I should be able to get the approval letter out by Sept. 12 if I have all information that I need. I have attached the buffer
letter, the approval letter for 40 Wade, the PCN application for 40 Wade which includes overall map of stream and
wetlands, 40 Wade stormwater management plan approval, and map that I found in the buffer file that I have written
on indicating how you need to modify your plans to correctly depict streams and wetlands near the proposed outfall
location.

Approval of 401 Water Quality Certification and Authorization Certificate per the Neuse River
Buffer Protection Rules (15A NCAC 2B.0233) with Additional Conditions - REVISED
Dear Mr. Raul:
You have our approval, in accordance with the attached conditions and those listed below, to place fill
within or otherwise impact 0.032 acres of wetland, 314 linear feet perennial stream (252 linear feet
permanent impacts, 62 linear feet temporary impacts), 37,904 square feet (ft) of protected Zone 1 Neuse
River basin riparian buffer and 26,470 square feet (ft) of protected Zone 2 Neuse River basin riparian
buffer as described in your application dated June 12, 2006, and received by the Division of Water
Quality (DWQ) on June 12, 2006, with more information received from you on July 6, for the purpose of
constructing the residential subdivision, commercial development and accompanying utilities at the site.
After reviewing your application, we have decided that the impacts are covered by General Water Quality
Certification Number(s) 3374 and 3402 (GC3374 and GC3402). The Certification(s) allows you to use
Nationwide Permit(s) NW 12 and NW39, respectively, when issued by the US Army Corps of Engineers
(USACE). This letter shall also act as your approved Authorization Certificate for impacts to the
protected riparian buffers per 15A NCAC 213 .0233. This Certification replaces the Certification
issued to you on May 16, 2006. In addition, you should obtain or otherwise comply with any other
required federal, state or local permits before you go ahead with your project including (but not limited
to) Erosion and Sediment Control, and Non-discharge regulations. Also, this approval to proceed with
your proposed impacts or to conduct impacts to waters as depicted in your application shall expire
upon expiration of the 404 or CAMA Permit.
This approval is for the purpose and design that you described in your application. If you change your
project, you must notify us and you may be required to send us a new application. If the property is sold,
the new owner must be given a copy of this Certification and approval letter and is thereby responsible for
complying with all conditions. If total fills for this project (now or in the future) exceed one acre of
wetland or 150 linear feet of stream, compensatory mitigation may be required as described in 15A
NCAC 2H.0506 (h). This approval requires you to follow the conditions listed in the attached
certification and any additional conditions listed below.

2. No Waste, Spoil, Solids, or Fill of Any Kind
No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas beyond
the footprint of the impacts depicted in the Pre-Construction Notification. All construction
activities, including the design, installation, operation, and maintenance of sediment and erosion
control Best Management Practices, shall be performed so that no violations of state water quality
standards, statutes, or rules occur.
3. Erosion and sediment control practices must be in full compliance with all specifications governing
the proper design, installation and operation and maintenance of such Best Management Practices in
order to protect surface waters standards:
a. The erosion and sediment control measures for the project must be designed, installed,
operated, and maintained in accordance with the most recent version of the North Carolina
Sediment and Erosion Control Planning and Design Manual.
b. The design, installation, operation, and maintenance of the sediment and erosion control
measures must be such that they equal, or exceed, the requirements specified in the most
recent version of the North Carolina Sediment and Erosion Control Manual. The devices
shall be maintained on all construction sites, borrow sites, and waste pile (spoil) projects,
including contractor-owned or leased borrow pits associated with the project.
c. Sufficient materials required for stabilization and/or repair of erosion control measures and
stormwater routing and treatment shall be on site at all times.
4. Sediment and Erosion Control Measures
Sediment and erosion control measures shall not be placed in wetlands or waters to the maximum
extent practicable. If placement of sediment and erosion control devices in wetlands and waters is
unavoidable, they shall be removed and the natural grade restored within six months of the date that
the Division of Land Resources has released the project;
5. Protective Fencing
The outside buffer, wetland or water boundary and along the construction corridor within these
boundaries approved under this authorization shall be clearly marked with orange warning fencing
(or similar high visibility material) for the areas that have been approved to infringe within the
buffer, wetland or water prior to any land disturbing activities to ensure compliance with 15A
NCAC 2B.0233 and GC 3404;

