RECLASSIFICATION OF SURFACE WATERS
IN NORTH CAROLINA
How to Request a Reclassification
Any person may request the reclassification of North Carolina's surface waters. The
enclosed application entitled "Application to Request Reclassification for NC Surface
Water" may be used for this purpose. In addition, a request to reclassify a surface water
of the State as an ORW (Outstanding Resource Water) must follow the petition process
as described in- 15A NCAC 2B .0225(d). Local governments which are requesting a
water supply reclassification should also have dialogue with all local governments having
land use jurisdiction within the boundaries of a proposed water supply watershed; . if the
request is for a more protective water supply classification, a written resolution from all
affected local governments is required by 15A NCAC 2B .0104. -Once the completed
petition/application is received, the Division of Water Quality may be required to conduct
studies to determine whether or not the waters meet the criteria associated with the
requested classification. For more details on the reclassification process, see the attached
flowchart entitled "Reclassification Process
Process for Reclassification
If the waters meet the criteria for reclassification outlined in the North Carolina
Administrative Code (15A NCAC 2B .0100 and .0200), permission is sought from the
North Carolina Environmental Management Commission (EMC) to proceed with the
reclassification request through "rule-making"; rule-making is the required legal process
to make official amendment to a waterbody classification. The rule-making process can
typically be, at a minimum, a two year process. Public comments are considered as part
of this process, and verbal comments are heard at public hearings. A written record of .
the rule-making process including all comments received is. prepared, and a
recommendation regarding the reclassification is presented to the EMC.
Final Adoption of a Reclassification
If the EMC adopts a rule, the rule is then submitted to the Rules Review Commission
(RRC), a ten member panel appointed by elected officials. If the rule is approved by the
RRC, the reclassification then goes to the next legislative session. If no bill is introduced
by the General Assembly that disapproves the reclassification, or if such an introduced
bill is defeated, then the reclassification will become effective pending EPA approval of
the change.

The Town of Siler City, Chatham County, North Carolina is proposing to expand
the Rocky River Lower Reservoir in order to increase its water supply.. The
surface waters associated with the existing Rocky River Lower Reservoir are
currently classified as WS-III BW and WS-111 CA waters. As a result of the
proposed reservoir expansion project, additional areas adjacent to the existing
Lower Reservoir will be impounded and will require reclassification. In addition,
the critical areas and the balance of the watershed associated with the proposed
reservoir expansion will require recalculation.
Currently, the majority of land adjacent to the Rocky River Lower Reservoir is
within Chatham County's planning jurisdiction and only a small portion of the
adjacent land is within the Town of Siler City's jurisdiction. The Chatham County
Watershed Protection Ordinance is applicable in all of the county area (outside
towns' jurisdictions) and in many aspects is more stringent than the state's
minimum requirements. In general the stream buffers are greater and the
densities allowed are lower. This letter is to notify the North Carolina Department
of Environment and Natural Resources, Division of Water Quality that Chatham
County supports the request for reclassification of the surface waters associated
with the proposed Rocky River Lower Reservoir expansion project. The county is
willing to work with the town and state to provide the town and county citizens a
more reliable water supply.

NORTH CAROLINA SURFACE WATER
6. REASON FOR REQUEST
The Town of Siler City (Town) proposes to expand the Rocky River Lower
Reservoir by constructing a new dam structure immediately below the existing Rocky
River Lower Reservoir dam. The proposed dam and expansion of the Rocky River
Lower Reservoir are located entirely in western Chatham County northeast of the Town
of Siler City, North Carolina (Figure 1). The project would result in'the establishment of
a 162.5-acre reservoir (including 24.1 acres of existing reservoir) and the preservation of
a 117.3-acre buffer zone consisting of a strip approximately 100 feet wide around the
proposed reservoir (Figure 2).
The Town's purpose and need is to develop a safe and dependable water supply to
provide an additional 2.0 million gallons per day (MGD) to meet its projected long-term
needs past the current 20-year planning window through at least 2030. The assurance of
an adequate water supply is essential to serve the existing population and industries and
for continued economic growth.
The watershed above the existing Rocky River Lower Reservoir consists of
agricultural land, forest and rural development. Lacys Creek and Mud Lick Creek drain
into the Rocky River within the project area. Several unnamed intermittent drainages
located on the east and west side slopes provide direct discharge of surface runoff.
Several of these drainages have ponds in their upper reaches. All named and unnamed
discharges to a point 0.3 miles downstream of Lacys Creek are classified as WS-III-CA
waters (NC DENR 1999). All waters from the headwaters of the Rocky River to a point
0.3 mile downstream of Lacy Creek are classified as WS-III waters (NC DENR 1999).
As a result of the proposed Rocky River Lower Reservoir expansion, approximately
138.4 acres of additional land adjacent to the existing reservoir will be impounded and/or
inundated and will require reclassification. In addition, the existing critical areas and the
balance of the watershed associated with the proposed Rocky River Lower Reservoir
expansion will require recalculation (Figure 3).

