8. PROJECT SUMMARY: The applicant is proposing to construct a public boating access area with
concrete driveway, parking areas, boat ramp with stabilization walls, fixed and floating access piers, and a
bulkhead with shoreside dock and riprap for shoreline stabilization. The applicant is also proposing to
maintenance excavate an access channel.
9. PROJECT DESCRIPTION:
The project site is located on Fulchers Landing Loop Road (SR 1517), adjacent to the New River, in Sneads
Ferry, Onslow County. To locate the site from Wilmington take US HWY 17 N to NC HWY 172, which is located
approximately 4 miles north of Holly Ridge. Turn right onto NC HWY 172 and continue for approximately 6.2
miles.to Wheeler Creek Road. Turn right onto Wheeler Creek Road and travel approximately 0.9 miles to the
junction of Fulchers Landing Loop Road and travel approximately 0.60 miles. The project site is located on
both sides of the Fulchers Landing Loop Road.
The project site consists of four parcels, three parcels along the shoreline of the New River and an additional
parcel located on the west side of the road. The combined area of the parcels is approximately 98,819 square
feet (2.3 acres). According to the applicant, the high ground portion of the property has an elevation of
approximately 2-3 feet above Normal High Water (NHW). Existing man-made features found on the parcel
located on the west side of the road, are a gravel parking area, storage shed, and an abandoned septic system.
The parcel is currently utilized for vehicle and trailer parking for the existing boat ramp. Existing manmade
features on the waterfront parcels include a former marina store, Green Turtle restaurant, boat ramps,
bulkheads, piers and bulkheads. Vegetation on the highground portion of the project site consists primarily of
lawn grasses, with several Live Oaks (Quercus virginiana), Eastern Red Cedars (Juniperus virginiona), and Wax
Myrtle (Myrica cerifera) near the shoreline. The project site has approximately 508 feet of shoreline frontage
that has been stabilized with concrete and wooden bulkheads. Portions of the bulkhead have not been
maintained and several sections of the concrete bulkhead have broken creating two large ebayments along
the southern shoreline. Within the two ebayments coastal wetlands are present and consist of low and high
marsh species, which include Bulrushes (Scirpus spp.), Smooth Cordgrass (Spartina alterniflora), and Salt
Meadow Hay (Spartina patens). Current water depths were obtained via soundings at low water supplied by
the applicant. The applicant has stated that water depths average -1 to - 3 feet at NLW from the existing
bulkhead offshore approximately 960 feet to -4 foot contour of the New River. Eelgrass (Zostera marina), a
type of Submerged Aquatic Vegetation (SAV), is present below NLW within the project area. A SAV survey was
conducted by the Wildlife Resources Commission and the Division of Marine Fisheries staff on April 12, 2011
(see provided survey). The areas immediately adjacent to the existing bulkhead and offshore approximately
100 feet were found to be highly disturbed, deeper and no SAV was detected. Offshore approximately 100 to
250 feet SAV coverage was estimated as sparse at approximately 25% coverage. Beyond 250 feet, SAV was
found by raking and overall coverage was less than 5%. Aerial photographs indicate that the site was
developed prior to 1978 and CAMA permit history is minimal. The project site and adjacent waters have an
established and traditional use as a working waterfront and providing water access.
The adjacent riparian property to the southeast features a residential structure with pier. Properties in the
vicinity of the project site have mixed uses; a commercial docking facility with fish house, a commercial boat
rental shop with boat ramp, a campground, as well as, residential home sites are within a quarter mile of the
project site. There are no known archaeological sites within the vicinity of the project site.

