In response to the above mentioned Administrative Order, there are 3 enclosures included with
this letter.
Enclosure #1 is a follow up report of the repairs and corrective action that had taken place on this
project after the March 3, 2011 inspection by Ms. Bonilla and completed by March 24, 2011. As
stated in a report sent to Ms. Bonilla on March 24, 2011, all the areas she had highlighted during
the inspection, including the paperwork, had been corrected. Enclosure #1 again documents
those repairs and corrective actions and are correlated when possible to the photos that Ms.
Bonilla took on site on March 3, 2011. .
Enclosure #2 is pictures taken on March 9, 2011 of the severe flooding that NCDOT encountered
last winter and spring on the project. The contractor was able to repair and maintain all erosion
control measures by March 24, 2011.
Enclosure #3 is copies of the Storm Water Inspections that the contractor completes and a
NCDOT representative verifies and signs. The reports included are from November 2010 through
January 2011. The Administrative Order states that these reports were missing. The reports
were not missing, but they were incomplete and the NCDOT representative had refused to sign
them until they were accurate and all forms completely filled out. During Ms. Bonilla's inspection,
she informed us that the reports should still be signed and notations made as to missing
information or inaccuracies. The contractor, along with NCDOT representatives and Mike Parker,
DENR, has worked successfully to eliminate the paperwork problems and all reports are signed
by a certified representative of the NCDOT.
Erosion control plans have been modified when it is deemed necessary to change the erosion
control measures from that indicated on the original plans. These approved plans are kept on site
and available for inspectors.

Following the inspection by Ms. Bonilla on March 3, 2011, Ms. Bonilla was contacted several
times by email by NCDOT personnel to update her on the progress of repairs and corrective
action taken on the Upward Road project. These emails are attached. On March 7, 2011, Ms.
Bonilla.was informed that inspection sheets had been reviewed and signed as required, and that
the contractor was in the process of repairing silt fence, skimmers and check dams along with
installing rip rap at temporary pipe outlets. On March 11, 2011, Ms. Bonilla was sent 12 photos
with a brief description to document corrective action that had taken place in areas that were
highlighted during her inspection. The email and photos are attached. On March 24, 2011, a
report was sent detailing repairs along with 23 photos to document the repairs. All areas had
been repaired and the contractor continued to install additional erosion control measures and
maintain them. These emails have been forwarded on to Ms. Pope.
All repairs and corrective actions following Ms. Bonilla's inspection were completed by March 24,
2011. The contractor along with the NCDOT representatives on the project are continually
working together to make sure the erosion control measures and requirements of the permits are
successfully met. NCDOT has complied with all requirements of the Administrative Order CWA
04-2011:4772.-

direction or supervision in accordance with a system designed to assure that qualified personnel
properly'gather and evaluate the information submitted. Based on my inquiry of the person or
persons who manage the system, or those persons directly responsible for gathering the
information, the information submitted is, to the best of my knowledge and belief, true, accurate,
and complete. I am aware that there are significant penalties for submitting false information,
including the possibility of fine and imprisonment for knowing violations.

I will try to reference these pictures to the pictures Ms. Bonilla took on March 3, 2011 if
possible. These were all taken on August 5, 2011. As you can see many changes have taken
place. As stated in the earlier report with narrative and 23 photos of March 24, 2011, all the
problems specified by Ms. Bonilla during her site visit were corrected by that time. Also, initial
corrective action had taken place earlier and was documented on March 11, 2011 by email and
included 12 photos of the repaired areas.
This corresponds to #101. Slope stabilization with rip rap protection near the culvert outlet to
King Creek.

Culvert outlet at King Creek. Material in creek is not sediment from erosion as the culvert
barrel bottom was filled 1 foot deep with natural stream bed material that was saved from
culvert excavation. The natural stream bed material was sand, gravel and mud which
proceeded to wash out of the culvert during heavy rains. Note baffles in culvert to meander
the stream in barrel and try to retain material.

Following your site inspection on March 3, 2011 of the Upward Road project in Henderson County, several items have
been addressed:
- All weekly NPDES inspection sheets have been reviewed once again and signed. Notations have been made where the
contractor has failed to fill out the forms properly. We will be working with Mike Parker to alleviate this problem.
- Repairs and maintenance of the in place erosion control measures such as skimmers, sediment basins, silt fence and
check dams are continuing.
- Rip rap has been installed at the temporary slope drain pipe outlets throughout most of the project and will continue
until complete.
The contractor will stabilize disturbed areas as required as conditions permit and install erosion control measures as
needed to minimize sediment discharges. I am still searching to find an answer to your question on the permitting
process. Please let me know if you need any other information.

under construction at the outlet of these drains.
We are working with the contractor and Mike Parker to resolve any issues with the
stormwater inspection records and to ensure that they are filled out properly. The
contractor is working to install, maintain and repair erosion control devices as needed.