Currently, the Upper and Lower Reservoirs on the Rocky River in northwest
Chatham County serve as the primary raw water source for the Town. The Upper
Reservoir Dam is located approximately 9,000 feet upstream of the North Carolina State
Road (SR) 1312 bridge (Figure 4). The existing Rocky River Lower Reservoir Dam is
located approximately 7,500 feet downstream of the same bridge. The existing intake
pump house for the Town's water treatment plant (WTP) is located immediately
upstream of the Lower Reservoir Dam (Figure 5). The existing reservoir system can
provide a maximum of 4.0 MGD of raw water for treatment. Currently, the capacity of
the Town's WTP is rated at 4.0 MGD. The plant currently treats approximately 2.75
MGD on average; however, during peak periods demand has reached 3.5 MGD
(approximately 88 percent of the plant's capacity).
The majority of land adjacent to the existing Rocky River Lower Reservoir is
within Chatham County's planning and zoning jurisdiction and only a small portion of
the adjacent land is within the Town of Siler City's jurisdiction. However, the Town is
currently in discussion with Chatham County regarding the expansion of the Town's
extraterritorial jurisdiction (ETJ) (Figure 3). This expansion would give the Town
control of both sides of the Rocky River for a distance totaling approximately 18.26 miles
both upstream and downstream of the reservoir, which would allow the Town to better
protect natural vegetative buffers and wildlife habitats along the Rocky River corridor.
Expansion of the ETJ would allow the Town to utilize and expand existing ordinances,
such as the Town of Siler City Watershed Protection Ordinance and Unified
Development Ordinances, to manage and direct growth within the Town and its ETJ in
order to protect resources.
A roller compacted concrete dam would be constructed approximately 105 feet
downstream the existing Lower Reservoir dam. A single release outlet structure capable
of releasing a range of flows equivalent to the minimum release requirements will be
utilized. The drainage area above the proposed dam site, including the Upper Reservoir.
drainage area, is approximately 53.8 square miles (sq. mi.). In order to increase the draft
rate of the Lower Reservoir to 6.0 MGD (an increase of 2.0 MGD), the normal water
level would need to be raised 12.3 feet above the spillway crest of the existing dam. The

elevation of the impounded pool would be 540.3 feet above MSL and would impound
approximately 1,102 acre-feet of water.
The expanded Lower Reservoir would continue to be used in conjunction with the
Upper Reservoir. The Lower Reservoir would remain the terminal reservoir from which
raw water is pumped to the Siler City WTP. Currently, the WTP raw water intake and
pumps are located immediately above the existing Lower Reservoir dam. The existing
WTP raw water intake and pumps would be demolished and upgraded to meet the
proposed increased pool level and draft rate. New intake structures would be located
immediately above the proposed Lower Reservoir dam and designed and constructed as
an integral part of the new dam structure. No changes in treatment requirements are
anticipated for the proposed Lower Reservoir Expansion.
Thirteen landowners would be affected by the proposed reservoir and the
inundation of 85.3 acres of forestland, 38.5 acres of pasture and 10.7 acres of cropland.
All landowners affected by the proposed project have been notified of the proposed
project. Each landowner has been contacted by periodic mailings updating and informing
them of the project status.
A Draft Environmental Assessment (EA) has been prepared in accordance with
the North Carolina Environmental Policy Act (NCEPA), N.C. General Statute Section
113A-1. et seq., N.C. General Statute 143-215.1 (b)(2) and other applicable laws, for the
purpose of evaluating the environmental consequences of the expansion of Siler City's
Lower Reservoir on the Rocky River, Chatham County, North Carolina. The EA will be
submitted for a second North Carolina Department of Environment and Natural
Resources (NCDENR) internal review on or before 30 September 2002. A Finding of No
Significant Impact (FONSI) is expected.
A NCDENR Department of Public Water Supply (PWS) intake permit application
was submitted in spring 2002. PWS has reviewed and commented on the proposed
intake plans. Issuance of the intake permit is pending approval of the EA and a FONSI.
A Dam Safety permit was submitted on 03 May 2002. Approval to construct is
expected by the end of 2002.

