Dear Sir: As you are aware, the North Carolina Division of Water Quality (NCDWQ) issued a 401 Water Quality Certification (WQC), dated October 6, 2003, to the North Carolina Department of Transportation (NCDOT) for the construction of the Greensboro Western Urban Loop from I-85 south of Groometown to south of I-40 interchange. The purpose of this letter is to request NCDWQ to modify Conditions 1, 3 and 15 in the 401 WQC. Your staff requested information about relocations and station numbers. This information can be found in the permit drawings provided with the original Section 404/401 permit application from July 2003. However, attached to this letter are summary sheets for the stream impacts with the relocations noted with an asterisk ("*"). The station numbers for the corresponding sheets are also located on sheets. ,iConditions 1 and 3. The NCDOT requests NCDWQ to include the new language regarding these "standard" conditions. Condition 15. Under the first bullet of wetland mitigation section for this condition, it states the North Carolina Wetland Restoration Program (NCWRP) with a payment sheet attached to the WQC. The NCDOT asks NCDWQ to modify this condition stating the: NCWRP will provide the mitigation and NCDOT has already provided payment to them. Additionally, the payment sheet for the impacts to the Randleman Buffer is needed. The NCDOT will be paying into the N.C. Wetland Restoration Program (NCWRP) for the Division of Ecosystem Enhancement.~DEE) to do the work. This payment sheet was not included with the origina1401 WQC issued for the project. Finally, based on various conversations about stream mitigation for this road project, the NCDOT understands it is most prudent to use the stream mitigation originally proposed in the Section 404/401 permit application from July 2003. This proposal included Woodlyn Way, Tick Creek and UT Bear Creek. Attached to this letter are mitigation plans for the three stream projects as well as 100% design plans for the Woodlyn Way and Tick Creek sites. The NCDOT commits to providing 100% design plans for UT Bear Creek within three months of the issuing of the modified 401 WQC. The NCDOT is not sure if another payment is needed to modify the 401 WQC because the stream mitigation, as now proposed, was included in the original Section 404/401 permit application from July 2003. If a payment is needed, please debit electronically from our account using the ~VBS element number for road project.