6. Culvert Installation
Culverts required for this project shall be installed in such a manner that the original stream profiles
are not altered. Existing stream dimensions (including the cross section dimensions, pattern, and
longitudinal profile) must be maintained above and below locations of each culvert. Culverts shall
be designed and installed to allow for aquatic life movement as well as to prevent head cutting of
the streams. If any of the existing pipes are or become perched, the appropriate stream grade shall
be re-established or, if the pipes installed in a perched manner, the pipes shall be removed and re-
installed correctly.
Culvert(s) shall not be installed in such a manner that will cause aggradation or erosion of the
stream up or down stream of the culvert(s). Existing stream dimensions (including the cross section
dimensions, pattern and longitudinal profile) shall be maintained above and below locations of each
culvert.
Placement of culverts and other structures in waters, streams, and wetlands must be placed below
the elevation of the streambed by one foot for all culverts with a diameter greater than 48 inches,
and 20 percent of the culvert diameter for culverts having a diameter less than 48 inches, to allow
low flow passage of water and aquatic life. Design and placement of culverts and other structures
including temporary erosion control measures shall not be conducted in a manner that may result in
disequilibrium of wetlands or streambeds or banks, adjacent to or upstream and down stream of the
above structures. The applicant is required to provide evidence that the equilibrium shall be
maintained if requested in writing by DWQ.
The establishment of native, woody vegetation and other soft stream bank stabilization techniques
must be used where practicable instead of rip rap or other bank hardening methods. If rip-rap is
necessary, it shall not be placed in the stream bed, unless specifically approved by the Division of
Water Quality.
Installation of culverts in wetlands must ensure continuity of water movement and be designed
to adequately accommodate high water or flood conditions.
Upon completion of the project, the Applicant shall complete and return the enclosed "Certificate of
Completion" form to notify NCDWQ when all work included in the §401 Certification has been
completed. The responsible party shall complete the attached form and return it to the
401/Wetlands Unit of the NC Division of Water Quality upon completion of the project. Please
send photographs upstream and downstream of each culvert site to document correct installation
along with the Certificate of Completion form.
7. Written Stormwater Management Plan (Final Plan Needed) Required For Each Phase
A final, written stormwater management plan (including a signed and notarized Operation and
Maintenance Agreement) for each phase of the entire project shall be submitted to the 401
Oversight and Express Permitting Unit (2321 Crabtree Blvd., Suite 250, Raleigh, NC, 27604) and
the stormwater management plans shall be approved in writing by this Office before the impacts
for that particular phase may occur per Condition No. 4 in GC No. 3402. You have the option
of using the Express Review Program for expedited approval of these plans.. If you propose to
use the Express Review Program, remember to include the appropriate fee with the plan. Site-
specific stormwater management shall be designed to remove 85% TSS according to the latest
version of DWQ's Stormwater Best Management Practices manual at a minimum. Additionally,
in watersheds within one mile and draining to 303(d) listed waters, as well as watersheds that are