The waters of the New River adjacent to the project site are classified as SA by the North Carolina Division of
Water Quality. They are NOT designated as a Primary Nursery Area (PNA) by the North Carolina Division of
Marine Fisheries, and they are CLOSED to the harvest of shellfish.
PROPOSED PROJECT:
The applicant is proposing to construct a public boating access area with concrete driveway, parking area and
boat ramp with stabilization walls, access piers, a bulkhead with shoreside dock, and riprap for shoreline
stabilization. The applicant is also proposing to maintenance excavate an access channel. The proposed
boating access area would require the entire project site (4 parcels) to be disturbed and graded for
construction. The proposed upland development, located on the parcel west of Fulchers Landing Loop Road,
would include paved drive isles and parking area, providing standard and "vehicle with trailer" parking spaces,
and storm water treatment (see Sheet 3 of 10). The applicant is proposing to remove the existing boat ramp
adjacent to the northern property boundary. The boat ramp removal would require the excavation of an area,
measuring approximately 30 feet wide by 30 feet long from below NHW. The applicant is then proposing to
construct 40 linear feet of bulkhead along the Normal High Water level (NHW) where the existing boat ramp
would be removed. According to the application, the proposed new boat ramp would have a footprint
measuring approximately 40 feet wide by 50 feet long from the existing NHW boundary along the bulkhead.
Approximately 126 cubic yards of material would be removed from high ground in order to provide adequate
slope for the proposed boat ramps. The applicant has stated that the end of the proposed ramp would
terminate at the existing -4 foot (at NLW) water depth contour. Sub-grade construction materials would
consist of 1 foot of Class B riprap and 6 inches of 57 stone would be used to provide a foundation and prevent
erosion and future movement of the ramp. The concrete ramp would consist of an 8-inch concrete slab that
would be poured and formed on the high ground and pushed into place (see Sheet 5 of 10). The boat ramp
would be stabilized with two vinyl sheet pile retaining wall/breakwaters. The proposed retaining
wall/breakwaters would extend from the high ground, slope with the ramp, and provide support for the
proposed fixed launch docks and the boat ramp. The proposed sheet pile retaining wall/breakwaters would
measure approximately 83 linear feet, of which approximately 50 feet of the breakwater would extend below
the proposed NHW boundary. As stated by the applicant, the portions of the wall located above NHW would
be constructed as retaining walls and would provide proper grade of the turnaround area to direct storm
water flow away from the top of the ramp. The portions of the wall located below the proposed NHW
boundary would be constructed with 1 inch gaps every 1 foot above the mud line. Connected to the
proposed vinyl sheet pile raining wall/breakwaters on the sides of the proposed ramp would be two 8 feet
wide by 60 feet floating docks. As proposed the floating docks would extend approximately 48 feet
waterward of the proposed NHW boundary. Separating the single lane ramps is a proposed ground out
floating dock measuring approximately 60 feet in length by 8 feet in width. As proposed, the floating dock
would extend approximately 48 feet waterward of the proposed NHW boundary.
The application states that the existing dilapidated and broken bulkhead would be removed from the
remaining shore line. Approximately 76 linear feet of new vinyl bulkhead is proposed south of the proposed
boat ramp. A shore side dock is also proposed perpendicular and waterward of the bulkhead. As proposed
the shore side dock would measure approximately 6 feet in width by 76 feet in length and would run parallel
to the bulkhead. An approximately 30 feet long return wall, perpendicular to the shoreline is proposed at the
southern end of the bulkhead. The applicant has stated that the proposed bulkhead would be located at or