PUBLIC HEARING SET FOR NOVEMBER
The N.C. Department of Environment and Natural
Resources on behalf of the Environmental Management
Commission (EMC) will conduct a public hearing in
order to receive public comments on the proposed
reclassification of two segments of the Rocky River in
Chatham County (Cape Fear River Basin) to the Class
Water Supply - III Critical Area (WS-III CA)
classification. In addition, the hearing is being held in
order to receive public comments on the proposed 401
water quality certification ("certification') required for
this water supply project.

GENERAL DEFINITION OF PROPOSED RECLASSIFICATION
A WS-III water is protected as a water supply for drinking, culinary, or food processing purposes and for those users where
a more protective WS-I or WS-II classification is not feasible. WS-III waters are generally located in low to moderately
developed watersheds. A CA is an area in close proximity to a water intake or reservoir, and the remainder of the area
affected by the WS-III designation consists of the rest of the watershed draining to the intake or reservoir.
BACKGROUND OF RECLASSIFICATION REQUEST
A request for reclassification of Rocky River was submitted by Dr. J.H. Carter III and Associates and the Town of Siler
City. The reason for the proposed reclassification is to allow a new dam structure to be placed below the existing dam. The
existing dam does not impound enough water to result in a true reservoir according to DWQ and DEH staff. However, the
new dam will cause the nature of this water supply source to change from run-of-river to an approximately 160-acre
reservoir. The new dam will raise the normal water level above the spillway of the existing dam, and as a result,
approximately 140 acres of land will be impounded in the new CA. The Town wishes to have the new dam constructed and
the resulting reservoir created in order to meet water demands through 2030.
WATERS TO BE AFFECTED BY PROPOSED RECLASSIFICATION
The proposed CA would extend along the current river from the proposed dam, which is to be placed approximately 65
feet downstream of the existing dam, to a point approximately 3.6 miles upstream of the proposed dam. This proposed
reclassification also includes several tributaries to the above-mentioned main stem portion of Rocky River; portions of
these tributaries, which are presently classified WS-III, are proposed to be reclassified to WS-III CA. The new WS-III CA
will be the area measured 0.5 miles from the proposed reservoir normal pool elevation of approximately 540 feet. The
proposed CA, which is approximately 2,207 acres, includes all of the current CA, which is approximately 168 acres. The
remainder of the balance of the watershed that will not be reclassified to WS-III CA will remain intact. Nearly 4.3 miles of
named surface waters are proposed to be reclassified.
PROPOSED RECLASSIFICATION REGULATIONS
If reclassified, development and discharge restrictions will apply. However, there are no current or planned dischargers and
no planned development in the entire proposed reclassification area. Chatham County and the Town of Siler City, the only
local governments with jurisdiction in the reclassification area, would need to modify their water supply watershed
protection ordinances within 270 days after the reclassification effective date, and have already taken steps to do so.
Chatham County has provided written support for this proposed reclassification.
HOW TO SUBMIT COMMENTS
The purpose of this announcement is to encourage those interested in the proposed reclassification and certification to
provide comments. You may attend the public hearing and make relevant verbal comments, and/or submit written
comments, data or other relevant information by December 1, 2003. The Hearing Officer may limit the length of time that

The EMC is very interested in all comments pertaining to the proposed reclassification and certification. All persons
interested and potentially affected by the proposals are strongly encouraged to read this entire announcement and make
comments. The EMC may not adopt a rule regarding the reclassification that differs substantially from the text of the
proposed rule published in the North Carolina Re gister unless the EMC publishes the text of the proposed different rule
and accepts comments on the new text (see General Statute 150B 21.2 (g)). The estimated proposed effective date for the
final rule regarding the reclassification and pursuant to this hearing process is April 1, 2004 provided no review by the