classified as nutrient sensitive waters (NSW), water supply waters (%VS), trout waters (Tr), high
quality waters (HQW), and outstanding resource waters (ORW), the Division shall require that
extended detention wetlands, bio-retention areas, and ponds followed by forested filter strips
(designed according to latest version of the NCDENR Stormwater Best Management Practices
Manual) be constructed as part of the stormwater management plan when a site-specific
stormwater management plan is required.
Also, the stormwater management plan (as approved by the Wetlands Unit) shall be implemented
before any permanent building or other structure is occupied at the subject site.
The structural stormwater practices as approved by the Wetlands Unit as well as drainage patterns
must be maintained in perpetuity. No changes to the structural stormwater practices shall be
made without written authorization from the Division of Water Quality.
8. Diffuse Flow (No Review)
All constructed stormwater conveyance outlets shall be directed and maintained as diffuse flow at
non-erosive velocities through the protected stream buffers such that it will not re-concentrate
before discharging into a stream as identified within 15A NCAC 2B .0233 (5). If this is not
possible, it may be necessary to provide stormwater facilities that are considered to remove
nitrogen. This may require additional approval from this Office.
Mitigation:
9. Compensatory Mitigation Using the Ecosystem Enhancement Program (EEP)
Mitigation must be provided for the proposed impacts as specified in the table below. We
understand that you wish to make a payment to the Wetlands Restoration Fund administered by
the NC Ecosystem Enhancement Program (EEP) to meet this mitigation requirement. This has
been determined by the DWQ to be a suitable method to meet the mitigation requirement. Until
the EEP receives and clears your check (made payable to: DENR - Ecosystem Enhancement
Program Office), no impacts specified in this Authorization Certificate shall occur. The EEP
should be contacted at (919) 733-5205 if you have any questions concerning payment into a
restoration fund. You have one month from the date of this approval to make this payment. For
accounting purposes, this Authorization Certificate authorizes payment into the Wetlands
Restoration Fund to meet the following compensatory mitigation requirement:

10. Deed Notifications
Deed notifications or similar mechanisms shall be placed on all retained jurisdictional wetlands,
waters and protective buffers in order to assure compliance for future wetland, water and buffer
impact. These mechanisms shall be put in place prior to impacting any wetlands, waters and/or
buffers approved for impact under this Certification Approval and Authorization Certificate. A
sample deed notification can be downloaded from the 401 /Wetlands Unit web site at

http://h2o.enr.state.nc.us/ncwetlands. The text of the sample deed notification may be modified
as appropriate to suit to this project; ,.
11. Sewer Systems
The project shall comply with 15A NCAC 2H.0219(i)(2)(G) and all other State, Federal and local
sewer system regulations.
12. Construction Stormwater Permit NCGO10000
Upon the approval of an Erosion and Sedimentation Control Plan issued by the Division of Land
Resources (DLR) or a DLR delegated local erosion and sedimentation control program, an
NPDES General stormwater permit (NCGO10000) administered by DWQ is automatically issued
to the project. This General Permit allows stormwater to be discharged during land disturbing
construction activities as stipulated by conditions in the permit. If your project is covered by this
permit [applicable to construction projects that disturb one (1) or more acres], full compliance
with permit conditions including the sedimentation control plan, self-monitoring, record keeping
and reporting requirements are required. A copy of this permit and monitoring report forms may
be found at http: //h2o. enr. state. nc. us/su/Forms Documents. htm. ;
13. Certificate of Completion
Upon completion of all work approved within the 401 Water Quality Certification or applicable
Buffer Rules, and any subsequent modifications, the applicant is required to return the attached
certificate of completion to the 401 Oversight/Express Review Permitting Unit, North Carolina
Division of Water Quality, 1650 Mail Service Center, Raleigh, NC, 27699-1650.
Violations of any condition herein set forth may result in revocation of this Certification and may result in
criminal and/or civil penalties. The authorization to proceed with your proposed impacts or to conduct
impacts to waters as depicted in your application and as authorized by this Certification, shall expire upon
expiration of the 404 or CAMA Permit.
If you do not accept any of the conditions of this Certification (associated with the approved wetland or
stream impacts), you may ask for an adjudicatory hearing. You must act within 60 days of the date that
you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of
the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center,
Raleigh, N.C. 27699-6714. This certification and its conditions are final and binding unless you ask for a
hearing.
Any disputes over determinations regarding this Authorization Certificate (associated with the approved
buffer impacts) shall be referred in writing to the Director for a decision. The Director's decision is
subject to review as provided in Articles 3 and 4 of G.S. 150B.