above NHW and some minimal high ground excavation may be necessary in order to provide a straight
alignment. The shoreline south of the proposed bulkhead would be stabilized with riprap. As proposed, the
riprap would be located landward of all coastal wetlands. The applicant has stated that in areas void of
wetland vegetation, the rip rap would extend a maximum distance of 10 feet waterward of NHW to obtain
adequate slope along the shoreline where the bulkhead is to be removed. The applicant has stated that the
riprap would have a maximum base width of 14 feet. The applicant is proposing approximately 240 linear feet
of riprap and approximately 116 linear feet of bulkhead for shoreline stabilization. The applicant is also
proposing to maintenance excavate the access channel located perpendicular to the shoreline in the location
of the proposed boat ramp. As proposed the access channel would measure approximately 960 feet in length
by 25 feet in width and would be dredged to a final depth of -4 feet at NLW (see Sheet 4 of 10). The applicant
has stated and provided documentation that the spoil material would be accepted and stockpiled at the
Onslow County Stump Sound Park and would be utilized for future Onslow County Parks and Recreation
Projects. The applicant is also proposing to install ten (10) US Coast Guard approved (red and green can or
nun buoy) channel markers along the access channel. The proposed channel markers would be spaced every
150 feet and would terminate at the -4 foot water depth contour (see Sheet 4 of 10). The channel markers
and "no-wake" buoys would be chained to a concrete anchor on the bottom. The applicant has stated that
the anchor size shall be determined by buoy size as well as tide and surf conditions. As proposed, the floating
docks would extend approximately 50 feet into a water body which measures approximately 7000 feet in
width.
10. ANTICIPATED IMPACTS
The construction of the boating access area would result in the disturbance of the entire project site,
approximately 98,819 square feet of high ground (approximately 2.3 acres). The proposed boating access area
improvements, including, but not limited to the paved parking, access, drive turn around area and boat ramp
would result in a total of approximately 57,513 square feet of impervious surface (58.2%) for the entire
project site. Approximately 33,203 square feet of impervious surface would be located within the Coastal
Shoreline AEC, resulting in approximately 33.6% coverage within the AEC. The applicant has applied for and
received Storm water Certification for the proposed development and results in a reduction in the overall
impervious area of the existing site. The proposed removal of the existing boat ramp and supporting
structures would result in the disturbance of an area of shallow bottom and open water with a footprint
measuring approximately 30 feet wide by 30 feet long (approximately 900 square feet) and approximately 155
cubic yards of material would be removed from the shallow bottom. The proposed boat ramp and supporting
structures would result in the disturbance of an area measuring approximately 50 feet wide by 50 feet long
(approximately 2,500 square feet). As proposed, an area measuring approximately 50 feet wide by 30 feet
long (approximately 1500 square feet) would be excavated from the high ground to provide adequate slope
for the proposed ramp, resulting in the removal of approximately 126 cubic yards of high ground material.
The applicant is also proposing to place approximately 310 cubic yards of fill material above NHW for ramp
support and to provide slope for the ramp and storm water treatment. Located within the proposed footprint,
the proposed vinyl sheet pile retaining wall/breakwaters on the sides of the proposed ramp would result in
the filling of approximately 330 square feet of Estuarine Waters. The placement of the fill material and
constructed slope for the boat ramp would result in a landward shift of the NHW boundary approximately 10
feet. The proposed boat ramp would extend approximately 48 feet below the proposed NHW boundary and
the toe of the ramp would terminate at approximately -4 feet below NLW. The proposed boat ramp

construction would result in the placement of approximately 140 cubic yards of material below NHW. The
proposed floating docks on both sides of the ramp would extend approximately 54 feet waterward of the
proposed NHW boundary and would incorporate approximately 1,296 square feet of Estuarine Waters. The
proposed floating dock would extend approximately 54 feet into a water body measuring approximately 7,000
feet in width. As proposed the floating docks would conform to the % width limitation and it would not
extend beyond the established pier head line. The proposed channel markers would incorporate an
additional 10 square feet of Estuarine Waters. The proposed maintenance excavation of the channel would
result in the removal of approximately 1000 cubic yards of material from below NHW to provide an access
channel. As proposed, sparse patches of SAV and potential SAV habitat, approximately 3,750 square feet
would be removed by the excavation.

