The Division of Water Quality (DWQ) determinations for the features are presented in Table 1. Landowners or affected parties that dispute a determination made by the DWQ or Delegated Local Authority that a surface water exists and that it is subject to the mitigation rules may request a determination by the Director. A request for a determination by the Director shall be referred to the Director in writing c/o John Dorney, DWQ Wetlands/401 Unit, 1650 Mail Service Center, Raleigh, NC 27699-1650. Individuals that dispute a determination by the DWQ or Delegated Local Authority that "exempts" a surface water from the mitigation rules may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. Applicants are hereby notified that the 60-day statutory appeal time does not start until the affected party (including downstream and adjacent landowners) is notified of this decision. DWQ recommends that the applicant conduct this notification in order to be certain that third party appeals are made in a timely manner. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center. Raleigh, N.C. 27699-6714. This determination is final and binding unless you ask for a hearing within 60 days. This letter only addresses the applicability to the Clean Water Act and the Neuse and Tar-Pamlico Buffer Rule requirements and does not approve any activity within Waters of the United States or Waters of the State. This stream was verified as intermittent and will require buffer mitigation. January 26, 2005 • Stream 27- DWQ verified this is as an ephemeral stream and no buffers required • Stream 29-DWQ verified this is as an ephemeral stream and no buffers required • Pond 123.6 across from Stream 28 does not require buffers • Pond 111.8 near Moore's Pond Road and US 401 does not require buffers • Stream showing up on the soils map crossing US 401 from Davis Pearce Rd. north up US 401 but before Stream 31 was not found in the field, thus no buffers required • Pond 125.9 near Tarboro Rd.- No buffers required • Stream 39 (channel coming out of culvert) and area north of wetland O (see map) - No buffers required • Stream 4 will require buffers March 30. 2005 • Stream 263E-Buffers required for part of stream as shown on map • Stream 43-Buffers required for part of stream as shown on map • Wetlands FA and AL determined isolated by the USACE, were noted as isolated and fall under thejurisdiction of DWQ. Mav 23. 2005 • Stream that parallels US 401 and flows into Stream 6 (page 7 on map). Buffers for this stream start where located on map. • Stream checked along powerline casement on north side of US 401 past Louisbury Rd. There was no stream, therefore no buffers required. Widening will be to the east or west of the existing two lanes of US 401. The project includes an eastern bypass of Rolesville from north of SR 2225 (Louisbury Road) to NC 96. (Zebulon Road) in Franklin County. The proposed project is approximately 19.3 miles. Purpose and Need The purpose of the proposed is to alleviate the existing and future capacity deficiencies along US 401. The facility is currently operating at an unacceptable Level of Service F under peak conditions, which designates breakdown of traffic flow. The proposed improvements will alleviate the existing traffic congestion and provide an acceptable level of service through the design year 2020. The proposed improvements will also improve safety along the studied portion of US 401 by providing extra maneuvering lanes, which will reduce the number of rearend type collisions, and by improving below standard sight distance where needed. The purpose of limiting the control of access along the new location portion of the project is to maintain the transportation integrity of this corridor by limiting. the number of at grade. conflict points which contribute.to accidents and traffic delays.
