Re: Condition 14 of the Water Quality Certification Pursuant for the Greensboro Western Outer Loop in Guilford
County, TIP Project No. U-2524 AB&AC, DWQ Project No. 030303
Dear Mr. Thorpe:
Thank you for your correspondence dated January 7, 2004. Condition 14 of the referenced 401 Water Quality
Certification states that the relocated channels and associated riparian buffer areas shall be preserved in perpetuity
through a deed notification, preservation easement, or some other legally binding mechanism. After reviewing your
proposal submitted. in January 7, 2004, we believe that Condition 14, as written in the 401 Water Quality
Certification, is not adequately fulfilled without a proper conservation easement be signed. In lieu of a conservation
easement (or other acceptable legally binding conservation easement), we will accept DOT's ownership of the site
as part of the road Right-of-Way. Please provide a copy of the easement or proof of DOT ownership of the property
in question in accordance with the timeframe detailed in Condition 14 of the 401 Water Quality Certification.