Redevelopment Project
CAMA Application Narrative - drawings dated 6/17/2011
The North Carolina Wildlife Resources Commission (NCWRC) proposes the
redevelopment of its Sneads Ferry boat ramp property in Onslow County, NC. The site is on the
New River and Fulchers Landing Loop Road (SR 1541) runs between the tracts of land.
NCWRC acquired these 4 tracts of previously developed land through WAMI grant funds
in early 2010. Existing development on the tracts includes parking, commercial buildings,
commercial docks and bulkheads, and a boat ramp that was previously open for public use for a
daily launch fee. This site has been operating on some capacity as a public/commercial access
since at least the 1940s. Historical aerial photos place the waterfront development and
approximately 1000'-long channel creation between 1938 and 1949. The boat ramp property
being sold is a direct illustration of this project's importance to the public and the area. As land
changes hands there is no guarantee the land use and business operations will remain the same
and the opportunity to launch a boat, even for a fee, could disappear from any privately-owned
ramp in the future. NCWRC's mission to provide free public boating access will be an asset to
the Sneads Ferry community as the boating and fishing it supports will be able to continue into
the future with no risk of disappearing.
The existing boat ramp at the site is inadequate and cannot be easily launched from in
the entire range of normal water levels. New River at this location has a lunar tide and is
additionally affected by wind tides. Water depths in front of the existing ramp can be as little as 1'
during lower water levels with sustained wind influence. The existing fixed dock next to the ramp
is set at a very high elevation so that it will not be inundated during high water events, but is
ineffective as a launching aid during lower water levels. The commercial docks behind the
existing commercial buildings are in poor shape and would be a structural safety concern to open
to public use in their current condition. The existing channel, while consistently 3' deep at low
lunar tide levels, needs to be maintenance dredged to ensure adequate water depths in lower
water depths created by sustained winds.
Redevelopment and new construction activities proposed at the site are: demolition of
commercial buildings, existing ramps, and existing bulkheads and docks. Construction of 2 new
launch ramps, 3 floating docks, bulkheads, rip rap shoreline stabilization, shoreline fixed dock,
asphalt parking lot and maneuver area, and improvement of an existing gravel parking lot.
Distinct driveways will be created to improve safety and traffic flow at the site. An NCDOT
Driveway Permit is needed for the new driveways and coordination with NCDOT has been
completed on those designs. The proposed ramps will be relocated on the site to the location
currently behind the old marina store. Here there is an existing harbor area and maintained
channel with better water depths than at the old ramp. This channel is currently in use today as
boats are still docking daily behind the Green Turtle Restaurant. Photo evidence indicates that
channel was created sometime after 1938 and has been maintained since at least the 1949. An
interview with lifetime resident Kern Everett provided information on past development and
waterfront uses of marina stores, fish houses, commercial docking, and charter boat docking as
far back as the 1941 that continuously used the existing channel at the site. Maintenance
dredging of that channel to a depth of 4 NLW is proposed to allow boaters to navigate to deeper
water during all ranges of water levels, especially during events with sustained winds augmenting
low lunar tide.
In May 2010, NCWRC engineering staff observed very sparse eel grass in front of the
existing boat ramp and in the shallow waters in front of the eastern property shorelines. At a
subsequent NCDENR Permitting Scoping meeting in July 2010, it was determined that regulatory
agency staff would visit the site during the SAV growing season for a preliminary SAV survey to
determine if a full SAV survey was needed. In late August and again in early September, staff
from NCWRC-Engineering, NCWRC-Inland Fisheries, NCDCM, NCDMF, and NCDWQ visited the
site for the preliminary SAV survey. A subsequent full-scale SAV survey was conducted by
NCDMF and NCWRC staff in April 2011. This survey found zero SAV in front of the proposed
new ramp location, SAV presence in front of the existing ramp location between the 2 fixed
docks, and some sparse SAV presence in about 150' of the existing channel near the end of the
existing fixed docks. Beyond the area of sparse SAV presence, very sparse SAV presence was
observed occasionally. The current boat ramp traffic pattern between the 2 fixed docks has boats
traveling over about 7000ft2 of SAV area (-175' long x 40' wide) to reach the existing channel just
to the existing channel to the south of the docks. During low water events, incidental prop
dredging by ramp users occurs in that SAV area. The proposed maintenance dredging of the
existing channel would impact approximately 3,750ft2 of sparse SAV area (-150' long x 25' wide).
Relocating boat ramp traffic to the existing deep water harbor area and existing channel would
stop any incidental impacts to the 7000ft2 of SAV habitat and allow it to be undisturbed in the
future. The proposed ramp construction would have no negative impacts to SAV habitat. The
proposed maintenance dredging and boat ramp traffic consolidation would have a negative
impact on SAV that has reestablished itself within the existing channel and a positive impact on
SAV that is in the path of the existing boat ramp. NCWRC believes that overall impacts to SAV
would not be major and would be necessary for benefit of the public. Enclosed with this CAMA
Permit application packet is a map of the SAV survey results and written comments from
NCDMF.
An earlier, smaller phase of redevelopment has already been carried out. Three
underground fuel storage tanks were removed from the marina store parking lot and
contaminated soil has been removed to ensure the environmental safety of the area during this
proposed full redevelopment. The initial phase of redevelopment required a CAMA Minor Permit.
Also at that time, and Erosion and Sediment Control Permit and a Stormwater Permit Exemption
were issued for the full redevelopment of the site, including proposed work in this permit
application. As required by NCDENR-DWM regulations, a Notice of Residual Petroleum (NRP)
for the property was recorded with the Onslow County Register of Deeds in May 2011 and
DENR-DWM issued a Notice of No Further Action for the site in June 2011. The NRP does not
result in any restrictions on the type of redevelopment proposed.