On behalf of Wexford Developers LLC, we are requesting authorization from the USACE to use
NWP's 12 & 39 for the construction of a residential/commercial development. We are also
requesting 401-certification and buffer compliance from the NC-DWQ.
The subject property is approximately 17o acres in size and is located immediately west of
the intersection of Wade Avenue and Edwards Mill Road at Latitude 35.8075681°N and
Longitude 78.7296585°W in Wake County, North Carolina. The site contains unnamed
tributaries of Richlands Creek and is located in the Neuse River Basin. The Hydrologic Unit

Wetlands were delineated by Soil and Environmental Consultants and approved by the
USACE on February 26, 2002 (USACE AID#: 200220576). On October 4, 2005, the NC-DWQ
conducted a site visit to evaluate streams potentially subject to the Neuse Riparian Rules. A
copy of the buffer letter is included with the attachments (DWQ Project #: 05-265).
Proposed Impacts
The proposed impacts consist of 252 linear feet of perennial stream channel and 0.032 acres
of wetland impacts for three roadway crossings and lot fill. An additional 62 linear feet of
perennial stream channel will betemporarily impacted forthe installation of a utility line.
Following construction of the utility line, the stream channel will be returned to pre-
construction contours. Impacts are summarized in the table below as well as in the PCN
form.

Avoidance and Minimization
Wetland, stream and buffer impacts forth e proposed project have been avoided and
minimized to the greatest extent practical forth edevelopment of the project.
Impacts 'A' and 'E' are required forth e improvement of the Main Drive collector roadway
(loo' right-of-way) connection from Edwards Mill Rd. to Trinity Rd. Impact 'A' has been
minimized through the use of retaining walls. The crossing location for impact'E' was
determined based upon the absence of significant trees within the proposed impact area,
and has been designed as a bottomless culvert in order to avoid direct stream impacts.
Impacts 'B', 'F' and 'G' are required for utility connections to existing sewer mains and for
pedestrian crossings as required by the City of Raleigh approved Master Development Plan.
Locations of impacts were determined by required connection points to existing manholes
and absence of significant trees within the proposed impact area. Pedestrian crossings were
situated at the same locations as required utility crossings in order to avoid additional
impacts to the riparian buffer. In addition, the pedestrian crossings will utilize bridges to
reduce impacts to the stream channels.
Impact 'C' is required for the roadway connection of Corporate Center Drive from its existing
terminus at the southern corner of the property to Main Drive. The impact to the upper end
of the stream buffer could not be avoided due to the minimum radius criteria and maximum
superelevation rate for collector roadways in accordance with the City of Raleigh standards
for horizontal curve design criteria. The proximity of the access drive connection from
Corporate Center Drive to the existing Cardinal Gibbons High School site was designed in a
mannerto completely avoid impacts to the stream and buffer.
Impact 'D' is required for internal circulation of the vehicular traffic within the site. The
impacts have been located in a manner to avoid the existing wetland area in the proximity of
the crossing. Again, the applicant is proposing an arch culvert in this location to minimize
impacts to the stream channels on-site.
Stormwater Management Plan
The proposed impervious for Phase I is 44.3%, therefore we have included a detailed
stormwater management that meets the NC-DWQ requirements for sites located within a
Nutrient Sensitive Watershed. Specifically, the applicant will utilize constructed wetlands in
order to protect downstream water quality. The NC-DWQ worksheets, signed Operations and
Maintenance Agreement and the Stormwater manual for Phase i are included with the
attachments. The stormwater plans for the future phases have not been finalized, however;
based on the drainage area, adequate space has been reserved for future BMP locations.
We are requesting that the NC-DWQ issue the 401- approval with a condition that work will
not begin on future phases until the stormwater management plans for these phases have
been reviewed and approved by the NC-DWQ.
Mitigation
Because the impacts to perennial channels exceed 150 linear feet, the applicant proposes
payment to the NC-EEP to satisfy mitigation requirements. Additionally, mitigation will also
be required for impacts to the riparian buffers at locations 'A' and V. A copy of our request
has been forwarded to the NC-EEP for approval and is included with the attachments. When
we receive confirmation that the NC-EEP is willing to accept payment, we will forward this
information to your office.

VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.
USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on January 15, 2002, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCEEP concurrence shall be placed on hold as incomplete.
An applicant may also choose to review the current guidelines for stream restoration in DWQ's
Draft Technical Guide for Stream Work in North Carolina, available at
http://h2o.enr.state.nc.us/ncwetlands/strmgide.html.
Provide a brief description of the proposed mitigation plan. The description should provide
as much information as possible, including, but not limited to: site location (attach directions
and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet)

Will this project (based on past and reasonably anticipated future impacts) result in additional
development, which could impact nearby downstream water quality? Yes ? No
If yes, please submit a qualitative or quantitative cumulative impact analysis in accordance with
the most recent North Carolina Division of Water Quality policy posted on our website at
http://h2o.enr.state.nc.us/ncwetlands. If no, please provide a short narrative description: All of
the adjacent parcels have already been developed (i.e. Cardinal Gibbons High School and the
RBC Center), therefore we do not believe that this project will lead to future impacts in the
adjacent parcels. In order to protect downstream water quality the applicant will employ the
qppropriate BMP's during construction. Following construction, stormwater wetlands (designed
to the NC-DWQ requirements) will be used to treat stormwater before it leaves the site. In
addition, the applicant will retain 50 -foot Neuse Buffers around the remaining stream channels
and will retain a 100-foot buffer on either side of Medfield Creek. Therefore we do not believe
that this project will negatively impact downstream water quality.
XV. Other Circumstances (Optional):
It is the applicant's responsibility to submit the application sufficiently in advance of desired
construction dates to allow processing time for these permits. However, an applicant may
choose to list constraints associated with construction or sequencing that may impose limits on
work schedules (e.g., draw-down schedules for lakes, dates associated with Endangered and
Threatened Species, accessibility problems, or other issues outside of the applicant's control).

There are waters of the U.S., to include wetlands, on the above described property which we strongly suggest
should be delineated and surveyed. The surveyed wetland lines must be verified by our staff before the Corps will
make a final jurisdictional determination on your property.
Because of the size of your property and our present workload, our identification and delineation of your wetlands
cannot be accomplished in a timely manner. You may wish to obtain a consultant to obtain a more timely
delineation of the wetlands. Once the consultant has flagged a wetland line on the property, Corps staff will
review it, and, if it is accurate, we strongly recommend that you have the line surveyed for final approval by the
Corps. The Corps will not make a final jurisdictional determination on your property without an approved survey.
The waters of the U.S., to include wetlands, on your lot have been delineated, and the limits of the Corps

WET [WETLAND] DETENTION BASIN OPERATION AND MAINTENANCE AGREEMENT

The wet [wetland] detention basin system is defined as the wet [wetland] detention basin, pretreatment
including forebays and the vegetated filter if one is provided.
Maintenance activities shall be performed as follows:
After every significant runoff producing rainfall event and at least monthly:
a. Inspect the wet [wetland] detention basin system for sediment accumulation, erosion, trash
accumulation, vegetated cover, and general condition.
b. Check and clear the orifice of any obstructions such that drawdown of the temporary pool occurs within
2 to 5 days as designed.
2. Repair eroded areas immediately, re-seed as necessary to maintain good vegetative cover, mow
vegetative cover to maintain a maximum height of six inches, and remove trash as needed.
3. Inspect and repair the collection system (i.e. catch basins, piping, swales, riprap, etc.) quarterly to
maintain proper functioning.
4. Remove accumulated sediment from the wet [wetland] detention basin system semi-annually or when
depth is reduced to 75% of the original design depth (see diagram below). Removed sediment shall be
disposed of in an appropriate manner and shall be handled in a manner that will not adversely impact
water quality (i.e. stockpiling near a wet [wetland] detention basin or stream, etc.).
The measuring device used to determine the sediment elevation shall be such that it will give an accurate
depth reading and not readily penetrate into accumulated sediments.
When the permanent pool depth reads . 2S feet in the main pond, the sediment shall be removed.
[For stormwater wetlands: If the elevation of the marsh areas exceed the permanent pool elevation, the
sediment should be removed to design levels. This shall be performed by removing the upper 6 inches of
soil and stockpiling it. Then the marsh area shall be excavated six inches below design elevations.
Afterwards the stockpiled soil should be spread over the marsh surface. The soil should not be stockpiled
for more than two weeks.]
When the permanent pool depth reads 2 - ZS feet in the forebay [and micro-pool], the sediment shall be
removed.

