stream channel of UT to Hickory Creek in Guilford County on TIP Number
U-2524 AB/AC, Federal Aid Project No. STPNHF-NHF-124-1(1) State

Dear Sir:
The purpose of this letter is to request that the North Carolina Ecosystem Enhancement
Program (EEP) provide confirmation that you are willing to provide compensatory mitigation for
the project in accordance with the Memorandum of Agreement (MOA) signed July 22, 2003 by
the USACE, the NCDENR and the NCDOT.
The North Carolina Department of Transportation (NCDOT) is proposing to extend a
stream channel relocation as per the attached drawings. The relocation is associated with an UT
of Hickory Creek located on new right-of--way near the intersection of Groometown Road and I-
85 in Guilford County (SITE 7 within the permit application). The NCDOT met with John
Thomas of the USCOE (1-28-OS) and Sue Homewood ofNCDWQ (2-1-OS) to discuss
extending the stream relocation from the permitted stream relocation to the 1500 mm pipe located
approximately 56 meters north of the permitted stream relocation. The reasoning for the need of
an extended stream relocation is that the existing stream between the relocated stream and the
1500 mm pipe has been deemed insufficient to handle the anticipated flow of water once the
project is completed. Both members of the regulatory agencies concurred with the determination
and recommended that NCDOT request a modification.
RESOURCES UNDER THE JURISDICTION OF SECTION 404 AND 401 OF THE
CLEAN WATER ACT.
We have avoided and minimized the impacts to jurisdictional resources to the greatest extent
possible as described in the permit application. A copy of the permit application can be found at
htt~p~//www ncdot org[planning_/pe/naturalunit/Applications.html. Compensation for impacts to
jurisdictional resources have been provided by the EEP program. However, this modification will
create additional impacts to jurisdictional resources. We estimate that 137.8 linear feet of
jurisdictional perennial stream, 0 acres of wetlands, and 4,526 square feet of ripazian buffers will
be impacted.
The project is located in the Piedmont Physiographic Province in Guilford County in the
Cape Feaz River basin in Hydrological Cataloguing Unit 03030003
• The stream impacts, summarized in Table 1, will be to a first order perennial stream that is a
tributary to Hickory Creek [DWQ #17-8.5-(1)]. Stream impacts aze not proposed to be
mitigated because the existing stream will remain, therefore, no loss in linear footage of
stream is anticipated.
• There aze also no anticipated wetland impacts.

RIPARIAN BUFFER PROGRAM
Notes utilized for calculating impacts
-The east side of the stream is vegetated almost entirely with grasses (see pictures). Re-
forestation will not be necessary. Therefore, buffer impacts to the east side of the stream
are not included in the calculations.
-No loss in linear footage of the existing stream is anticipated, therefore, stream impacts are
not included in the calculations.
-The existing stream is proposed to be widened within it's existing footprint. Impacts are
proposed to cover a 10 meter(32.8 ft) wide X 138 ft long area which includes the width of
the stream (approximately 4 ft) and the area along both sides of the stream.
-Only the west side of the stream (16.4 ft wide) has been included in the mitigation impacts
minus 2 ft (1/2 of the stream width). Therefore, mitigated impacts are calculated by
multiplying 14.4 ft X 138 ft.
-Reforestation is planned for the west side of the stream which should encompass the entire
impacted area of 1,987 square feet. It will be subtracted from the mitigation impacts.
-All mitigated impacts are in Zone 1 of the riparian buffer.
We propose to mitigate for the Randleman Buffer impacts by using the EEP for the 1,987
square feet of impacts by contributing $3,815.04 to the EEP.

This amount of mitigation is what NCDOT anticipates is needed to satisfy permit
requirements of the North Carolina Division of Water Quality (NCDWQ) for buffer impacts.
Upon receipt of the 401 Water Quality Certification from NCDWQ, NCDOT will transfer funds
to EEP for buffer mitigation.
In order to satisfy regulatory assurances that mitigation will be performed; the NCDWQ
requires a formal letter from EEP indicating their willingness and ability to provide the mitigation
work requested by NCDOT. The NCDOT requests such a letter of confirmation be addressed to
Mr. John Dorney of NCDWQ, with copies submitted to NCDOT.