currently not in use. The one for the Green Turtle restaurant is in use and will be filled in when that building is torn down
during site redevelopment.

Stormwater is collected by ditches and drop inlets and is discharged into New Rivery by 3 outlet pipes.

of equipment and where it is to be stored.
Proposed dredging would be bucket-to-barge dredging using a barge and excavator. Ramps will be poured on high ground
and pushed into place. Equipment used will be excavator, bulldozer, paver, dumptruck, back hoe. Equipment will be stored
on-site.
d. List all development activities you propose.
Revelopment of entire site - removal of existing buildings, ramps, and docks. New development includes bulkheads, rip rap
shorelines stabilization, 2 boat ramps, 3 floating docks, 1 shoreline dock, asphalt parking lot, asphalt maneuver area and
driveway, and gravel overflow parking. At the request of an adjacent landowner, a 6` wood privacy fence is also being
constructed.

NCEPA Statement of Compliance
The proposed improvements to the Sneads Ferry Boating Access Area involve
public funds and public land. The project does not significantly affect the quality
of the environment as the land use will remain the same and the access channel
is existing. The project is in compliance with the North Carolina Environmental

The North Carolina Division of Marine Fisheries (DMF) has evaluated the proposed Sneads Ferry WRC
Boating Access Area. WRC proposes to install a boat ramp and dredge the existing 3-foot deep channel
to depth of 4 feet. On April 12th, DMF and WRC staff conducted a survey for submerged aquatic
vegetation in the project footprint. The survey was conducted by boat using a modified clam rake. The
weather was sunny but the water was turbid so that the surveyors could not see the bottom. WRC
mapped the findings of that survey (see attached).
The areas immediately adjacent to shore and out approximately 100 feet were found to be highly
disturbed, deeper, and no SAV was detected. Continuing out the proposed channel, from 100 feet
offshore to 250 feet offshore, SAV coverage was estimated as sparse, at approximately 25%. Beyond
250 feet from shore, patches of SAV were encountered by raking and overall coverage was very sparse,
at five percent or less.
Aerial photographs obtained by WRC confirmed that the proposed project area has been historically
dredged and used by large fishing vessels. Although, there is an existing boat ramp on the property
adjacent to the proposed ramp, WRC chose this ramp location because it results in the smallest amount
of dredging and least amount impacts to SAV.
Although, a minor amount of SAV is present within the project area, there would not be significant
adverse impacts from this project because 1) the amount of SAV habitat to be impacted is small, 2) the
applicant minimized impacts by locating the channel in the footprint of the deepest existing channel
with the least SAV, 3) the area has been dredged in the past, and is therefore considered maintenance
dredging, and 4) the project will be consistent with historical use as deep water access for fishing.
We do not object to the project in this location. However, all excavation activities should be completed
outside of the in-water work moratorium from April 1" to September 30th.