5. Remove cattails and other indigenous wetland plants when they cover 50% of the basin surface. These
plants shall be encouraged to grow along the vegetated shelf and forebay berm.
[For wetlands: Wetland planting densities in the marsh areas should be maintained by replanting bare
areas as needed. Wetland plants should be encouraged to grow in the marsh areas.]
6. If the basin must be drained for an emergency or to perform maintenance, the flushing of sediment
through the emergency drain shall be minimized to the maximum extent practical.
7. All components of the wet [wetland] detention basin system shall be maintained in good working order.
8. Level spreaders or other structures that provide diffuse flow shall be maintained every six months. All
accumulated sediment and debris shall be removed from the structure, and a level elevation shall be
maintained across the entire flow spreading structure. Any down gradient erosion must be repaired and/or
replanted as necessary.

depth is reduced to 75% of the original design depth (see diagram below). Removed sediment shall be
disposed of in an appropriate manner and shall be handled in a manner that will not adversely impact
water quality (i.e. stockpiling near a wet [wetland] detention basin or stream, etc.).
The measuring device used to determine the sediment elevation shall be such that it will give an accurate
depth reading and not readily penetrate into accumulated sediments.
When the permanent pool depth reads 2.2S feet in the main pond, the sediment shall be removed.
[For stormwater wetlands: If the elevation of the marsh areas exceed the permanent pool elevation, the
sediment should be removed to design levels. This shall be performed by removing the upper 6 inches of
soil and stockpiling it. Then the marsh area shall be excavated six inches below design elevations.
Afterwards the stockpiled soil should be spread over the marsh surface. The soil should not be stockpiled
for more than two weeks.]
When the permanent pool depth reads 2. ZS feet in the forebay [and micro-pool], the sediment shall be
removed.

5. Remove cattails and other indigenous wetland plants when they cover 50% of the basin surface. These
plants shall be encouraged to grow along the vegetated shelf and forebay berm.
[For wetlands: Wetland planting densities in the marsh areas should be maintained by replanting bare
areas as needed. Wetland plants should be encouraged to grow in the marsh areas.]
6. If the basin must be drained for an emergency or to perform maintenance, the flushing of sediment
through the emergency drain shall be minimized to the maximum extent practical.
7. All components of the wet [wetland] detention basin system shall be maintained in good working order.
8. Level spreaders or other structures that provide diffuse flow shall be maintained every six months. All
accumulated sediment and debris shall be removed from the structure, and a level elevation shall be
maintained across the entire flow spreading structure. Any down gradient erosion must be repaired and/or
replanted as necessary.

On June 15, 2007, the Division of Water Quality (DWQ) received the stormwater management plan for
Phase 11 of the Forty Wade project, with additional information received from you on July 5 and July 26,
2007. This Plan has been reviewed and addresses the requirements of Condition No. 7 of the 401 Water
Quality Certification issued for this project on August 7, 2006.
The structural stormwater practices as approved by DWQ as well as drainage patterns must be maintained
in perpetuity. No changes to the structural stormwater practices shall be made without written
authorization from the DWQ. Stormwater easements shall be recorded for a distance of at least 10 feet on
each side of all stormwater conveyances on all lots containing these structures including future access for
maintenance. The stormwater easements shall allow for the ability to maintain the structures, perform
corrective actions as described above and shall provide protection of the structures from potential
alternations by future property owners.
This letter completes the review of the DWQ under Section 401 of the Clean Water Act. If you have any
