a relatively high elevation along the western side (bordering Kings Landing Road) sloping down in an easterly
direction towards the existing bulkhead. The site is vegetated with a few mature live oaks and ground cover consist of St.
Augustine intermixed with Pennywort and other coastal species. The disposal site does not appear to exhibit any wetland
characteristics above the existing bulkhead.
Based on DCM records, the channel/canal has been routinely maintained since the 1990's, with the most recent 'event
occurring in 2000. Current water depths in the access canal range from approximately -1.0' to -2.5', relative to Normal
Low Water (NLW), and water depths in the entrance channel range from -2.0' to -8.0' NLW.
It should be noted that the shallow bottom area within the entrance channel and access canal contains a fair amount of
Submerged Aquatic Vegetation (SAV). Based on the applicant's permit application, a SAV survey was conducted in the
area on August 2, 2011, by Chad Chimes (applicant's agent), concluding that approximately 30% of the shallow bottom
area within the proposed dredge limits contained patchy areas of SAV with no densely populated areas. The agent also
deduced that existing soil composition, coupled with water depths in the -2.0 to -3.0' range at NLW, make it an
inhospitable habitat for continued survival of SAV.
The NC Division of Water Quality has classified the waters surrounding this particular portion of the AIWW/Topsail
Sound as SA. The NC Division of Marine Fisheries has NOT designated this area of Topsail Sound as Primary Nursery
Area (PNA); however, the waters adjacent to the proposed project are OPEN to the harvesting of shell fishing.
PROPOSED PROJECT:
The applicant proposes to perform maintenance excavation (bucket to barge) within an existing entrance channel and
access canal. According to the application package, approximately 800 cubic yards (cy) of material would be removed
from the previously permitted area. The dimensions/extent of the dredge limits would measure approximately 475' (L) x
20' (W) to a depth of approximately -4.0', measured at NLW. In order to eliminate impacts to SAV, the dimensions of the
proposed project have been reduced from a 60' wide cut (originally permitted), to a 20' wide cut, while the overall length
of the project would remain unchanged. Additionally, the applicant states that a minimum separation of 5' would be

maintained between the dredge limits and the adjacent coastal wetlands. The applicant proposes to begin dredging at the
terminal end of the access channel where water depths average 0.0' to -1.0' at NLW. From there, the dredging operation
would move south and east toward the entrance channel (where most of the SAV is located) and then out toward the
waterway. A barge supported long-arm excavator would be utilized to remove the material from the channel. The material
would be placed on a barge and transported to the disposal site, where it would be off-loaded and staged on high ground.
Fortunately, the contractor would be able to use the existing boat ramp at the disposal site for off loading, eliminating any
concerns of potential fill in wetlands. All spoil material would be located a minimum of 50' from the edge of the bulkhead
and would be contained on-site by silt-fencing. The applicant proposes to dedicate the entire lot (14,000) sq. ft. for spoil
deposition.
10. ANTICIPATED IMPACTS
The proposed maintenance dredging would disturb approximately 9,500 sq. ft. of previously excavated shallow bottom
area. Additionally, the project would include the removal of approximately 300 sq. ft. of SAV from the area within the
entrance channel. Minor increases in turbidity should be expected during the dredging event; however no long term
adverse impacts are anticipated. Spoil disposal would disturb approximately 11,000 sq. ft. (0.25 acres) of high ground at
the proposed disposal site. Sedimentation and erosion control structures would be installed to prevent transport of
material off the property. As proposed, it appears that the dredging and disposal activities would not impact coastal
wetlands or PNAs.

Kings Landing Creek Homeowners are requesting to construct the following:
1. Maintenance dredge the existing canal to tie into existing channel ICW at
4.0 NLW
The dredging is approximately 475 `feet long and will be 20 feet wide. The existing
canal is approximately 40-70' wide. The canal has some mainland stabilization but the
majority does not have any shoreline stabilization and is eroding over time. The dredging
quantities are approximately 800 CY.
This canal has been routinely maintained since the 1990's. The last Permit that was
issued was on April 20, 2000 for maintenance dredging. This canal serves 7 residential
lot owners who are boating enthusiasts. Current depths at NLW range from 1.0 NLW to
2.5 NLW. This proposed dredging depth of 4.0 NLW is consistent with prior Permits.
Dredging will be performed to ensure proper flushing.
DISPOSAL SITE
Kings Landing Homeowners have an agreement with a property owner (Ms. Linda
Sellers, 1223 Kings Landing Road) located approximately 0.5 mile to the North to place
the spoil material. This property has a boat ramp and Coastal Dredging will be able to
unload the barge from this boat ramp. An excavator with a long reach will be located so
that it will remove the spoil material from the barge and place it on the residential lot
without disturbing any wetlands. The area for the spoil to be placed is 150'x50' (7,500
square feet). The material will have a 30' buffer to the nearest normal high water line.
Once the material is placed, within 30 days, it will be graded and seeded. Silt fence will
be placed prior to the material being placed on the property. Once the seed is established,
the silt fence will be removed.
ENVIRONMENTAL IMPACTS
A. SAV's

In the last couple of years, SAV's have begun appearing in the section of canal
that leads to the ICW. The original canal width was dredged at 60'. Under this
proposed Major Permit, we are requesting to reduce this dredging width to 20'
feet. This will minimize the impacts to the SAV's while preserving enough
necessary width to the owners in this canal.

On August 02, 2011, a SAV survey was conducted by Darian Chad Kimes, PE,
Engineering Services. SAV's were present in the proposed area of dredging only
in the 50' section nearest the ICW. The SAV's declined quickly once the canal
was entered (coastal wetlands on both sides of canal entrance). Several areas were
raked in the first 100' of the canal. From this survey, SAV's were scattered
throughout the area without having many dense populations. It is estimated from
this survey that the distribution of the SAV's was approximately 30%. The
bottom consisted of about 3"-4" inches of soft loam before becoming a sandy
consistency. The center of the existing canal tends to have less SAV's, however, it
was very difficult to determine due to non-uniformity of the SAV's. Therefore,
we are proposing to dredge in the center of the channel.
From these findings. I am anticipating impacts to be 30% of a 1000 square foot
(50' x 20') area. Therefore, 300 square feet of SAVs will be impacted. It is also
noted, this area of SAV's is located in an area with water depths on average of 2.0
NLW to 3.0 NLW. Based on these depths and the existing soil composition, it
will be very difficult for SAV's to survive in the future. It is unknown if recent
low tides in the last two years have contributed to these SAV's.
B. Shellfish

I do not anticipate any impacts to shellfish. "AU 201A

I do not anticipate any impacts to wetlands. All dredging will be a minimum of 5'
from any wetlands.

Kings Landing Creek Homeowners has contacted Coastal Dredging to perform this work.
ADJACENT OWNER COMMENT
No objections seen at this time. All adjacent property owners have signed a statement in
favor of the proposal.

Carolina, will be representing Kings Landing Creek Homeowners during the Permit
process, and will personally oversee all of this proposed work if requested to by the

The purpose of this project is to re-dredge the existing canal, so there will be 3.5' to 4' of water at NWL. The use of this
facility is for boating. Daily operations will be boating. The channel will have a grade so that proper flushing will occur.