NOTICE OF RESIDUAL PETROLEUM
Sneads Ferry Boat Access, 312 Fulchers Landing Loop Road, Sneads Ferry Onslow County, North
Carolina
The property that is the subject of this Notice (hereinafter referred to as the "Site") contains
residual petroleum and is an Underground Storage Tank (UST) incident under North Carolina's
Statutes and Regulations, which consist of N.C.G.S. 143-215.94 and regulations adopted thereunder.
This Notice is part of a remedial action for the Site that has been approved by the Secretary (or
his/her delegate) of the North Carolina Department of Environment and Natural Resources (or its
successor in function), as authorized by N.C.G.S. Section 143B-279.9 and 143B-279.11. The North
Carolina Department of Environment and Natural Resources shall hereinafter be referred to as
"DENR".
NOTICE
Petroleum product was released and/or discharged at the Site. Petroleum constituents remain on
the site, but are not a danger to public health and the environment, provided that the restrictions
described herein, and any other measures required by DENR pursuant to N.C.G.S. Sections 14313-
279.9 and 143B-279.11, are strictly complied with. This "Notice of Residual Petroleum" is composed of
a description of the property, the location of the residual petroleum and the land use restrictions on the
Site. The Notice has been approved and notarized by DENR pursuant to N.C.G.S. Sections 143B-279.9
and 143B-279.11 and has/shall be recorded at the Onslow County Register of Deeds' office.
Source Property
The State of North Carolina is the owner in fee simple of all or a portion of the Site, which is located in
the County of Onslow, State of North Carolina, and is known and legally described as:

BEING all of that 0.2904 acre tract of land as shown on map entitled, "Property of Franklin E.
Justice and wife, Shera A. Justice", dated March 6, 2006, prepared by L. Weston Lyall, PE, PLS
and recorded in Map Book 50, Page 147, Slide L-1245, of the Onslow County Register of Deeds
and being the same property identified as 0.2904 acres as shown on that plat entitled "Sneads
Ferry Boating Access Area", recorded in Plat Book 59, Page 203, Onslow County Registry.
For protection of public health and the environment, the following land use restrictions
required by N.C.G.S. Section 143B-279.9(b) shall apply to all of the above-described real property.
These restrictions shall continue in effect as long as residual petroleum remains on the site in
excess of unrestricted use standards and cannot be amended or cancelled unless and until the
Onslow County Register of Deed receives and records the written concurrence of the Secretary
(or his/her delegate) of DENR (or its successor in function).
PERPETUAL LAND USE RESTRICTIONS
Groundwater: Groundwater from the site is prohibited from use as a water supply. Water supply wells
of any kind shall not be installed or operated on the site.
ENFORCEMENT
The above land use restriction(s) shall be enforced by any owner, operator, or other party
responsible for the Site. The above land use restriction(s) may also be enforced by DENR through any of
the remedies provided by law or by means of a civil action, and may also be enforced by any unit of local
government having jurisdiction over any part of the Site. Any attempt to cancel this Notice without the
approval of DENR (or its successor in function) shall be subject to enforcement by DENR to the full extent
of the law. Failure by any party required or authorized to enforce any of the above restriction(s) shall in no
event be deemed a waiver of the right to do so thereafter as to the same violation or as to one occurring
prior or subsequent thereto.
